Public Hearing for Proposed Ban on Sale of Salvia to Kids Approved

Rockland County residents will get a chance to tell local lawmakers whether they think sale of the hallucinogen herb salvia — salvia divinorum — should be restricted in Rockland County.
The County Legislature voted Tuesday to allow a public hearing on May 3 on a proposal by Legislator Frank Sparaco, R-Valley Cottage, which would make it illegal to sell salvia to anyone under age 18, and would also make it illegal for anyone under 18 to possess salvia.
Sparaco said the herb is being used by local young people as a hallucinogen and should not be available to them at local stores.
Sparaco brought up the proposal last year, but it never made it to the full legislature. He contends that a public hearing on the issue would show there is support in the community for restrictions on salvia.
A measure introduced in the state Senate in January calls for a ban the sale of salvia in New York. Sparaco said a local law in Rockland County restricting its sale could serve as a temporary measure until the state government steps in.
Recent testimony at the Multi-Services Committee of the Legislature showed that salvia is listed as a "drug of concern" by the federal Drug Enforcement Agency, but it is currently legal to sell and possess.
Rockland County Health Commissioner Dr. Joan Facelle said salvia acts as a halucogen and has strong dissociative effects on its users. She said its use by young people is a health concern because it affects their judgment and behavior.
Sparaco said the herb, grown in Mexico and Central and South America, became a concern for him when he learned about its use by local children when he spoke with friends and neighbors at a block party several years ago. Sparaco said his proposed ban on the sale of salvia to people under age 18 was developed after he sent his 15-year-old brother to a local store to see if he could buy salvia — and he did, without problem.
Sparaco's proposal calls for making sale of salvia to anyone under 18 a misdemeanor, and to make it illegal for anyone under 18 to buy salvia, making that a violation.
The proposal originally called for making possession of salvia by a minor a misdemeanor, but Sparaco agreed to change that provision after fellow legislators said they did not want to create a penalty that could give a child a criminal record.
The hearing is set for 7:05 p.m. on May 3. The proposal would then need another vote in the Legislature before it could take effect.

I completely agree with this. I wouldn't want to see my juvenile offspring smoking salvia. It's not proposing a ban after all, just making 18 the legal age limit which I find completely responsible and reasonable.

Hope this is the law they are going to adopt in Canada. Right now they are looking at an all out ban. There is a 30 day period they will listen to input from the public that ends March 19. The link is on erowid under Canadian Law, and probably somewhere on shroomery to Health Canada (or whatever that dept is called).

Indeed. This is more sensible drug policy.
However, it looks to be temporary until it's outright banned from the state.
