Penny offense: Man fined for paying fee in pennies

No lucky pennies here: Police have charged Jason West, an aggrieved medical patient in Vernal, Utah, with disorderly conduct. His alleged crime? Attempting to pay a disputed medical bill of $25 entirely in pennies.

The story, reported in the Salt Lake City Deseret News, describes the "penny offense" this way: West, 38, did not believe he owed the medical clinic $25 but came in to pay the fee in person. He first asked the clinic staff if the facility accepted cash payments, and then dumped 2,500 pennies onto the counter and demanded that they be counted.

But West apparently hadn't counted on the clinic calling the police; the arresting officer contended that West's protest served "no legitimate purpose." The charge carries a fine that can go as high as $140--and there's no word as yet on what currency West will use to pay it.

West isn't alone in the ranks of penny protesters. A wise guy in Frederick, Maryland, showed up at the county clerk's office last summer with bags of cash to pay off his tax bill with $966.86 in change.

And a New Jersey school district a few years back punished 29 students who paid for their $2 school lunches in pennies--possibly as a prank--with two-day detentions. After parents protested, the students were pardoned. The school explained that the use of the small change slowed down the lunch line.

In Canada, using more than 25 pennies to pay for something is illegal. Unless they are rolled.

I found that on a weird laws website. To me, it makes sense... keep your fucking pennies or roll them

There was one court who allowed a man to pay a traffic ticket with pennies, except the judge would only accept it if the man counted them outloud in front of him :lol:  was a few hundred dollars too

One time I was buying a 9 dollar bottle of whiskey at a grocery store and I didnt have any dollars so I was useing all quarters and the bitch started giving me lip saying no I cant accept all quarters, and Im like, you have to accept quarters i been in here before and they accept quarters,  and she was like, no u should go to the coin machiene and get it turned into dollars, and i told her I cant do that because after percentage they take away from u I wouldnt have enough money to buy it, then after complaingg a more she accepted the quarters and I bought it and left.

My husband's line of work leaves him with an abundance of quarters. Once, he tried to pay for a blunt wrap with them and the clerk threw the wrap at my husband's feet so he had to pick it up. He ended up kicking over an entire display of the little medicine packs. :rofl: The clerk was fired shortly after that...

He wasn't charged for paying in pennies, he was charged with disorderly conduct, said conduct being dumping 2,500 pennies on the clinic counter, presumably half of them running all over the floor and causing disorder.
Misleading story title is misleading.

My understanding is that pennies (like all other American currency)are usable as legal tender for all debts payable.

For all the people saying "roll the pennies up," banks won't even accept rolled up pennies any more, and a lot of bigger shops won't either. There's been too many fraudulent pricks who put a piece of metal in the middle- or whatever they do to fake it.

I knew this guy who made mucho cash putting pennies in the dime rolls.  Apparently the clerks rarely broke them open immediately and if they did he said he would just act all pissed off and demand back his pennies.

:shrug: I payed for a gallon of milk in all dimes and nickels.  I gave a friend of mine like 7$ in change at a gas station and asked him to go inside and give it to the teller.  He wouldn't do it, he was embarressed to pay in change :kingtard:

I walk in like a boss, I think it's funny, i worked a register before, I liked when ppl payed in all change cause it slowed me down, got to stand and count lol.

When I was 7 or 8 I tried counting up 100 pennies to buy a ice cream from one of those ice cream trucks that sold a dollar ice creams that came by all the time, but I kept losing track of what number I was on and starting over then ragequit before I counted up to 100.i was in a hurry to count it because the ice cream drove by and i wanted to try and catch him on bike.

Read the Page again Title 31 states that its "legal tender for all debts, public charges, taxes and dues...."


They clarify by saying "What this statue means, in the words of the united states treasury is that all united states money is a valid and legal offer of payment for debts when tendered to a creditor."


I would argue his owing the towing company 88 dollars qualifies as a debt. I hope that not all of the over 5k posts you have made in under a year have been this poor.

This is a debt he already owes this towing company money. They loaned him a tow and are using his car as collateral on the loan. Think about it. Now if the same towing company refused to accept pennies for a tow that you requested they would be well within their rights.

Pennies, like any other form of coin or paper money, are indeed legal tender for all debts according to federal law (unlike foreign gold, silver, etc.)

However, this does not mean that a business has to accept them.  As private entities, that have the right to demand particular forms of payment (i.e. "we don't accept credit cards")

In this case, the man should have been able to pay in pennies, provided that there was no written policy or display that stated beforehand that pennies were not an acceptable form of payment.

The reason that this guy got arrested and charged with disorderly conduct isn't because he attempted to pay in pennies.  Regardless of how frustrated he was with the situation, throwing the coins on the counter and demanding that they be counted isn't the most orderly way that he could have handled the situation.

I've paid an unscrupulous towing company in dollar bills and change before (for a $150 charge).  I knew I was giving them a hard time, but I wasn't being belligerent about it-- just handled the situation as I would any other business transaction.
