Unfortunately I don't know the exact words. After I was terminated from my job, someone said I had made indirect gun threats against a couple of the employees there. I found out because I know someone who knows the person responsible for taking down these police reports but either she couldn't remember or just doesn't' want to say what the exact wording reported was. I think she said it was something along the lines of "I'm tempted to go get my gun and take care of business". But that can't be the entirety of it because she said that certain employees were mentioned by name.

I'm kind of nervous about even posting any of this, I'm not supposed to know, obviously she's not supposed to of pretty much directly went and told me that a police report has been filed against me.

The report was apparently filed sometime this morning, or maybe even yesterday but no one has came or contacted me. I plan to stay as far away from everyone involved so as to not antagonize anything further.

I just really do not enjoy this feeling of paranoia of just waiting for cops to come beating on my door, and my fear is that if they are pursuing the reason they haven't yet came is to obtain a search warrant. I do indeed own a gun. I don't know how the law works but it would seem that would definitely lend credence to the threat being "credible".

"I'm tempted to..." isn't a threat.  It might be enough for a restraining order, but it isn't a criminal threat.

Well that put's my mind at ease a bit I guess.. If that's what was written down, I should be good. I have no problem with a restraining order. I don't plan to return there anyways.

I also just wanna say thank you for taking time out of your day to do this stuff for people. I try to find stuff online and it never really works out. Just get a bunch of conflicting information or can't find specifics, like this situation I'm in. Everything I found was more about the victim's standpoint and what they should do when a threat is made. Not much about what the 'perp' could expect, other than what the maximum sentencing could be.

Hey Enlil.

I have a little story followed by a question(s) if you have time.

When I was 25 I got into a car accident, leaving the scene with injury.
I was then given a felony suspended sentence. I was to complete 18 month probation in FL. Anyway I messed up (completed 17 months). I ended up becoming homeless violating my probation. Was arrested for the violation and then bailed out of jail.
I then ran to MA while out on bail. I have now been living in MA for 5 years without any trouble. The police here simply let me know that I have a warrant in Fl any-time they pull me over. My license is suspended in Fl, yet I was able to obtain my MA license, and live happily ever after. Great story right?

Here is the problem. My father has become ill recently and guess where he lives.

I would like to clear this up somehow. I have no idea where to begin. My suspended sentence involves 5 years in prison. I have never been in any other trouble with the law other than this.

1. Is going to the pen in Fl my only option?

2. How can I avoid this?

Man I think that what you do here is a truly spectacular service that shows your generosity.

That one is kinda easy.. Or maybe I just know the answer because my father has been dodging warrants all across the US and is starting to run out of states.. If they don't catch you, they can't take you to prison and I really doubt you're high profile enough to stake out your terminally ill father just to catch you. Question is, is it worth it?

I just wish I did the time. I would have been out fast I bet.. Probation was a stupid option for me at the time.
I just want to be free. I feel like I want to go there more just because I know I cant.
My dad has the exact opposite problem as me. Cant come to Ma:facepalm3:

Do you think I could fly there without any problems? Or a bus?

I'd wait to see if Enlil has anything to say on the matter but it's pretty much just you get caught you go to jail afaik. It's not like they're gonna be checking passports at the gate or running facial recognition software looking for you as soon as you hit state lines. I would be too paranoid to fly, but driving entails more risk. Get pulled over, legally or not, they run your license, that's it.

Yup I am sure he will chime in soon. I know better than to even attempt to drive in fl.
The cops there can smell yankees like me from a mile away.

I also am not a paranoid freak who thinks the president himself is watching me through my web cam to try and profile me for facial recognition software:rofl2:

I am really just wondering if I should try to contact the Judge and apologize. Maybe with my circumstances being so much better than they were back then. I have a good job, have not been in any trouble since ect ect.

Maybe beg for the mercy of the court..  Idk

not sure if you deal with family law.
but what would be a smart way for a man to get into marriage.
and be ready for a divorce just in case.

what I mean is. we are at a disadvantage when were married. decisions usually favor females. and you hear a lot of stories that certain( she) ended up with everything or half of what he had.

what should men do or not do during marriage to be better off IF the time comes to go separate ways.

This can go any number of ways, but it starts with you retaining a FL lawyer.  I have seen it where people who have absconded like you return years later and be sent home without any further time.  I've also seen them get sent to prison.  There is a good argument to be made that probation is about rehabilitation and that your 5 years without getting into trouble is evidence of that rehabilitation, but some judges are hardasses.

Get an experienced criminal lawyer in the county, and he/she should know each judge enough to get some idea of what to expect.  Having said that, there are no guarantees.

As far as visiting, the best bet is to take a plane or bus and don't drive while you're there.  If cops check your ID, you're probably gonna be arrested.

There isn't a whole lot that you can do to prepare.  You can get a prenuptial, but that's not very useful unless you have assets before you get married.  Even with a prenup, all money earned during the marriage is usually going to be community/marital property.

My advice is that if you're that scared of losing assets in a divorce, don't get married.

Let's say that a person is carrying contraband in a cigarette case.  And a police officer frisks you and feels the case, can he/she make the person open it? 

Now that same scenario as before except that the person smells like pot, will the officer make the person open it?

Now if there is a dog involved does the officer need a warrant to open it?

So I have a friend who is old and expects to die soon, but he is still healthy and his mind is sound. He is divorced from his wife for about two years and he has a minor son he pays child support for. He purchased a house after his divorce and the x-wife is not on any of the house or mortgage documents.

His family, who he dislikes, is waiting for him to die so they can take his house which has substantial equity accumulated. He has added me to his credit card account as a second authorized signer, and I often make purchases for him using his credit account but with a card issued in my own name. On occasion I have paid his child support payment with a check from my own checking account of which I am the sole owner.

My friend wants to prevent his family, including his son, from getting the house when he dies. He wants me to have the house, but for reasons I can't get into, he doesn't want to write a will. To that end, he gave me a durable power of attorney. He also added my name to his credit card account as a second authorized signer with a card in my own name. The POA document states that I have perpetual and total control of all his assets.

The POA also expressly states that the fate of the house is entirely in my hands now and after his death including the power to keep the house for myself against his family's objections.

My question is: how powerful is this document in the real world? If he dies and I want to keep the house for myself (after I pay off the mortgage of course), can his parents, son, or anyone else override the POA and prevent me from keeping the house?

If not, is there any way for me to keep the house but without a will of any kind existing?

The POA will become ineffective at the time of his death, so if you want to transfer the house into your own name, you have to do it before then. 

The smart thing to do is to have him execute a quitclaim deed signing his interest in the property over to you, and to record that deed.  This will effectively transfer all of the equity over to you, although the loan will still be in his name. 

Another option is for him to move the house into a trust with you as the trustee.  That way, the trust can survive his death.  Again, the house has to be transferred while he's still alive.

The quitclaim is super easy and cheap to do, but the trust is a bit more bulletproof and a bit less transparent.  If he executes a quitclaim, the family can find out about it if they check public records.  If he transfers to a trust, only the transfer is public record, but what the trust does with it is not.
