Lawmaker Looks To Ban 'Herbal High' That Sickened 3 Over The Weekend (Salvia)

Two incidents over the weekend in which three young people were sickened by legal herbal compounds they bought at Palisades Center mall and smoked have prompted a state lawmaker from Rockland County to expand the list of such compounds that would be banned from sale in New York under legislation he introduced in 2010.
Assemblyman Kenneth Zebrowski, D-New City, said products like the “AM-HI-CO Atomic Bomb” have no legitimate use and should not be available for sale. Zebrowski said this product and others are purchased as “herbal highs” despite warning labels stating they should not be smoked or consumed in any way.
In the weekend incidents, Clarkstown police said two New City women, 19 and 20, and a Wisconsin man visiting friends in Rockland County had to be taken to Nyack Hospital for treatment after reactions from smoking AM-HI-CO Atomic Bomb. The Wisconsin man, 19, remains in intensive care at the hospital.
Clarkstown police said all three exhibited catatonic and hallucinogenic behavior. The incidents prompted police to issue a warning, especially targeted to parents, urging the public to be aware of the dangers of smoking such herbal compounds.
Zebrowski said he has been pushing for more than a year for a state ban on chemicals known as “synthetic marijuana” or “legal ecstacy.” He said his bill, Assembly Bill Number A5008, was introduced in 2010 and would add chemical compounds including “Spice” and “K-2” to the New York State controlled substance list.
The lawmaker said he was concerned about the illnesses in Rockland over the weekend and has decided to expand his proposal so that it would include the AM-HI-Co Atomic Bomb and similar products.
“These chemical/herbal concoctions can cause very serious health problems and should be dealt with the same way as other illicit drugs,” said Zebrowski.
Zebrowski said the federal government recently issued an emergency controlled substance schedule that bans chemical mixtures found in the “synthetic marijuana” substances for at least 12 months. These compounds were designated in schedule 1, the most restrictive category of controlled substances.
“With federal and state Governments clamping down on these substances companies are tweaking the chemicals and herbs to avoid regulations,” said Zebrowski. “I vow to amend my current bill to close these loopholes and ban all dangerous chemical/herbal concoctions.”
The AM-HI-Co Atomic Bomb that made the three young people sick over the weekend was purchased, according to police, legally at a tobacco kiosk on the fourth floor of Palisades Center in West Nyack. The herb combination, which looks similar to marijuana, cost $30 per package and the concoction was put into rolling paper and smoked, police said.
On Saturday, friends of the Wisconsin man called police for help in an underground garage at Palisades Center, where he was having a bad reaction to the material he had smoked. On Sunday, Clarkstown police found the two young women in a New City home after they received a 911 call from the house. One of the women was conscious, breathing and speaking but could not move her body. The second woman was feeling dizzy and was slightly disorientated.
The two women were treated at the hospital and released.
In March, the Rockland County Legislature cleared the way for a public hearing to be held May 3 in New City on a proposal by a Valley Cottage lawmaker to restrict the sale of salvia — salvia divinorum — in the county so that the herb could not be purchased by anyone under 18.
Rockland County Legislator Frank Sparaco, R-Valley Cottage, said the herb is being used by local young people as a hallucinogen and should not be available to them at local stores.
Sparaco brought up the proposal last year, but it never made it to the full Legislature. He contends that a public hearing on the issue would show there is support in the community for restrictions on products such as salvia.
A measure introduced in the state Senate in January calls for a ban the sale of salvia in New York. Sparaco said a local law in Rockland County restricting its sale could serve as a temporary measure until the state government steps in.
Testimony at a Rockland County Legislature's Multi-Services Committee meeting in February showed that salvia is listed as a "drug of concern" by the federal Drug Enforcement Agency, but it is currently legal to sell and possess.

Sweet. I'm sorry but I don't think that kids should ever be taking this stuff. It's meant for meditation, not "tripping balls" and if it was 18+ or 21+ like alcohol at least non-smokers would start to respect the fact that it is a legal drug for adults only, instead of banning it outright - or focusing on the fact that the kids who take it and get in trouble are deliberately breaking the law, rather than "oh look, salvia is horrible for our kids".
