Saying he never should have signed a plea agreement, Aaron Granville Thompson nonetheless agreed that a 20-year prison term was what he bargained for.

Today in U.S. District Court in Roanoke, that was the sentence given to the 42-year-old Dublin man in a case centered on a deadly overdose of the painkiller fentanyl in 2007.

Last week Seth Linkous Thomas of Riner was sentenced to 25 years for his role in the overdose.

Judge James Turk told Thompson he understood that Thompson now wished he'd taken his case to trial, but said he was holding him to a plea agreement Thompson signed in January. In the agreement, Thompson pleaded guilty to two charges of distributing fentanyl and one of conspiring to distribute the fentanyl involved in an injury. The agreement set the sentence at the lowest allowed by federal guideline, which was 20 years.

Before grumbling about the plea, Thompson turned to look at the courtroom's spectator benches and apologized to the parents of Barry Paul Duncan, a 23-year-old from Check who died after taking fentanyl supplied by Thompson.

"I'm sorry for your loss," Thompson said. "No parent deserves to bury their child."

Then Thompson turned back to the judge and said he did not think he was guilty. Thompson said he had been advised that he would be convicted at a trial and receive a longer sentence, but now wished he'd risked it.

Prosecutors have said that on Nov. 27, 2007, Thompson sold fentanyl to Thomas, who in turn provided it to Duncan.

Duncan's mother spoke in court today, as she did at Thomas' sentencing, saying she wanted to introduce her son to anyone who hadn't known him.

"He was a funny, loving, trusting person ... and he would have made an amazing father," Sheila Duncan said.

Her son worked as a tree trimmer and was a construction electrician in the Navy Reserves, she said. In both jobs he climbed, either to cut branches or to install wire on poles. He suffered intense pain after hurting his back in his tree-trimming job and had wanted the fentanyl as relief, Sheila Duncan said.

Defense attorney David Damico said Thompson had been on a long slide into despair after his mother shot herself to death in his presence, but had still held jobs and tried to be productive. Barry Duncan's death was terrible, but did not define his client, Damico said.

Asked by Turk which prison he'd like to go to -- federal judges can request specific facilities, but it is up to the U.S. Bureau of Prisons to make a final determination -- Thompson said he'd like to go to Butner, in North Carolina, or if that was unavailable, to "anywhere with a weight pile."

"He likes to lift weights," Damico explained.

"Anything I can do to stay in shape," Thompson said.

Turk said he would request that Thompson go to either Butner or to Alderson, W.Va.

Thomas was convicted of the same charges as Thompson in a December jury trial. Last week, Turk told Thomas he had planned to also sentence him to 20 years, but added five after learning Thomas tried to influence a potential juror in his case from jail.

So he helped out a guy who was in chronic pain and the uniformed (to stupid to do research) guy takes to much fentanyl and dies and he gets 25 years?  Thats fucking bullshit, people that actualy MURDER other people get less time than that if it isnt pre meditated.  Makes me want to :puke: thinking of this guy rotting in jail for that long.

Odd scenario.  Dude gives medication to a person who wanted that exact medication. Guy dies, so you penalize the guy who blackdoored a script with 20 & 25 years?  Clearly it is not right, but if you ask for something and get that exact product I believe it is 100% the end users fault.  Now it would be different if he asked for 1 thing, and got a different product under the original asking name.  There was no crime here, only 1 person trying to help out another (patch to pain) and the other person helping supporting by paying for it. (pain to patch)
