Hello Enlil. I was recently brought in for criminal mischief: reckless property damage. The officer told me hewasnt going to charge me with the class D felony it could have been and went for a lesser degree. I received a call from my public defender today letting me know that my court date was moved and that the ADA was charging me with a felony. She didn't say what. The long and short of my question I guess would be, can the ADA change the charges, or was I perhaps lied to by the officer? I was given an appearance ticket for the offense, section 145.0003 of the penal law. I am from upstate NY.

Ok that makes sense.Thank you.One more question if I may? At the time of my arraignment I was able to qualify for a public defender. If I am able to get enough money to hire a different attorney, am I able to do that? I know if you have hired an attorney you can fire them at any time but is it up to the judge's discretion when it comes to a public defender?

I was pulled over a few weeks ago by an unmarked state trooper vehicle. I was issued a seat belt ticket.I plead not guilty because ive heard it isn't legal for unmarked vehicles to do V&T. Should I fight it? I live in upstate New York.

I'm going to co-sign for an apartment for a friend. The paperwork the property manager gave me is for a renter, but im not going to live in the apartment. Im pretty much juat going to be the garuntor. Should I only be filling out the parts that allow for my credit check and all that jazz? Im not trying to move in so moving date, pets, type of vehicle, all these aspects of the paperwork i ahould be able to skip over, yes?

Yeah, that scene was a lottle sketchy. Turns out the property manager was using the term garuntor and cosigner interchangably. I didnt go through with it.

I'm not a lawyer but my guess is that you should have put those stipulations in the contract. I e made a lot of dumb car deals that I got fucked in so I fell your pain sir.
