The US Sentencing Commission is considering whether to recommend that the Fair Sentencing Act be made retroactive. What does the Fair Sentencing Act do? Among other things, it reduces the racial and class injustice of crack cocaine offenders (largely poor, black) being penalized much more harshly than powder cocaine offenders (largely white).

You can help make the Fair Sentencing Act, which while not perfect is a step in the right direction, retroactive. This would allow thousands of people who have been suffering unjustly long sentences (up to 40 years) to be released earlier and have a chance to rejoin their loved ones and make something of their remaining lives.

If you would like to, you can send a letter such as the following stock letter from the FAMM website (Families Against Manditory Minimums) reprinted below. Send to: United States Sentencing Commission, One Columbus Circle, N.E., Suite 2-500, Washington, D.C. 20002-8002, Attn: Public Affairs. COMMENTS MUST BE RECEIVED BY MARCH 21, 2011.



Last year Congress passed one of the most important pieces of sentencing reform in years: the Fair Sentencing Act of 2010, reducing the sentencing disparity between crack cocaine and powder cocaine from 100:1 to 18:1.

Congress enacted the Fair Sentencing Act because it concluded that the sentences for crack cocaine were unjustifiably long and disproportionately impacted African Americans. It did so with the support of law enforcement, civil rights and faith-based organizations, and well-respected conservative and progressive leaders.

Unfortunately, the job isn't finished. People are currently in prison serving the sentences that Congress agreed were unjust, costly and did little to promote public safety. That's because the Fair Sentencing Act was not made retroactive.

You can correct that by making the new crack penalties retroactive.

I ask that you commit to supporting efforts in the 112th Congress to let the courts apply the reduced crack penalties in the Fair Sentencing Act to those who received punitive sentences before the new law took effect.
