Scenario: There are multiple people living in a house and a search warrant/knock-and-talk goes down. There is a grow op in one bedroom and a (legal) gun in another bedroom. What's likely to happen? Will everyone living there be charged? If only the grower is charged, will he or she having amplified charges for the gun being present?

Enlil: My room mate and I went to the DMV to get ID cards yesterday (he lost his 2+ years ago, I don't have a photo ID because my license was revoked/currently have a limited driving privledge).

He got everything sorted out with his photo ID and has a new one on the way, but found out his license is revoked because of a speeding ticket + 2 failure to appear charges from 2005. Now, I know this is EXTREMELY low on the list of important shit for cops to do and probably varies jurisdiction-to-jurisdiction, but (in your experience) what's the likelihood of the police coming to our house to look for him now that his address has been updated? Would they ever haul him in if he's in a car that gets pulled over?

I wish. Getting the guy to go to the DMV to get a fucking ID was a minor miracle, he's a 30-something year old stereotypical deadbeat stoner that works in fast food. I know he's not going to take care of it, I just wanted to know if it's going to affect me by the cops showing up at our doorstep.

That's my primary concern. This guy is a fucking moron and smokes in our front room all the time. You and Enlil pretty much re-affirmed what I thought.. going to have a long chat with this guy about getting this fixed and let him know he needs to find another place to live if he brings any heat to our door.

Absolutely. Your advice is noted and appreciated, along with everyone else thus far. This guy has been an issue on other things, but his name is on the lease. It will be made clear that if he refuses to solve this problem and continues to spend money that should otherwise go towards a lawyer/fines on pot and booze, then he will need to find a new place to live once the lease is up.

Enlil, not sure if you heard about the SCOTUS ruling that came out today in Salinas v. Texas, 12-246 but it appears that pre-Miranda silence can now be used against defendants. Specifically:

Any comments/opinions on this as a defense attorney? My interpretation is that this will only affect individuals who begin talking with the police and then begin to refuse, for fear of self-incrimination.. which is still awful shitty.
