if it was indeed an illegal search, with out  a warrant then what they find after searching will be thrown out

atleast thats what happened to me few years back

they came to my house looking for some stolen stuff, forced themself inside the house with out permission and found over 500 bucks worth of glass pipes, some bud, some brass knuck's etc..


anyway went to court and it was thrown out for illegal search and seizure, if they dont have the warrant they cant come in unless the owner/renter gives permission.

i definately did not give them permission, they lied and said they smelled marijuana to get inside, then claimed they "saw the tray of bud" ONCE THEY WERE ALREADY IN..but they did get a warrant after already inside, after they already searched, though, so they took the liberty of lying and saying they had the warrant before they searched. its a mess.

i pray to god this gets thrown out, it has me stressing so bad.

Your neighbors across the hall saw them come in and search before they got a warrant that's good if they will swear to it.  Did they find anything when the burst in before they got the warrant?  Anything lying about that gave them reasonable cause to get a warrant?  If not, then you stand a much better chance with all those coupled together of getting the search thrown out.




yes they saw a tray of cut up weed on it once they came in, but they opened my bedroom door to see it..dont know if that matters

but they said they smelled bud, and they said they heard the girl making a scene, and that was their "reason" for bargin in.  i still didnt give permission, and they got the warrant hours later, so do you think i'm good for illegal search?

a cop can say whatever he wants, but if you hve proof that they searched before actually having a search warrant then yes, i  think it'll be dismissed for illegal search and seizure..


I'm not lawyer im just speaking from my own previous experience.

and my "proof" will have to come from my neighbors testimony when he saw threw the peephole, i hope thats enough proof..
