Court orders NDLEA to produce Baba Suwe October 26, 2011 - thenationonlineng.net
Justice Yetunde Idowu of the Lagos State High Court, Ikeja, yesterday ordered the National Drug Law Enforcement Agency (NDLEA) to produce comedian Mr Babatunde Omidina (also known as Baba Suwe) before her “physically” on November 1 by 9am.
Her order followed a Motion on Notice dated October 24. It was moved by Omidina’s counsel, Mr Bamidele Aturu, who led Mr Kunle Adegoke and others.
They sought an order directing the NDLEA to release the applicant from detention forthwith, pending the hearing and determination of the substantive suit.
In the alternative, they prayed for an order directing the respondent to produce Omidina in court on the next adjourned date.
Omidina has been in detention at the NDLEA’s facility since October 12 without trial.
Omidina’s first son Adesola, in an affidavit he swore to in support of the motion, said his father has been a diabetic patient for over five years and is in danger of death because he has not had access to his medical doctor.
He said: “My father told me when I visited him on October 24, 2011 at the detention centre at the airport at about 6pm that he did not ingest any narcotic substance, and I verily believe him.
“He also told me that he had so far defecated eight times without any banned substance in his excreta, though he ate thrice daily. It is in the interest of justice to grant this application.”
NDLEA’s Director of Legal Services, Mr Femi Oloruntoba, did not oppose the application that Omidina be produced. He expressed concerns over the crowd that may accompany him to court that day.
“We are not opposing the application. The applicant is in good condition. We urge the court to make such consequential order as to avoid a breach of peace,” he said.
Justice Idowu granted the application.
Aturu asked for an adjournment to enable him file a further reply to NDLEA’s Counter Affidavit in opposition to Omidina’s N100 million fundamental rights enforcement suit.
In the suit, the actor is praying the court for an order to release him immediately from “the unlawful detention” in which he said he is being held at the respondent’s pleasure.
The applicant asked for N100 million as compensation from the NDLEA for alleged illegal and unconstitutional violation of his fundamental rights, as well as a public apology from the NDLEA.
The Publicity Secretary of the Human and Environmental Development Agenda, Mr Kazeem Mohammed, said in affidavit on behalf of Omidina: “His children, dependants, relatives, friends and associates have been greatly worried and subjected to unnecessary trauma by the continued detention of their benefactor and associate who has been in detention for days without any lawful charge brought against him.”
But the NDLEA, in its counter affidavit, said Omidina’s arrest and detention were within the purview of the law and the Constitution, so he does not deserve the N100 million compensation and apology he is asking for.
It prayed the court to dismiss the actor’s case as lacking in merit and being vexatious.
NDLEA said: “It is not in the interest of justice to grant this application, as it will prevent the respondent from having the opportunity to supervise the excretion of the drugs ingested by the applicant. It is in the interest of justice to dismiss this application.
“He is not entitled to any of the reliefs claimed, including the sum of N100,000,000.00 damages.”

The 19-day long real life drama starring Nollywood comic actor, Baba Suwe, assumed a new dimension this morning with the revelation that the National Drug Law Enforcement Agency, NDLEA, has never held any drug suspect in its custody for 19 days since it was set up about two decades ago.
The disclosure by Mitchell Ofoyeju, NDLEA Head of Public Affairs, was made this morning as he assured that the comic actor will be produced at the Ikeja High Court tomorrow as ordered by a judge last week.
“We are a law abiding agency and we can’t go against the decision of the court. We will produce him tomorrow as ordered by the court,” Ofoyeju said.
Asked if NDLEA has ever held a suspect this long, Ofoyeju said: “no, we have not held a suspect this long. But our international partners tell us that they have had a case of a 19-day detention before the drug was excreted. It depends on body constitution.”
When P.M.NEWS inquired about the international partners he was referring to, Ofoyeju said, “I have to confirm.”
An Ikeja High Court last Wednesday ordered NDLEA to produce physically in court the popular actor.
Justice Yetunde Idowu granted this order, following an application by Omidina’s lawyer, Mr. Bamidele Aturu, who urged the court to mandate the agency to produce the popular actor on 1 November.
Babatunde Omidina, Baba Suwe’s real name, was arrested in the night of Wednesday 12 October at the Murtala Muhammed International Airport in Lagos, southwest Nigeria, as he was about boarding an Air France flight to Paris, France.
He was detained after strange particles packed like hard drugs were detected in his stomach by the United States-donated scanning machine known as Soter RS.
The actor denied the allegations and threatened to sue NDLEA.
The NDLEA maintained that it will be vindicated when the actor’s wastes are analysed.
For two days, millions held their breath, expecting the first exhibit from the comedian’s wastes. Such wastes are usually tested by the NDLEA to exonerate or incriminate detained drug suspects after analysis.
But when the waste finally arrived in the night of 14 October, it bore no hint of drug ingestion. Public interest rose. Another round of waste yielded nothing. The third excretion was thus eagerly awaited, especially after Femi Ajayi, NDLEA Director-General, said in a television interview that suspects are usually released after a third excretion tests negative to drug ingestion.
On Monday night, the comedian produced the third waste sample, which also yielded nothing incriminating. Then began strident public clamour for his release. On the web, the NDLEA was slammed by angry Nigerians.
The next day, NDLEA’s Head of Public Affairs, Mr. Mitchell Ofoyeju, left many Nigerians confused, when he announced that the comedian still had to remain in detention.
“I can confirm that Baba Suwe is still under observation. He excreted for the third time last night and no drug was found. But he remains under observation.
“It will not end at the third excretion because it depends on body composition. For some people, it takes more time, more excretions. It really depends on the body of each individual,” Ofoyeju said. The Lagos airport Commander of the NDLEA, Mr. Hamza Umar, disclosed that in previous arrests, some suspects expelled the drug at the fourth excretion.
As days passed, the arrest looked more like a comedy of gargantuan errors, with many suggesting that the agency was in a quandary. Many called on the actor to sue the NDLEA. But Ajayi claimed the agency was only doing its job.

