anyone familiar with insurance claims?

my car got hit and the driver has state farm insurance. made a claim and they told me to go to a certain repair center to get an estimate.
estimate was for $540, and the guy i was talking to told me that if it was his car, he'd get them to send a personal check for the estimate amount, buy a new tail light (mine got busted, and some paint damage on the bumper) and keep the rest.
another party i spoke to (with not much experience in regards to insurance claims) told me that the insurance will not do that at all.
a google search came up with mixed replies, but a few sources saying that i'm entitled to the cash.
anyone know whats good with getting some dough out of this situation?

if you go through insurance that cannot be done if it was claimed.
if it is not then you can go the "we'll just take care of it ourselves route and hope they pay up"
but really taking more money out of it than what you really need to get fixed is sleazy, what if someone did that to you and had you pay way overpriced at some dealership and got a ripped off a bunch of money just b/c you made a mistake?

firstly, you're not obligated to go to the body shop the other guy's insurance company tells you to and second, they'll try and stonewall you about cutting the check directly to you but it's your property that was damaged and you have no contract with his insurance company so you arent obligated to do it their way, tell them to cut you the check and you'll have your own body shop do the repairs

it's his property that was damaged by another driver, if the price is agreed upon by the insurance company and the owner of the damaged vehicle then there's nothing sleazy about it, this is why we have insurance so that we arent out of pocket for damage caused by others and once that money is in his hand it's up to him as to what is done with it, if he want to use it to go on a crack binge, it's his money for his property

some ass bag on a motorcycle said i hit and run on him. Meanwhile he fell from his bike and was being a dick when I tried to help him when I seen him fall in front me, had nothing to do with me at all. he reported it to insurance they tracked it down, I said pay It cause i didnt care. about a yr later his bike meet the fate of 5 gallons of paint and stripper.. how that happened i do not know.

I fully agree with this. I've had 1 of my cars wrecked and my dad 2 of his and just got the check from the insurance company. We would just fixed it in the driveway. I don't think its sleazy unless you cause the accident on purpose just to get the money.

I've gotten several personal checks from accidents. Find the highest estimate possible and send them that, it's your property.

Yeah, tell them you'll only go to this certain shop and give them an estimate from some custom place downtown.

yeah thats fine what i meant was claiming more than what actually happened so that you make some extra cash is sleazy. its happened to me before and sucked

Take it to the top repair shop in your area and get an estimate. You can present this to the car insurance company and they will cut out the check for you. You can later get your car repaired from a cheaper shop and save some bucks.

take it to a car dealership, specifiacally its main competition. Say you have a chevy...take your car to a ford dealership for the estimate...or you can drive to a major city and find a high end sports car dealership that sells porches or bens, not only will they be expensive but they will also have to special order all the parts
