It really depends on your state. Some states it is vehicular manslaughter and some states it is second degree murder.
California is up to 15 years and gross vehicular manslaughter while intoxicated. They specify.
Don't drive if you are that intoxicated. Little weed, 1-2 drinks who cares.

this whole drunk drivers don't tense up thus they don't get hurt thing kinda bugs me. I've seen drunk drivers die, even when wearing their seatbelt. One of them was actually the ONLY driver i've seen who was lucky to not be wearing their seatbelt (car rolled into a river and they got ejected halfway out the car). That guy ended up dead later though. Tore his subclavian artery along with other injuries

I had a friend who was thrown forty feet, yes forty feet, in his car while drunk. His head exploded on impact and his guts were blown out when a car ran over his corpse.

Yeah, I can relate to that somewhat. When I was 16 years old I was T boned at an intersection as I was turning left and dude ran the red light. I didn't even see it coming until he hit me, therefore I didn't tense up or brace for impact. I was completely uninjured.
The dude that hit me tensed up and along with getting hit in the face with his airbag, he got pretty banged up.
Also a few years back when I worked at a state park my friend and I were driving on a fire road going back to the dam to smoke some weed. He had his seatbelt off and I had mine on. Well he decided to have fun and try to drift around a 90 degree bend in the road, lost control and hit a tree at about 25mph. He cracked his head on the windshield, bent the steering wheel upwards and actually had to have glass pulled out of his scalp. I saw it coming and had my seatbelt on. Tensed up and initially I was in much better shape than he was (he was a bit dazed and I pulled him from the truck), but because I tensed up I had MUCH greater pain than he did. Fucked my back up about 8 hours later.
So I forced him to give me all of his percocet, because even after a head laceration he was in MUCH better shape than I was.
We both weren't drunk or intoxicated in any way, but even after he broke the windshield with his head, the fact that he didn't tense up and brace for impact like I did, he fared much better than I did.

felony charges regardless... and if there is property damage on top of that, gets even stickier.
good luck. tell her to get into a rehab stat.
the judge may show some remorse.

I havent seen the driver in over 3 years, she was kind of trashy then too so it seems like she didn't change her ways.
I've been in 7 car accidents, 5 of them were bad and every time I close my eyes hoping I'll open them again. Each time I open my eyes back up and think "How the fuck is this number X accident and I'm still uninjured?"

Had I not worn the belt each accident I'd have probably be killed. Must be lucky.
I am a good driver , I was never driving during any one of the accidents.

Its sad how tragic things have to get before some people learn their lesson. I got a DUI 3 years ago, I just went into a ditch in a parking lot doing 15mph (don't ask ) but that was all it took for me to wake up and realize that even though I was actually ok to drive that night, I'd been blackout drunk and driven MANY times before that and its just dumb luck that I didn't hurt anyone.
I'm just glad that somehow it worked out that I could learn my lesson without anyone getting hurt. Some people either don't learn, or don't get a second "oops".

Weird, my friend driving in the snow lost control at about 60mph and I had plenty of time to tense up when we hit the tree at 50mph. In fact, I had time to say "this is gonna hurt". No injuries, in fact I was okay enough to help winch the car off the tree

Well in my defense, I've had chronic back problems since I was 15.
I was ok enough to pull his dazed ass out of the truck and call the local park ranger (who I worked for at the time).
It wasn't until later that night and the next day that I started hurting like a motherfucker.

Its not 100% fullproof. You probably got really lucky. But if something were to really hit you, then i would imagine it wouldve done alot of damage
