Cop cites buckled-up 10-year-old for improper seat belt use

AUSTIN — A "scared" 10-year-old Central Texas boy who stuck his head out the passenger's seat window to get some fresh air says he was ticketed by police for improper seat belt usage after it slipped off.

Marshall May, a fourth-grader at Jim Plain Elementary School in Leander, just north of Austin, was on his way home in a minivan when he stuck his head out the window and his seat belt slipped, he said.

A Leander police officer pulled over the van that Marshall's 19-year-old aunt, Ashley Arredondo, was driving and gave the boy a ticket after a brief discussion Tuesday.

"He said: 'You were wearing your seat belt incorrectly. Sorry, but click it or ticket,'" Marshall said.

Apparently the child wasn't properly wearing the belt because it wasn't covering the top of his chest, said Marshall's stepmother, Kristy May.

But Texas law states that the adult in the car is at fault when a child isn't properly secured by a seat belt. Marshall's aunt, however, was not ticketed.

Interim Leander City Manager Robert Powers told the Austin American-Statesman that the police officer just made a mistake but "it wasn't anything egregious or malicious."

The Police Department has taken procedural steps that may lead to the ticket's dismissal but the municipal court must decide whether to actually dismiss it, Powers said.

"I was really scared," Marshall said Thursday of the police stop. "He made me sign my signature, but I don't have a signature because I'm 10 years old."

The boy printed his full name instead.

"I thought it was a joke until I saw the actual ticket," said Marshall's father, Gabriel May. "I think they should drop it."

Firstly, seat belts don't "slip." The child had to deliberately duck under the shoulder strap to get his head out of the window.

Secondly, the policeman has a point in that the child could have been seriously injured if the car had encountered an accident under those circumstances (e.g. broken hip bones, various injuries from whiplash, etc.). And there's something to be said about teaching the child responsibility by giving him the ticket.

It is a pretty ludicrous ticket though. The child is 10 years old. A warning wouldn't have sufficed for this hardened law breaker?

I certainly get your point about it being dangerous and definitely feel that the cop should have just spoken with the kid or give him a warning. I definitely think it's over the top though

Omg banhammer that little kid! Like wtf, how can a cop be so dumb that he tickets the kid himself? Parents or the responsible adult are always supposed to be the ones responsible up to a certain age. That whole police department just went *facepalm*

Well that kid broke the law and got ticketed.  It is a glorious day for law enforcement.  Another dirty criminal brought to justice.  :hitler:

I see it like this, the ticket serves as a serious warning, when the kid gets
to court they'll probably dismiss the ticket but it gives the kid an idea the
pain in the ass court appearances are

who's going to drive when an adult has to sit in the back seat the whole time
to make sure the kids dont get out of the seat belts, should the responsible
adult be looking in the mirror the whole time, well that becomes a serious
safety problem for other motorists. I'm :facepalm:ing at the way people are
blowing a seat belt ticket to a kid out of the water, if my kid got the
ticket, he'd be working to pay the fine and he's only 7

and if that kid got into an accident while he was fucking around in back what do you think would have happened then?
Maybe the cop earlier that week saw a kid die bc he was fucking around in the back while the driver got into an accident:shrug:

There are plenty of stupid laws out there seat belt and general safety traffic laws aren't the ones you should be bitching about.

If you want to play the fascism card go patriot act or some thing.

Anyone who has kids or has spend a lot of time around them will realize that they are sneaky as hell and try and get away with whatever they can.

trying to keep a 3-5 year old to sit properly in there car seat is(with most kids) impossible for rides longer than 5min.

A 10 year old should know to sit and behave in the car, but they don't. I do recognize the lesson learned for this kid will better him but it seams rather harsh. none the less, it'll more than likely be dropped and everyone will I've happily ever after.... until next time.

Trekie - Seatbelt laws are non-violent crime statutes.  These are *precisely* the sorts of things people should concern themselves with.


How can anyone legitimately have the authority to tell you to place a seatbelt on your body considering that the seatbelt and the god damned car both belong to you, or a party that's consented your use of the items.

Ridiculous.  More arbitrary statutes.

Surpass the local ordinances of the Universe.

Its not like people being to lazy to wear a seatbelt has consequence for many people involved.

The city is going to have to pay some one to scrape your broken ass of the pavement because of your irresponsibility .
What if that accident is with a different car that other person has to live with the guilt they killed someone.

Not to mention all the people who care about you and all that shit.

If you want to be stupid and kill yourself there are way to do it that dont involve others  .

I have a son and when I do get to see him I make sure he is blucked up but I lay down the law cause I acutely give a fuck

Assumption 1:  A child has to wear a seatbelt/ought to wear a seat belt


Assumption 2: if a seatbelt isn't being worn there MUST be someone with a gun to ENFORCE this seatbelt wearing.


I see where your logic fails.  Do you?


You're espousing your opinion and you're so confused that you're willing to back it up with violence and force against people who don't want to listen to you.  Is that fair?  Is that just?

So you support sticking a gun in someone's face because of perceived risks?  Your argument is that if one dies, the remaining body must be removed from the area; so one's living will ought be restricted to reduce the possibility that dead bodies will accumulate in the streets?  I'd imagine people won't want to die readily and so *most* people would wear their seatbelts anyway.

Do seatbelt laws so encourage people to wear seatbelts that they place them on for that very reason?  What do you think?  Statistics show that laws do not deter against crime, even when you threaten to chop people's heads off for non-violent crimes those behaviors and actions are still executed.

was the kid dragged from the car and shot in the back, why bother to
mention the gun with enforcement when in fact it's the state that vested
powers to the cop to enforce the law, the gun has neither the ability to
