FF's Guide to NOT getting Yanked! (driving) 9
#13605091 - 12/09/10 01:49 AM (13 years, 1 month ago) |

I've been meaning to post my tips for awhile now. Feel free to add quality tips to the thread.
This covers mostly/only not getting pulled over, not other police tips.
The good news is that 95% of avoiding trouble is not getting stopped in the first place. Many, many cases get thrown out because the stops were not legal. Most cop cars now have cameras, so cops stick to the law and drivers can easily prove if they were stopped illegally. This is the first thing a DUI lawyer will check, and the easiest point to win on. If you give them NO legal excuse to stop you there's not a thing they can do.
Unfortunately it's easy for them to find a bullshit reason, and after they stop you it's rare they can't find something to justify their stop. But if you have a checklist for avoiding EVERY bullshit reason you can feel and become almost above the law.
#1 (New!) Check every light on your car! Now go to ebay and order LED lights for everything you need. LED lights last virtually forever (no getting yanked on mile 50 of your 200 mile trip when you have a joint in the ashtray), use a fraction of the power (no dead battery when you forget your dope light on overnight), and cost hardly nothing. On ebay you can get them around a dollar or so each. For the 9-10 lightbulbs you probably have this is nothing as far as car maintenance goes. You must always have EVERY light working (license plate lights too!). Any out light is an automatic pullover in many areas, especially if you have non-local plates.
#2 Always wear your seatbelt. Common sense. In most places now this is a primary offense, meaning they can pull you over for it. If you're not wearing it cops will ALWAYS say that's why they pulled you over (bullshit), this creates an instant justified traffic stop and ticket.
#3 Always have current tags and a legal vehicle. No missing parts or other random illegal bullshit.
#4 No attention getters. No "Legalize It!" bumper stickers, no stupid flashing tire valve stem lights, no political stickers.
#5 Always drive the speed limit. You should never be more than 4 over the limit or more than 10 under. Either one can and will get you pulled over. If your on a Cali freeway or out East then make sure you're going 4 over, anything less is a traffic hazard, but don't let them sucker you into going faster and getting yanked.
#6 Check your speedometer! Use one of those radar signs, time the mile markers, use a GPS, or go to http://www.miata.net/garage/tirecalc.html with your tire sizes so you really know exactly how fast you're going.
#7 No stupid violations. Common ones are... no lights at dark/raining/snowing (in many states if your wipers are on you need lights by definition), no shit hanging from review mirror (obstructed view ticket/stop), no shit in back window (this is just asking for it as it's in their face), cracked windows, broken lights, license plate light, license plate covers/frames, stupidly loud music, etc..
Clear your damn windows of frost. That includes headlights, rear window, turn signals, and license plates. I'm from a cold state and picked up the bad habit of using a credit card to scrape a tiny hole in the front window. Sometimes it works, usually it fogs up. Take the time to use your big scraper to clean off all your windows. Some cops love issuing "obstructed view" tickets, and it's just stupid to get yanked for DUI suspicion just because you can't see the road good enough. Things may look fine, but then those oncoming headlights or streetlights hit your windshield and you can't see shit. (Thanks for the reminder luvdemshrooms)
#8 Stay in the center of your lane. No weaving, no off to either side. Check yourself so you really know how the road looks in your vehicle when you're in the exact center of your lane. Mantra for rough situations: "I am a big crayon, and I stay inside the lines"
#9 Do complete stops. This really sucks, but you can force yourself. Keep your eyes straight until you come to a stop BEFORE looking each way. This forces you to make a complete stop. You'll do your regular rolling stop, but by the time you check each way you will have stopped.
#10 "The low-ride-er drives a little slower." You're not in a hurry, drive like you're cruising the strip. Passengers love to complain, tell them "We're cruising the strip, bitch! The beast cruises, it never hurries." When you feel like your driving grandma-style you're actually driving the normal person speed, exactly between grandma and dumb punk speed. Slow corners, easy stops, 25 or so on the streets. Enjoy life. The aggressive asshole gets yanked 20X the average and gets there a whopping 3-5 minutes quicker for all their troubles. I can't count the times someone's flew past me only to see them stuck at the same stoplight 2 minutes later or often pulled over to end up 20 minutes behind me.
#11 Use your signals, etc.. This is common sense. It avoids accidents and stops, there's no logical reason not to use them. This goes along with the other traffic laws... pull into the nearest lane when making turns, stop when exiting alleys or parking lots, etc..
Other laws commonly forgotten include staying 2+ sec behind the car in front of you (no tailgating) and having tinted windows that are too dark. Never assume that the car you bought is legal, check everything out on it.
#12 Never, ever park in a bar parking lot. Walk a block you lazy fuck. This goes even if you're picking someone up, etc.. In one town I know for a fact the cops will walk the parking lot and wipe down one tail light of every vehicle there. They then spend the rest of the night stopping every vehicle with one light brighter than the other. But the real reason is that cops constantly sit where they can observe one or more bar parking lots and they simply pull over many of the drivers. Bullshit money-grubbing DUI laws what they are, nearly everyone who has a couple beers is a profitable DUI case to them.