If he was smuggling drugs were his contacts going to wait three weeks for him to poop it out?

Justice Yetunde Idowu of an Ikeja High court, this morning, ordered the National Drug Law Enforcement Agency, NDLEA, to release Babatunde Omidina, popularly known as Baba Suwe, on bail by Friday 4 November, 2011, if he fails to excrete the suspected narcotic substance he allegedly concealed in his stomach.
The judge made the order while ruling on the application filed by Omidina’s lawyer, Bamidele Aturu, for the enforcement of his fundamental human rights.
After listening to the arguments of counsel from both sides, Justice Idowu noted that she would have ordered NDLEA to released Omidina immediately but for a Federal High Court order which empowered the agency to hold him till Friday.
“The only thing hindering me from releasing the applicant today is because of the Federal High Court order of 20 October. I don’t want to meddle with that order. But if he (applicant) does not excrete the suspected substance he is accused of harbouring in his stomach by Friday, NDLEA should release him on bail,” she said.
She set the bail on Baba Suwe for N500,000 with two sureties in like sum, and further ordered that his international passport be deposited with the High Court Chief Registrar.
Before she pronounced the order, Baba Suwe told the court that he was in good spirits.
“I’m in good spirits. I am not harrassed. I eat three times daily,” he said.
Around the court premises, a phalanx of journalists, myriads of fans and actors held their breath while waiting for the verdict.
While some hung on the gate, others stood for hours under the scorching sun as legal arguments went on inside the court room.
Many of Baba Suwe’s sympathisers and fans arrived the court premises as early as 7.30 a.m. and were there long after 11 a.m.
“I believe they should free him since they do not have any evidence against him,” one man said without giving his name.
Before the proceedings opened at about 9.30 a.m., artistes arrived the court premises in droves. They included Adewale Elesho, Kayode Olaseinde a.k.a. Ajirebi, Sokoti, Remmy Shitta-Bay, Alhaji Ade Ade, Opebe, Alhaji Abdullahi Abdul Rasak, Chairman, Corporate Pictures, Soji Taiwo, a.k.a. Omo Banke, Tajudeen Gbadamosi and Alade Adesina.
When Omidina was being taken away by NDLEA officials at about 11’0 clock after the court sitting, his friends and colleagues were jeering and booing NDLEA officials.

Members of the Association of Nigerian Theatre Practitioners, ANTP, led by its former president, Prince Jide Kosoko, also called for the immediate release of the comedian.
“It is surprising and quite unbelievable that after a week in the custody of NDLEA and after excreting about three times without the purported hard drugs found, the authorities of NDLEA have refused to release him.
“This has not only brought untold humiliation, bad press and unprecedented public outcry against Baba Suwe, it has even brought our industry and all the theatre practitioners into public odium. Everybody in our industry is now seen as a potential drug pusher,” Kosoko said at a press conference in Lagos.

Kind of sucks he has to post bail- what's he charged with if there are no drugs?

Comedian, Babatunde Omidina, also known as Baba Suwe, was released by the NDLEA this morning.
A High Court judge had ordered the NDLEA to release Suwe on bail by today if no drugs were found on him.
Recall that the NDLEA had obtained a court order to detain the actor for an extra 15 days, this after he had spent 11 days in detention. The order was granted by Justice Okechukwu Okeke of Federal High Court, Lagos.
But Counsel to Baba Suwe, Bamidele Aturu, in an ex-parte motion application had asked the Ikeja High Court to order NDLEA to immediately release his client from detention and incarceration.
Justice Yetunde Idowu granted the request of the defense and ordered the NDLEA to release Baba Suwe on bail at the termination of Federal High Court order.
While Suwe had threatened to sue, the NDLEA is said to be considering its options.
