I need legal advice please!

My girlfriend could not file taxes since she did not work last year. She offered me $1,000 to put her 2 children on my taxes for the EIC. It seamed like a great idea at the time, so I did it. She went with me to H&R block, and gave the lady all the info she needed, and signed the forms right along with me.
Since then, we broke up, and I am still waiting on my return. Now she is saying that if I dont give her the whole check (including the money I would have recieved without the EIC) she was going to report me. Im assuming she will tell the IRS that I didnt really take care of the kids, and I have no proof that I actually did.
My question is wont she get in trouble as well? Is she just bluffing to get the money? She wants the money cause she is strung out on coke, this is the main reason we broke up. I really need the money for school, but if I risk going to jail or something, then I will give her the check...
P.S. Im not trying to be rude, but please dont answer unless you know for sure.

I would think if she contacted the IRS no one would be getting any money and youd both probably get charged with fraud. Give her the 1000 bucks she gave you and keep the rest.

Yeah I would call her bluff. She's strung out on coke, like you said, so she's probably just trying to scheme however she can for cash. When it comes down to it though, I highly doubt she'll report you.
Even if she does, they don't have proof that you weren't taking care of the kids... I would keep the cash that you would have received anyway, and kick her the rest.

Honestly, I am so pissed, I want to keep the whole $3600, but it seems immoral, and I would probably lose sleep over it. I also thought about just keeping the $1500 I was originally supposed to get out of the deal, and give her the rest. Then again, if she is going to report me either way, I mite as well keep it all right?

I have done some researching, and I know that if they find something wrong with a return, they make you pay it back. They have also been known to wait a few years so they can tack on a bunch of interest, and fees. If I do go to court and somehow get convicted of purposly trying to cheat on my taxes, I can go to prison! (just ask Al Capone, and Wesley Snipes)

buy a cheap recorder and record her next bitch fit play it back to her then get rid of the tape(taping is illegal) that should make her think your for real and truly have begun legal proceedings

You should tell her that if she reports you and the IRS sees that your claim was fraudulent, you will lose ALL the money and both possibly go to jail... I think she will settle for the cash you do decide to give her.

Pretty much all of these answers is what I was thinking anyway. I just dont want to call her bluff, and end up in prison... Does anyone know of a website or something where I could get some legit legal advice without giving out personal info? Im thinking that if we both signed the papers, we are both responsible. If something on the return ends up being false, we both go down. Also, since its only MY tax return, I would think that Im legally entitled to ALL the cash. Our agreement was verbal, and is just hearsay. This is what my common sense tells me, but laws are really fucked up sometimes.

well...legally you're probably entitled to your money, if your claim was legitimate. Since you don't actually have kids or support them, that's tax fraud and you could be facing some REAL penalties.
Here's the penalties for all types of tax evasion and such, I'm sure you can find which one fits your case, but in most cases you're looking at 3-5 years in jail and 250-500k in fines. http://www.irs.gov/compliance/enforcement/article/0,,id=106790,00.html
That of course is the maximum punishment, but still...the IRS doesn't fuck around

Technically you both did something illegal. Perjury. which is a federal offense. Prison time baby.
So if she tells the IRS, and her signature is on that paper, she is admitting to falsifying a legal document, and perjury as well.
Warn her of that, and I bet she backs off. It's a shit crazy fine, something like 250,000$ and like 7 years in prison.

I know this is some pretty serious shit, otherwise I wouldnt even consider giving her the whole fuckin check...
Scenerio 1- I give her the whole check, and chalk it up as a learning experience.
Scenerio 2 - I keep some/all of the check, and nothing bad happens.
Scenerio 3 - I keep some/all of the check, and I/we get huge fines, and possible jail time.
Even if my odds are good, scenerio 3 sucks balls. Scenerio 1 isnt much better. I wonder how likely scenerio 2 is... Everyone vote! 1, 2, or 3?