#13 If a cop gets behind you more than 2 turns or 5 minutes, STOP! Just pull over and take a 10 minute break. Get out and walk around the block. There isn't shit the cop can do since you didn't give them the chance to wait for you to make a driving mistake. You can tell them your legs cramped and you're walking it off. You can also just tell them to piss off and you have nothing to say to them. It's still a semi-free country and there's very little they can do to a pedestrian, no matter how suspicious your stop is.
Always take some time with your stop. Go shopping, eat lunch, walk around a block or two. Cops will sometimes wait down the street for you, then they will certainly pull you over. They have nothing better to do, so don't put it past them to wait 20 minutes watching for you to drive again.
In one case cops followed some poor kid for over an hour. Amazingly, he didn't make a mistake for that long. Finally they said he "touched a line" and yanked him. He was over the limit and fought the case. The judge stated in his opinion that the cops were going to pull him over regardless and there wasn't anything any legal driver could to do avoid this sort of stop. Yet he ruled for the cops because it WAS a legal stop. Basically this means even the judges know that cops can and will simply follow you until you make a mistake and there isn't shit you can do about it. Had this guy simply pulled over when he realized the cops were following him he would have been in the clear.
There's little room to find error when you simply put on your right blinker on and pull over into the first parking spot you see. At that point you're done and free, there's no more traffic violations they can get you for.
#14 Always drive during daylight hours. Avoid driving after dark whenever possible and take extra precautions when you do. Daylight cops are looking for speeders. They have a lot of traffic to deal with and are only looking for easy tickets. Regular people (daylight drivers) are also NOT used to getting hassled and have actual important things to do. Night drivers (off work people who didn't go home, bar patrons, druggies, punks, and other assorted criminals) get yanked and hassled frequently.
Night cops are looking for drug busts and DUIs. They are used to hassling people and being real pricks. These are guys looking to make their quota, advance their careers, get onto the day shift, adrenaline junkies, assholes, or other assorted deviants. I can't stress enough how much your chances of trouble go up at night vs. daytime.
It's as simple as... do you want to be driving with 80% of the traffic, 98% of whom are legal... or 20% of the traffic, 70% of whom have something illegal going on. That's really how it is. Nearly half the people on the road after dark are over the limit. This is why night cops are so ballsy and such assholes. They know that if they don't like some driver there is a better than half chance they can find something to charge or ticket them with.
OTOH day cops are used to most people they pull over being very respectable people that are pissed about just getting a speeding ticket. They just want to say "sorry", write the ticket, and move on the the next one.
#15 Get a visor holder (kind of after the fact but...). Keep your insurance/registration in it. That avoids the whole glovebox-fumbling issue. One time a friend had 2+ oz. in the glove box and got asked for insurance/registration. Luckily he bullshitted his way out since he had hidden the glove box key earlier and showed it wasn't on his keychain. Once you're yanked you aren't supposed to reach for anything and should keep your hands on the wheel. That means you have to wait for the cop, tell him you're getting your paperwork, fumble around for it, and hope the cop doesn't just shoot you and claim he thought you were going for a gun.
#16 *Title/register your vehicle in two names. Legally it's a good idea. If you die (say in hmmm... a car accident) the other person can just take the car and it avoids all the estate court bullshit. They can also get your car out of impound or the like if you find yourself unable to (in jail). Daily impound fees are steep.
But the real reason is this... When cops run your plate, like they always do before a stop, your rap sheet/driving record/parking tickets/age/etc. come back over the radio. When there's two names on the title the names come back, but they don't know who to run a check on and usually just say "no wants or warrants" back to the cops. This alone can avoid a lot of stops or extra problems if you have anything less than a squeaky clean record. Even if a speed warning comes back that gives them an extra excuse to hassle you over speed. This is a crazy slick trick that I finally learned by accident.
When cops run your plates they are often undecided weather to pull you over or not yet. Bad report = pullover + hassle. Good/no report = maybe the next guy will be more interesting. Each stop takes the cops probably 10-20 minutes and they also have to drive around back to their hiding spot. OTOH they can run a couple plates a minute and decide which speeders to bust.
The newer computer systems may be different. But I bet it's probably an extra keystroke or so for them and it still introduces the fact that they won't know who they're pulling over, thus reducing their odds of getting a bust or delivering a good hassling.
