A registered nurse with a previous drug arrest managed to get a Washington state nursing license, work at three hospitals and allegedly divert drugs nearly a hundred times before getting caught, according to health records released this week.

The state Nursing Care Quality Assurance Commission suspended registered nurse Gordon McSherry, 46, last week after accusing him of taking the painkiller fentanyl and other controlled narcotics from hospitals. The facilities include Virginia Mason Medical Center in Seattle, where officials said McSherry diverted drugs 97 times in a three-week span.

McSherry got a nursing license in Washington in April of 2010, despite having been arrested in a suspected drug crime in Texas, according to commission records.

Mary Dale, disciplinary manager for the nursing commission, said the arrest, which showed up in a background check, did not disqualify McSherry from getting a license here.

McSherry wasn't charged in the Texas case until September of 2010. By that time, he was working at Virginia Mason. In October of 2010, hospital investigators accused him of diverting drugs 97 times, by withdrawing medication for patients who never got them, or who didn't have a doctor's order for them, state records show.

The hospital fired McSherry and reported him to federal law enforcement.

Despite that action, McSherry was able to find work three more times. In December of last year, he worked a single shift as a contract nurse at Regional Hospital, a long-term care facility in South Seattle. While there, he was seen taking fentanyl from a dispenser and caught with vials of fentanyl and midazolam in his backpack, health authorities said. He was arrested.

That act led King County prosecutors to charge McSherry with a felony drug crime, but not until April of this year.

In the meantime, McSherry surfaced at a third hospital a month after his arrest. In January of this year, he showed up for a shift at Providence Holy Family in Spokane, where he allegedly diverted hydromorphone, state officials said.

Last week, despite being fired and charged with drug crimes in two jurisdictions, McSherry was working a fourth job as a nurse at the Downtown Emergency Services Center, Dale said. She said nursing commission officials had gone to the center last week to personally serve him suspension papers charging him with unprofessional conduct.

Although McSherry's license was valid until just last month, Dale said it's up to individual hospitals to check a job applicant's history with previous employers.

She said hospitals also could have checked with the state, which had opened an investigation on McSherry in October following the Virginia Mason investigation.

Managers are Regional Hospital took issue with Dale's statements Tuesday, saying they had used standard procedures to hire and vet McSherry.

Barbara Hostetler, the hospital's chief nursing officer and chief operating officer, said Regional had used an agency to hire McSherry. She and Mary Dawson, the hospital's quality risk manager, said the hospital had checked McSherry's license and had confirmed that the agency had done a background check.

"We checked his license, and it was fine," Dawson said. "We're doing the standard in the community."

"If there's something different we should be doing, we want to know," Hostetler said. "The (nursing) commission needs to tell us, so the agencies are up to snuff, and the facilities are up to snuff."
