Four face drug charges following fentanyl overdose

Four people face drug charges after Bismarck police executed a search warrant at a home after being called to a possible drug overdose.
Tim Weigel, 58, was charged Monday with two counts of Class A felony delivery of fentanyl, and Class C felony charges of tampering with evidence and possession of drug paraphernalia. South Central District Judge Sonna Anderson set bond for him at $10,000 cash.
Ryan Holden, 21, was charged Monday with Class A misdemeanor charges of ingesting a controlled substance and possession of drug paraphernalia. He also was charged in an unrelated case with Class B felony delivery of marijuana, second offense. Anderson set bond for him at $7,500 cash.
Chelsey Lang, 20, was charged Monday with Class A misdemeanor charges of ingesting a controlled substance and possession of drug paraphernalia. Anderson set bond for her at $1,000 cash, which also covers an unrelated case in which her probation could be revoked.
Cory Moller was charged Monday with Class C felony possession of methamphetamine and Class A misdemeanor and Class C felony counts of possession of drug paraphernalia. A warrant has been issued for his arrest.
According to an affidavit from Bismarck Police Det. Paul Olson, police were called to the home where Lang, Holden and Moller live on Friday for a drug overdose. Holden told officers he had injected fentanyl that he got from Weigel. Lang also said she injected fentanyl. Holden was taken to the hospital, then later to jail, where officers found marijuana and paraphernalia on him.
Police already had a search warrant for the house, and Lang showed them where there was drug paraphernalia in the house. In a room Lang said was Moller's, police found marijuana, methamphetamine, LSD and paraphernalia. Moller told police the paraphernalia, marijuana and methamphetamine were his, but he did not claim the LSD.
Lang had told police that Weigel fled from the home with some evidence when they called an ambulance for Holden. Olson wrote that Weigel returned to get his cellphone while police were searching the house, and Weigel admitted to giving Holden and Lang 50 milligram fentanyl patches. Weigel also showed Olson where he had put the evidence he took from the house.
In a separate case, Holden is accused of selling a confidential informant marijuana on April 26. Since he has a prior delivery conviction, he faces a three-year mandatory minimum prison sentence if convicted.

50 milligram fent patch? i only wish such a thing existed. i think the article means 50 mcg/hr patch.

How is running away with "evidence" prior to anyone arriving there tampering with evidence? How can it be tampering with evidence unless it is declared evidence prior to the act? By that account, if someone flushes their weed down the toilet while the police are trying to bust in, they are tampering with evidence.