#17 Keep a can of fix-a-flat in your car. Several buddies have gotten shit while changing tires on the side of the road. Think that cop is pulling up to help you with your flat? Guess again. Best case they're going to stand there like dicks and make sure you get moved on quickly. Normally they will pull the whole license/registration bullshit and it's more or less like they stopped you. The fix-a-flat shit takes only a minute or two, a fraction of the time for a regular tire change.
#18 Have an emergency kit in your car. Hat/gloves, cat litter for traction, a dollars worth of quarters, etc.. If you get stuck throw out some cat litter and you'll be gone in a minute or so, otherwise you're fucking around asking for it. Hat/gloves for if you have to walk. Maybe a cop was following you or you're waiting off a drunk, etc.. Quarters... make a phone call to kill some time, or get a cup of coffee at a gas station/diner. It is SO smart to wait out ANY potential driving problem. Hat/gloves, phone call, or coffee and that cop knows it isn't worth waiting around for you to drive again. A phone card number is also handy. This is better than a cell phone because it shows a legit reason to stop, get out, and waste time. If you find yourself with no money you either look suspicious loitering around or you better do the walking around the block thing.
#19 Never make 2 right turns in a row. This is pullover time. People trying to get away from someone behind them always try right hand turns, they're the easiest and quickest to do. If you make two in a row you are either trying to get away or are lost. Either way they will probably want to hassle you.
#20 "In through the front, out through the back. That's just how I roll baby!" Always take a different route coming and going if two reasonable routes exist. Besides being good luck there are many reasons for this. You avoid U-turns, circling blocks, and crossing any of the same people twice. Cops really hate seeing the same car multiple times, for whatever reason.
#21 If you have ANYTHING illegal in your car (or even the slightest bit suspicious) make sure you have ZERO alcohol in your system. I can't stress enough how much easier a night stop will go if you look the cop in the eye and say "I haven't had a single a drop of beer today officer." (tip from Green_T)
#22 Eyes on the road at all times! Don't mess with the radio, don't talk on your cell phone. If you do anything do it by feel while keeping your eyes glued to the road. Pull over if that doesn't work. All it takes is one swerve to get you pulled over. Even if you don't cross a line the cops will say "Driver swerved for no reason, driver was driving erratically, etc..
#23 If you crash or get stuck somewhere... If you have anything in the car grab it and bail. If you've been drinking also bail. If you have a cell phone disable it. Head to the nearest payphone/store. Call in the accident from there and tell them you're meeting the tow truck/getting a friend for help/going to the hospital/going to the store for flares or a first aid kit/going somewhere you can wait for help. This will almost always avoid a "fleeing the scene of an accident" charge and still let you hide out until you sober up or ditch your contraband.
I also have more than one friend that has gone to the nearest bar to call it in and ordered a beer and several shots. Sound stupid? Well... the cops have to prove you were over the limit while you were driving. Having a bartender/witness there to testify that you got drunk AFTER the accident can get you off. I should also point out that you don't have to drink the drinks. If you don't drink the drinks you have nothing to lose! Your BAC won't go up and you have a reasonable defense that you got drunk AFTER the accident. You can reasonably say you were so shook up from the accident that you needed a few drinks to calm your nerves. I've even known this to work when the driver sat down on the sidewalk and pretended to suck down half a pint of whiskey in front of several bystanders. He told them he was sober and showed them his shaking hands while feigning extreme distress and claiming he needed a drink to avoid a breakdown. It worked! (The rookie cop was ready to beat him to death, but the veteran told him there was nothing they could prove)
#24 Have insurance cards ready. Many auto insurers have tear off cards that you can give the other party of the accident. They contain all the required insurance info. If you don't have this kind then make at least two and keep them in the vehicle. These are almost like a license to hit and run. If you smash into something leave one under your wiper and bail. If you hit another car leave it under their wiper and bail. No matter what happens just say X/Y/X is hurt, wife is in labor, or any other bullshit excuse. Then tell the other party that you're fully insured, all information is current, hand them the card and get the fuck out of there. Do this and you're golden, don't and you might be facing felony hit-and-run charges.
#25 Never, EVER drive between the hours of 1 am and 3 am. This is like Cinderella's ride turning into a pumpkin hours. Cops don't even take a brake during this time. This is their bread and butter. They yank one car after another. I've been stopped, ticketed in record time, and had the cop speed off to pull the very next guy to go past. Midnight to around 4-5 am is pretty bad too, but never drive from 1-3am. Get going before the witching hours or just sit tight for a bit. (You have your hat and gloves in the emergency kit right?)
