Thx for all the info Chemy...i'm looking up state laws and stuff now and i see where it says class d and what takes place, usually. seems like indiana is real strict.

Indiana is not a guidelines state and I can't find the mandatory statute for DUI 2nd sub. conv.
IC-35-50-2-1
Minimum sentences:
(5) for a Class D felony, one-half (1/2) year.

IC 35-50-2-7 Class D felony Sec. 7. (a) A person who commits a Class D felony shall be imprisoned for a fixed term of between six (6) months and three (3) years, with the advisory sentence being one and one-half (1 1/2) years. In addition, the person may be fined not more than ten thousand dollars ($10,000). (b) Notwithstanding subsection (a), if a person has committed a Class D felony, the court may enter judgment of conviction of a Class A misdemeanor and sentence accordingly. However, the court shall enter a judgment of conviction of a Class D felony if: (1) the court finds that: (A) the person has committed a prior, unrelated felony for which judgment was entered as a conviction of a Class A misdemeanor; and (B) the prior felony was committed less than three (3) years before the second felony was committed; (2) the offense is domestic battery as a Class D felony under IC 35-42-2-1.3; or (3) the offense is possession of child pornography (IC 35-42-4-4(c)). The court shall enter in the record, in detail, the reason for its action whenever it exercises the power to enter judgment of conviction of a Class A misdemeanor granted in this subsection.

I dont know about other states but a friend of mine in Cali got a 2nd DUI and was given jail time, but instead of going to jail he just did community service for a while.

Hah,yea everything is ok. A lot of 10 codes have different meanings in which case mine is "intoxicated pedestrian." But I should probably change it to 10-57 since I only really get fucked up at bars and at house parties/my house. I have been known to wander around drunk as hell tho, During those times it just seems like a good idea for some reason.

I had the unfortunate situation of getting a DUI in Arizona...which is notorious for having some of the harshest (if not THE harshest) penalties for DUI offenders. A few thousand dollars in fines, mandatory jail time in the infamous 'Tent City', alcohol classes, traffic school, and mandatory interlock device for at least a year...and that's for first-time, non-extreme offenders! You just have to learn from it, and get the penalties over with as quickly as possible so you can move on.

It sucks.

When I was sentenced (not for a DUI though) they gave me 21 days to report in. I just had to let the sheriffs office know when I was coming.
Jail now --- Jail later 
I went 3 days later.
He'll probably get a day or two to report if his lawyer asks for it.
