So what you're saying is that if I want to fuck over someone I don't like, I can mail him some cocaine, making the box in such a way that postal inspectors will have reason to suspect something, then they'll perform a controlled delivery and my nemesis is whisked off to prison.

Can it really work that way?

First, he'll have a fair trial and then be whisked off to prison.

Truth be told, If someone has the desire and willingness to frame someone else...it's gonna be a hard rap to beat.  If I ever got a package of coke in the mail, I'd call the cops immediately and say "I don't know what this shit is, but I got a box of white powder."  Of course, if the door gets busted in first, that's gonna be tough to do.

A case like that would hinge totally on the testimony of the defendant. The more credible he seems on the stand, the better his chances are...but he's got an uphill battle.  This is even more so if he's got some skeletons in his closet that can be used against him at trial.

Very much so.  Of course, the likelihood of the usps catching that particular package is low...and after the first time, if the dude calls the cops like he should, it's unlikely that a future attempt will be successful.

In addition, the more obvious you made the package, the easier it is to argue that it's a setup.  If you wrote "do not open, illicit drugs inside", that would be a pretty easy case to beat.

I absolutely don't recommend that you do anything like that.  In addition, the fact that he has made enemies in the drug trade would make his defense that much stronger.

If the warrants are conditional on delivery, what constitutes delivery? If its put in your mailbox, is that enough to get the warrant executed and they bust in? In the example of getting even with someone, if you have a good idea they use drugs or better yet deal them, you could do the dirty package and the cops break in, perhaps he beats the possession of the package charge but since they find drugs in the house or apt and its on a legal warrant, they can stick him with that even if he gets off on the package. In that case, if you get a fat letter or package you didn't expect, maybe you should just leave it in the mail box or not even take it out?

Have cases such as these come up in reality, in your experience or what you've heard of? It would be nice to separate the theory from normal practice. If its never happened its less of a threat than if it happens somewhat often.

A package need not say "drugs inside" it could be rubbed with a nice fragrant bud all over so that while it looks normal, even a bored clerk is likely to notice something wrong about the smell. Or, since other strong odors are considered likely indicators, simply soaking it in perfume would accomplish the same job and a little bud inside with a note saying "here is the sample, i'll send the other 10 kilos if you like it"

I've never had a case where drugs were delivered by mail, nor have I ever heard of one.  That doesn't mean much since I work in an inner city where drugs are often handed off personally.  I have, however, known of several cases where guns were delivered by mail.  All of these cases had a conditional warrant which was executed after the guns were delivered...In two of these case, I know that the cops waited for the package to be taken inside of the house...I assume the rest were like that as well.

It sounds like the best practice is to not order anything that must be signed for, leave it in the box at least until night or over night. Come and go a few times to check out the neighborhood, and not take the package in unless everything is squeaky clean. Does anyone see a flaw in that theory?

So I was riding my bike around the University of Miami campus this morning and noticed several UM Police driving around. I was wondering how that works. How does a private organization have an actual private police department (not security guards) that can arrest people and even shoot them like any other cop?

This is from their web:

The University of Miami Police Department (UMPD) adherers to the philosophy of Community Policing. Community Policing is a direct expression of our mission statement. Our police officers are an integral part of the campus, a place where our students, visitors, faculty and staff feel safe.

UMPD is a professional law enforcement agency that actively works to maximize the quality of life on the Coral Gables campus through proactive community policing efforts and continuous crime prevention programs.

All University Police Officers are State of Florida Certified, sworn and empowered through the City of Coral Gables. Can anyone create a personal police department equally empowered to enforce the law as a municipal police department?

Say you'd like to avoid arrest but are caught with small amounts of an illegal substance, or even anything that's a minor crime without any reason on the part of the officer to believe that you'd skip town after getting a Notice To Appear. How likely is it to be given one, and what's the best way to improve your chances of getting one ( obviously being polite to the officer is one)?

Generally no.

In my state the legislature passes a bill that grants the entity the authority to form a police department.  The public universities just hte same as the private.

Most campus police are trained and sworn in by the police department of the city, county, or state.  They are simply funded by the university.

Such things are often a matter of policy with little discretion left to the officer.  Be polite, and ask if you can just be given a summons to appear.  If an officer has the option, usually he will take it.  Hauling someone to jail and filling out an arrest report is more with for him.

Of course, some departments and/or individual officers might have a particular incentive to arrest...i knew an officer who preferred to arrest because he had a thing for the girl working the intake counter.

Hey Enlil just to follow up on that case where I was sued for $6.2k for a delinquent credit card, I got them down another $800 and settled for 70%, or about $4400. Thanks again for your help.

Sad to say I had over $70K in debt across many different credit cards. One I had reduced down from 31K to $5,200!

Now I have no debt, and my credit score is up from "Escort this fuckin' scumbag to the door before he steals something" to "we'll politely reject his application."

Teach me to dive headfirst into a money-making venture without a solid business plan.

So I was out diving and hunting lobsters this weekend and on my way back we were stopped by the Florida Marine Patrol, basically cops on boats. They searched my boat and counted our lobster catch to make sure no one had caught any protected fish or were over-limit on any catch. Made me open every hold and cooler, inspected my flair gun, and they counted the life preservers to make sure there was one for each passenger as required by law.

Now, this happens all the time in Florida. I've always complied without a second thought, and as far as I know, compliance is required. If the FMP or coast guard even wants to board, I have to let them.

My question is why are search laws different on boats than they are in cars? With a car, I have to get a license and give implicit consent to a sobriety test or risk losing my license. But I don't need a license or even have to be of adult age to drive a boat.

So how does it happen that my boat can be searched without consent but not my car?