#26 Emergency kit extended... Besides the earlier necessities, I always thought I was pretty smart to have a few extra tricks in the emergency kit. Blanket, pillow, road flares, and a tent. Blanket and pillow are pretty simple, you might have to sleep in your car (hide the keys, they can and will DUI you for sleeping with the keys in the ignition even to listen to the radio). Pillow and blanket are also just smart. It's extra comfort for passengers if they want it, or can save your back on a long trip.
The tent and road flares are a commando style trick. Suppose you go in the ditch, run out of gas, or your car dies? The last thing you want to be doing is flagging down traffic late at night with whatever less-than-legal aspects you may have going for you. Almost always a cop will come hassle you. It used to be that someone would pick you up and take you to town, but not any more. Now everyone has cell phones, so they don't have to stop, they just call 911 and report a stranded motorist/suspicious person/hitch-hiking killer/attempted car-jacking. So nowdays a cop will almost always be the first person to find you. It used to be they would help you get going or give you a ride into town. Now they just tell you that your car is a traffic hazard and you better get it moved before they have it towed and impounded. That goes along with the standard hassle/search/ticket bullshit.
So what to do? If you're prepared, like I'm telling you to be, you can make it an adventure. Just grab your shit and baja into the woods. Set up camp and come back for your car in the morning. If you have anything you need to stash this is the perfect time. A small tent costs very little and takes up almost no space. With your blanket and pillow, hat and gloves you'll be just fine.
You never know when you'll need to be a fugitive for a few days. This happens more often than you would think. If you're prepared it's no sweat. Lots of times the cops might want to jail you for a few days because they're stupid. If you lay low for a few days they often sort shit out and you've avoided jail/bail/etc..
What happens to your car? If you're not there they shine their flashlights in and look hard, then they put an orange ticket on your car, usually giving you 48 hours to move it (if it's not blocking traffic). If you're there it's a whole different story.
Back to the road flares... Do you use them to signal trouble? HELL NO! The road flares are for starting a campfire. A road flare will get just about any sort of campfire going. Wet or dry, it doesn't matter (not green though). Start with smaller stuff, the road flare will dry out and light any sort of small to medium fire material. Use that fire to dry out bigger stuff. Remember that fires can be seen for a long ways at night, so make sure you're over a hill or two from the road.
One time I was running from a cop. We passed head on and I was going about 90 in a 45, so I floored it. The cop never turned around, but I misjudged a "T" intersection and ended up smashing into the ditch pretty damn hard. I bailed, ditched my pipe, and walked towards town. When I got tired I stopped to chill (too close to the road). A cop came by and started hassling me. I told him I was walking into town, but he had seen my car and knew about the accident. I admitted that it was my car and he took me back to the scene. He looked at the 150 feet of black marks and my smashed vehicle. My car had actually folded up at about a 30 degree angle where the windshield meets the hood. He laid into me pretty good. Asked how fast I was going. I told him "Apparently too fast for this intersection." He started saying that he could measure the black marks and determine how fast I was going and write me a ticket. I told him that would be impossible physics-wise since the marks went all the way to where I smashed into the far side of the ditch. He actually laughed a bit at that, then went on to say that all accidents over $200 damage have to be filed with insurance/police/etc.. I told him my car was in pretty rough shape before going in the ditch and we walked around the car a few times. I kept telling him, "Well, that was already like that to everything." Finally he asked if there was ANY damage from the wreck. I pointed to a few scratches and told him that wasn't there before, but I'd probably just buff it out, nothing worth reporting. That cop didn't really know what to make of me, but I guess he figured it was easier to give me a ride into town than a ride to jail.
If there's a moral to the story it is to bail on your beater car. I lucked out in that case. It's just not worth insurance/tickets/jail/busted. If you're ever in question bail straight into the woods. Walking for town is a bad idea because you're going to be about 1/2 mile away from your car when they pick you up, and even idiots can figure out what's going on.
-------------------------------------------
I hope this helps some people avoid getting jammed up. It took me a long time to learn all of this. Many of the tips are simple stuff you can do BEFORE even getting in the car. All told, there's about $20 worth of shit you should do just as preventative measures.
The very first time you get stuck and throw out some cat litter and are on your way you'll thank me. When you get a flat and are back on the road in 3 minutes instead of spending 20 minutes on the side of the freeway putting on a spare because you had fix-a-flat you'll thank me even more. When you make that first right turn and pull over instead of making the 2nd right turn and getting yanked you'll praise god that you read the shroomery.
Hope this helps. All of it has come through experience, mine or friends of mine. Pretty much every tip here is because me or a friend of mine got jammed up or almost jammed up because of it. Hopefully this thread will generate a few new tips I didn't know.

