My best friend since I was 12 was just sentenced to 13.5 years in prison :(
    #14533820 - 05/29/11 11:57 PM (12 years, 9 months ago)

I won't go into too may specifics here, but it was considered a violent crime, and he had no chance in the courtroom to begin with.  This whole situation sucks because he was offered a plea bargain about 6 months ago for half of the time.  He was convinced that there was no chance he could lose the case, and would never listen to either me or his family if we ever tried to tell him otherwise.  His dad was a real dumbass, and kept fueling his lies and convincing my buddy that he was the real victim, and that his court appointed lawyer would convince the jury that he was truly innocent.  Because of all of this, the plea bargain was never considered, which it very well should have been.

Long story short, the Jury didn't buy it, and after 10 minutes of deliberation, found him guilty of all four felonies he was charged with.  The Judge burned him a new asshole with the sentence, and he was taken away.  I set up my pay-tel account so we can keep in touch, but the entire situation has really got me and his whole family down.

Don't get me wrong.  I knew he was guilty the whole time, and I knew that he was blatantly lying to his family and the lawyer about everything he did so that we would see him as the victim.  I'm just pissed at his dad for convincing him that he could lie and manipulate his way out of a situation that no one even knew was so serious to begin with.  But I'm also mad with my self about not calling him out on his lies more, and not being honest enough with him to help make better and more appropriate decisions.  In fact, his brother and his mom both told me they felt responsible as well for not being more honest.  All we wanted to do was be supportive through out the whole process, but we were only ever told by the lawyer that the worst possible outcome from this case was 5-7 years, and that my buddy would probably be acquitted anyways.  Little did we know how misinformed we were.

Had we known that the outcome was going to be 13.5 years from the beginning, the whole situation would have been approached differently, and we could have worked towards damage control.  We could have tried to work out a better plea deal with the DA, and he might have been out of jail in 3 years.  Now, he'll be in his thirties when he's released, and even then, he won't be able to get a job, or even lease a one bedroom apartment in his name.  He'll be totally institutionalized in 13.5 years.  Most cars probably won't even run on gasoline, and the world that he knew only a week ago before he was locked up will be unrecognizable.  He was an alcoholic at age 19, his dad allowed him to drop out of school in the 7th grade, he was very manipulative, he was guilty, and he made very terrible decisions.  I even thought that he should have to serve some time to help get his life back together, maybe a few months, but I never wanted the true outcome.  Now I probably won't see him until I'm 34.

What do you all think?  Any advice?

He's gonna need alot of mental support. Thats really all you can do. Make up for not being honest and on his ass about the plea by keeping him focused on doing good, not fighting and finding ways to make him self look better, and honestly he prob. will serve about half the time and get out on parole.

....This is a big time reality check for me. I was charged with a Felony assault(1st Degree) on a minor. What actually happened was my brother(1/3rd bigger than myself) and I got in a mutual fight.

My brother was trying to tell the cops whats up but, no dice. I was barely 18 at the time and they told me I was looking at years in prison(mostly bluffing I'm sure). I was offered 3rd degree charges and no domestic violence charge. I being scared to death took the deal, ended up with 10days community service.

Long story short: Reading this has mad me glad I took that plea agreement all those years ago.

We plan to try and support him as much as possible, and I can't wait to talk to him on the phone.  But unfortunately due to the nature of the crime, his attorney told us that there is a very good chance he will serve the entirety of the sentence.  I hated to hear that, but then again, the lawyer told us the worst that could happen was 5-7.  Who knows?  The lawyer already got the GED classes in order, and that is a great thing since he's 19 and hasn't been to school in 6 years.

They were all 1st degree robbery and assualt w/ deadly weapon charges.  He clearly never considered the consequences, likely because he was never once punished as a kid for acting out of line.  I remember when we were kids, we snuck out of the house at 2 am.  My dad caught us, and grounded me for a month.  The next morning, his dad picked him up and took him to chick-fil-a.

It sounds like he deserved it and should take his punishment like a man. He tried lieing his way out and that didn't work. It's sad your friend is in jail, but reading about him makes me think he put himself in there and honestly deserves the time. Don't talk to him about it being unfair because it was and it would just fuel his denial. He needs to realize it is his fault and he is where he is because of his lifestyle and because he broke laws that sounds like he harmed others directly or indirectly. Just be his friend and try to get him to see that this IS all his fault and it got worse because he tried to lie his way out of it. He needs to learn a lesson it seems.

Just be his friend. Talk to him and keep in touch.

best of luck, i hate to say this, but 13.5 years, they don't give you that for no reason. he must have done some serious shit.

i really feel for him though, i hear after that long in jail/prison, you get so used to doing the same thing every day, that once you get out, you never really adapt back into society.

i really wish you both the best. jail is a shitty thing made up by society to try and fix the problems that it can't fix on it's own. it's scary to think about. i hate to admit that without it people who do crazy shit whenever and however they want would be free to continue doing the same crimes, but none the less if this wasn't the case the world would be a lot better off without jail.

Really sorry to hear that. 13 years is a long time, but honestly that much time confined might produce some deep introspection in him and he might make some changes and revelations that will positively influence the rest of his life. Theres nothing you can do now but try to help him through emotionally. Just try to lead him along and support him in feeling like this time can be used productively to learn about himself. Im not sure the best way for you to convey this to him but you will know, just stay with him throughout this time. And maybe provide him with some valuable reading material that could help him look inside while inside
