How high is too high to drive?

A Colorado Springs area state lawmaker is proposing a new law the would quantify how much marijuana is too much to drive.

House Bill 1261 would allow a person who drives with a tetrahydrocannabinols (THC) blood content of 5 nanograms or more to be charged with driving under the influence.

In our balanced coverage, we found that not everyone likes the bill.

Medical marijuana advocates say the bill's sponsors, Republican Representative Mark Waller and Democrat Claire Levy, are inventing a crisis of high drivers.

Rep. Waller says, "I think this is an important bill it's an important public safety issue for the state of Colorado, as marijuana use goes up the number of people using marijuana and driving automobiles goes up as well and we certainly need to protect our streets."

Mary McNeely, a Springs area medical marijuana advocate says, "people should not be driving impaired whether it's on medical cannabis, alcohol or Percacet, my concern is that the 5 nanograms seems like an arbitrary number."

Rep. Waller says the five nanograms was recommended by Denver area doctors and lawyers.

And, he says, one in five car accidents in Colorado has a marijuana impaired driver at fault.

lol the thing is in colorado to tell wheather they where high driving is by giving a piss test lol which  can test upto 30 days ago of use and also i want to know how much 5 nanograms is like a bowl?

and there should be a thing if you get into a wreck whiel your high then the next time your caught for driving high you should be in trouble not the first time not until you fuck up

Sounds like an arbitrary figure to me too, much like what is considered the "legal" limit of alcohol in the body over which one would get a DUI. And of course this would vary from person to person. While one would be utterly plastered if the BAC was .8%, another would be rock-solid sober at that same level. In a perfect world, they would scientifically quantify just exactly how much is too much to drive on, but that ain't gonna happen.

All the dipstick test I have seen/used, the emit test which is the most used portable pee cup test, have a cutoff of fifty ng/ml fifty nanograms per ml. Of urine, if you have less, you test negative. They would have to do a lab test to even test 5ng.

i got my first ever road side drug test the other day, i didn't even know they had it in my state. lucky for me i hadn't smoked anything yet that day so i passed.

I can tell you from personal experience with alcohol that 0.08 is probably the slightest feeling of having a drink, maybe not even noticable.  (at least for my body chemistry) I got a DUI at 0.17 and I thought I was probably borderline legal, I felt perhaps buzzed.  No kidding.

I imagine with THC they will be just as strict.  You will probably only feel the slightest effect to get a DUI.  It may be hard to judge impairment with blood THC % cuz there might be tolerances/individual sensitivity for some.

P.S.  Of course DUI is bad, but the fines are at least $5,000+ and lots of classes

Indeed. And it stays in your system for quite a while, so there would be a lot who would get marijuana DUI's who aren't even remotely high.

2 bowls of Alaskan Thunder fuck.  Everyone was tripping, including me.  I drove just fine.    1 blunt of some sour diesel.  I could drive but I was so high I didn't dare walk into the mall.  I sat in the car and sobered up for half an hour. Twas waste of a good buzz.

What they should do is make the drivers watch sponge bob square pants and count the number of times they laugh to determine highness.

I'm a better driver stoned, more cautious, polite, analytical. I took my driving test stoned. :shrug:

If your not comfortable with the BAC you can refuse it and request a blood test instead.  Nobody forces anybody to take a BAC.  You would be suprised at how many drunks think they can call the BAC worthless and yet it does provide a solid baseline for alchol level.  Just because you can drink more and not *notice* the amount of drunk you are doesnt mean you arent drunk just that you know how to function more because you are a drunk.  Take it from somebody that has gotten a DWI.  This number seems rather ridiculous for marijuana as are most laws regarding it.  Its a lot harder to prove that marijuana intoxication causes an accident when you compare it to alcohol simply because you aren't stumbling around acting like a jackass.  Thats probably one reason why the lawyers were like yeh make it real small .

I agree, a lot of people use cannabis.  So if obviously there are a lot of cannabis users in accidents.  Does not mean that cannabis is the reason for accident.

I can tell you from personal experience with DUI recently that a lot of courts/judges will make a person with a blood alcohol content liable for montary damages, etc even when the other driver was clearly at fault.    Basically if you are in an accident and you have a measurable blood alcohol it is your fault.    I would assume the same will go for THC when testing becomes standard.

I'm guessing 0.08 is the number you were thinking of not 0.8.  Nobody is sober at 0.8 BAC.

This is just too silly. While many people will disagree with me, I'm sure, but I feel personally that driving is very easy to do under the influence of marijuana. This is just some stupid stunt to be able to ticket people for one more thing. :fearandloathing:

supposedly you can request the presence of a lawyer and refuse the roadside tests. ideally, you would sober up before your lawyer got there and you took the test. i don't know this from experience though, only rumors

it's much better to smoke than to drink IME, as related to driving or anything else :flyhigh:

In most places you can forfeit your license for a year in exchange for not taking the blood test/breath test. I had a friend do that to avoid a DUI.