A lot of this is common sense, but the tips on keeping change for a call or coffee/just parking when being followed/registering a car in two names is definitely witty and slick.
Anecdotal story with little value: One time, I got out of a DUI/Possession Charge (I was pulled over for expired tags - doh) by having a can of tuna fish in my glove box.
Officer: "What's that?" Me: "Erm. A can of tuna fish." Officer: "For what?" Me: "For when I get hungry." Officer: *laughs* "Okay, I'm going to run your info now."

Yeah most is common sense but reading so many stories of people who get busted because they didn't follow these rules makes it not so common :P
If you have to transport drugs in your car- do it during the day, during a normal work driving time. No chance of getting stopped then. Your just one of the daily commuters going to / coming home from work.

> #4 No attention getters. No "Legalize It!" bumper stickers, no stupid flashing tire valve stem lights, no political stickers.
No DARE stickers. No 'I support the police' stickers (the little badge stickers they give you when you donate to the police whatever fund).
> #19 Never make 2 right turns in a row.
The one time I had a cop behind me and it could have been bad to have been pulled over I immediately pulled into the first public parking lot (that made sense). Turns out that I was all the sudden hungry for some Taco Bell (not the drive through). The cop actually followed me into the parking lot, but I ignored him as I walked into the restaurant (he didn't make contact). I'm not sure how long he hung out, but he was gone by the time I got done eating.
A few other tips that I have picked up on over the years... If you do get pulled over and the cop makes a lame joke, give a little laugh. Guilty people that are hiding stuff don't laugh at stupid cop jokes. (Typical stupid cop joke, "Do you have any guns, knives, grenades, nuclear bombs, dead bodies, or anything else in the car that I need to know about.")
If going from state to state, be careful if you have a radar detector. They are illegal to use in some states, and often the cops in those states have radar detector detectors.
Keep your car clean and try to dress conservatively. Contrary to what they say, cops do profile based upon look. If you are in a junker car, covered in dirt, with purple hair and a prison tat running down your neck, the cop is going to be a lot more likely to hassle you than if you are in a clean car and look like a clean cut lawyer.
Don't have anything illegal in the car. If asked, do not submit to a search. Make the bastards waste their time waiting for a drug dog to show up, as they are going to search regardless of how you answer. The time the cops waste on you is time that others have a free pass as they drive by.

