Michigan jury convicts 70-year-old woman in marijuana case
June 7, 2011 - Daily Tribune

An assistant prosecutor told jurors this morning to follow the law and not use sympathy when weighing the fate of a 70-year-old woman facing a drug charge.

Should this 70-year-old woman be sent to prison? What should be done with the medical marijuana law as well as the marijuana and drug laws in general? Comment below.

In the end, the jury heeded that advice and decided to convict Barbara Agro as charged. She faces sentencing July 13 on one count of delivery/manufacture of marijuana, a 4-year felony.

The former Lake Orion police dispatcher worked as a receptionist at a medical marijuana dispensary in Ferndale called Clinical Relief. When the facility was raided on Aug. 25, 2010, Agro told deputies that she had marijuana plants growing at her house. Deputies found 19 marijuana plants and other items during a search of her Lake Orion home.

“You must hold the defendant accountable for her actions,” said Assistant Prosecutor Beth Hand during her closing argument.

Defense attorney Jerome Sabbota said Agro used the substance for medical reasons.

“In this case here, we have a person who was growing medicine for herself,” Sabbota said.

Sabbota referenced old laws, such as those surrounding prohibition and a law that once made it a crime to harbor a runaway slave. In his opening statement yesterday, he told jurors that laws sometimes need to be changed.

Hand pointed out that Sabbota did not contest any elements of the charged crime.

Hand said marijuana, in the state of Michigan, is still illegal. She said Agro is not charged with using marijuana, but with growing it.

“This is not a medical marijuana case,” she said.

Hand referenced Agro’s age and told jurors that all different types of people break the law.

“The law is that sympathy and prejudice have no place in the courtroom,” she said.

Agro is a registered medical marijuana patient and caregiver. Oakland Circuit Judge Wendy Potts previously granted a motion from prosecutors seeking to preclude Agro from referencing the Michigan Medical Marijuana Act during the trial.

Michigan has a 12 plant limit.

her husband had a card too. thats a 24 plant limit in my state. he died a few days after the raid from a heart attack. the jury wasn't even alowed to hear the word MEDICAL MARIJUANA or hear of her card.

She was only 7 plants over the limit... Seems kind of harsh, but then again so does all marijuana laws in my opinion. Just another life ruined because of this pointless prohibition on such a harmless plant. She will probably spend the rest of her life in prison because of the ignorance of the prosecutors and jury. Makes me sick. :mad2:

:facepalm: this court case is a disgrace to the United States... Sounds completely unconstitutional to me. How could she not use medical marijuana as a defense when it is completely legal in her state? Cases like this make me question why we're called "the land of the free"...

The problem with voting is that the people really don't have the final decision in the presidential election, many candidates have actually won the popular vote but lost the electoral vote... The Electoral College chooses who's president in the end, and most don't agree with marijuana reform sadly. :sadyes:

I'm still voting though. Most likely going for :ronpaul: or Gary Johnson

True, but if we could get a president who actually agrees with marijuana reform things would go a lot smoother... Obama is making it really hard on the states to make their own decisions on marijuana by sending out the DEA and threatening letters to more than a few states. His hypocritical actions recently stopped Washington state from legalizing dispensaries unfortunately.

That is your problem right there. What a fucked up call to make. She is quoted as having both a card AND being a caregiver, so I bet she was within her legal limits. 

Its all about local elections :sad: If she were in Ann Arbor or Lansing that would not have happened

She was undoubtedly within her legal limits, her husband (who died a few days after the raid due to a heart attack) also had a card so that limit of 12 plants should have been 24, and she only had 19 plants. Plus the fact that she was a caregiver...

My question is, how can they not allow her to quote the Michigan Medical Marijuana Act? That's insane! Judge Wendy Potts has overstepped her boundaries by far by granting this motion. :shakefist:

I say Agro challenges the constitutionality of this decision. I'm almost certain this ruling is unconstitutional due to the fact they didn't allow her to quote a law that is currently in effect.
