Cops now have a leg up on tokers

It may seem old school to make a driver stand on one leg for a roadside sobriety test, but that's one of the best available methods police have for determining whether or not someone is toking and driving.

Police believe the number of stoned drivers is increasing but their efforts to deal with the problem have been hampered by a lack of roadside tools.

But there may be an effective solution. Unable to use breathalyzers, cops are now counting on training. Officers across Canada are graduating as drug-recognition experts who are able to detect those impaired by drugs with a series of tests. A trained officer has several tests for drivers to determine impairment:

- A multiple-stage visual examination of specific movements.

- A pupil test that examines a driver's pupil size in four light levels.

- Testing for muscle tone by lifting arms.

- An attention test in which officers make motorists stand on one leg and balance.

"It's been an effective method and has worked quite well," said Insp. Kash Heed, in British Columbia, where the first Canadian officers were trained.

There have been several convictions of impaired driving in Vancouver based on evidence from these officers.

There are now three cops in Toronto with the new drug training but Ontario must pass legislation to allow courts here to accept evidence from these officers.

I know a cop in Atlanta who is supposed to be trained as a drug-recognition expert. I got him to check me 6 different times. I was only high on one of them. He didn't think I was high that time, but he concluded that I was high on 3 times when I wasn't.

Yeah, its amusing getting pulled over by cops here, stoned off my ass on hash for driving eratically. They give you a breathalizer, ascertain you arent drunk, and let you go. Gotta love hick towns...

Cops on my campus pull people over all the time to see if they are drunk. Its really funny because the police have actually told me that they don't give a damn about weed unless you are too stoned to function.

Remember the alcohol sobriety tests? Say the alphabet backwards? Like many people can do that sober...
I'm pretty sure I could balance on one leg easily when stoned. It's not exactly difficult, you just have to concentrate. What about people who can't stand on one leg very well while sober? Does that mean they're stoned?

I used to practice all the typical tests whenever I would get messed up.  You cannot easily get around some of the involuntary responses that they look for, but you can be used to standing on one leg, waving your arms like a chicken, etc.  I know the alphabet forwards and backwards now... :smile:

Of couse we shouldn't be driving when we are in an altered state, be it drunk or other.  I had a good friend killed when a drunk driver lost control of his truck and plowed down the sidewalk where she was walking.  I have also had a drunk teenager drive his uninsured car through my closed garage door, hitting my parked car which ended up in my kitchen.  Our cat, which slept in the garage at night, was killed, but nobody else was hurt.

Being able to say the alphabet backwards isn't an indication that the person is sober. It's an indication that they drink and drive alot.

Id like to see how this plays out in the courts with no hard evidence, only an educated guess.
DA:"our officer thinks he was stoned" DEFENSE:"no he wasnt", they cant prove shit.
I realize this is Canada though so I hope it will play out just as well for our northern neighbors.

hey im all for smoking pot and driking and doing poretty much any drugs you want as long as you dont drive or do other things that can put other people in danger because of your bad choices.

Good point.  Most people can't recite it.  In fact, I was told by a chief police officer they're not interested in whether or not you can recite it.  They say your concentration will shift from maintaining a sober-looking state (if you're drunk and trying to hide the fact) to trying to recite the alphabet, so they're just watching to see if you become imbalanced or slur or or signs of impairedness.  Don't bother practicing the alphabet backwards, just don't get hammered and drive :smile:

Police are not doctors. You can refuse a field sobriety test at any time without any reprocussions. You cant refuse a breathalizer without getting arrested, but if you are high, then who cares about a breathalizer.

I have seen several cases thrown out because a police officer arrested someone based on a field sobriety test. Those tests are just a power trip for a police officer and have no legal standing.

I was once arrested and put in jail for DUI drugs while completely sober (had been for several days) by a "Drug Recognition Expert". They made me stand on one foot for like a minute. Bullshit.

You can refuse a a sobrity test... so they give you a breathalizer... you refuse that? Obstruction of Justice, Contempt of court when you get there ofcourse.. and why do you worry about these things? Ban alcohol and legalize smokin pot, thats the fuckin problem.