The Trick: Practice driving the speed limit and following all the rules all the time. That way it is natural and has its own rhythm. If you are holding and are driving with your arms locked, shoulders hunched up all paranoid then you are fair game. If you practice or adapt following the rules in your daily life then to a cop's practiced eye you fit in.

PLUR
This is overdue enough to type 'PLUR'.
Thanks, on behalf of those this will hopefully benefit.
Regarding the titling/registering in two names, any articulation? I've heard hearsay that makes this sound like it may create an undesirable circumstance, (fraud), when done by the same SSN-carrier.

Some more handy tips:
1) If you are riding dirty, or are a designated driver, have ZERO alcohol in your system. It makes it much easier to get yourself out of a nasty situation if you clearly haven't had anything.
I have been pulled over before and all my passengers were passed out drunk. The cop leaned in through the passenger window, took one whiff of the air, and said, "step out of the car sir for a sobriety test". If I had even ONE drink, he would've smelled it on my breath. It will make any sobriety test go much faster and you are guaranteed a pass if the question is "has he or hasn't he been drinking?" instead of "how much has he been drinking?".

2) If you are driving through several states, check the laws. In some states you cannot turn right on red, etc. Ignorance of the law can lead you to being pulled over or cause an accident.
3) Always look for signs if you are stopped and in an unfamiliar area. Some turns may be prohibited, etc. This may be grounds for being pulled over.

Don't smoke weed in the car, especially if you're committing a felony at the time. Sounds crazy obvious, but I've known a lot of people get popped for ignoring this really simple principle.
And get a hair cut.

Mostly common sense but it's always good to have a reminder! I like the comment:
Keep your car clean and try to dress conservatively. Contrary to what they say, cops do profile based upon look. If you are in a junker car, covered in dirt, with purple hair and a prison tat running down your neck, the cop is going to be a lot more likely to hassle you than if you are in a clean car and look like a clean cut lawyer.
Simply because even though I am 19 I used to carry large amounts of LSD in my car. Locked in the glove box however wearing a polo-shirt and jeans as opposed to a hoodie and sweat pants (along with never smoking weed in the car because that is instant probable cause) had helped me in the 2 stops I have had (crossing a marked lane which I clearly didn't, and 45 in a 40 which is retarded) Car wasn't searched and I got verbal warnings on both occasions and the 2000/3500 hits of acid was hidden safely in the glove box.

Regarding the titling/registering in two names, any articulation? I've heard hearsay that makes this sound like it may create an undesirable circumstance, (fraud), when done by the same SSN-carrier.
It's very common to have a car titled in two names.
Like I mentioned, it's good to have everything you own titled in two names. In case you die/get jailed/have to bail unexpectedly/creditors come after you/etc. it is very handy to have the title in two names. Usual people would be your parents/grandparents/siblings/cousins/GFs/son/daughter/business partner/etc..
One note... In many states you don't have to tell the other person that they're on the title. Good example is GFs. In my state you need their full name and birthdate only.
You can say it's a present for them and you want it all ready to go, or grandpa is probably going to die soon/can't get around good, or that your parents paid for half and want to be able to repo it if you don't pay off the other half, etc., etc..
There's really nothing suspicious about this at all. If you state is a difficult one just bring down the other party after explaining the death/creditors/no hassle when you borrow it to them/etc. thing.
This does work! Obviously, if they stop you they will run your name, but it sure beats your entire rap sheet coming over the radio before they even decide weather to stop you or not.

Add to #7... completely clear the snow from your windows AND all your lights, including headlights, brake lights and turn signals. They love that shit in here in my state. Don't just clear a small patch so you can see.

Doesn't sound very safe to me bro. I could think of 1000 better ways to transport acid than inside of a glove box, even if locked.

Another thing to watch out for: Following too close. The law says you need to be 2 seconds behind the vehicle in front of you. One person I know was pulled over recently for being 1.6 seconds behind a truck as he was leaving the toll booth.
If you have anything illegal, always put it in the trunk. Even if you get arrested while driving, they are not allowed to search your trunk without consent due to a recent supreme court decision.

Awesome post, thanks for the great contribution!
Also one thing to note - make sure your tints are legal. I bought a car once that already had tinted windows. I never checked if they were too dark or not. Got pulled over for that and it cost almost $16,000+ for that mistake

What?
16K for a tint violation? Did they find a body in the trunk or the car explode? That sounds unreasonably high.

And get a hair cut.
To take that a step further; if you're a cigarette smoker and are smoking when you pass by a cop put it out. Don't ever smoke a cigarette while being followed by police either, as the officer can use your smoking as probable cause to pull you over by simply stating "it looked like a joint" or "all I saw was smoke billowing in the car" or "sometimes people smoke when they're nervous or thinking they can cover up an alcohol smell".
Avoid tossing out a cigarette butt and/or knocking off a cherry while driving at night. The cop can easily use that as an excuse to pull you over for littering, even if the butt is still in your possession now you have to explain it during a probable cause stop.
The shit cops come up with is beyond me!

Awesome post!
I'd like to add that everyone gets pulled over eventually, the best advice is to never carry anything illegal in your car. We all ignore this occasionally, but it should still be kept to an absolute minimum. Minimum means minimum: there is no reason to drive around with your massive stash of acid, weed, and shrooms. It does not make you cool.
Also, one thing has gotten me out of a lot of trouble: being as nice as possible to the cop pulling you over. That doesn't mean overdoing it, just don't be an asshole, rude, contradicting, impatient, outraged, etc. Just like in customer service, a smile goes a long way.

I hate the police.
Too fast? Speeding, illegal. Too slow? ARE YOU HIGH? illegal. Driving the speed limit = suspicious?
I keep a copy of my state's DMV manual with me with the page about speeding laws (5 over, 5 under) torn out and right over my visor.
Never had to use it.

Slightly less relevant, but I can recall being accused of casing my own neighborhood and threatened with arrest whilst reading in a lawnchair at the end of the short driveway of my property. Unreasonableness is only one overzealous rookie, distrustful neighbor, both, or swerve away from your bail bondsman being interrupted during their dinner.
Also, many cases of folk being pulled on interstate and regional highways for driving the speed-limit while traffic was overwhelmingly slower/faster. Better to match the law, or the flow of traffic? Seems to depend on location and circumstance foremost.

Well, we're talking about not giving them legal probable cause to pull you over, so match the law. I know how it is... traffic is often doing 80 in a 65. But if you end up in court and you try to say you were going with traffic they're just going to cite the state law that says you can't go over the speed limit.
Some people HAVE gotten off... of speeding ticktets for that reason, but if you're charged with something major the "being safe and going with the flow of traffic" excuse doesn't matter shit. "I pulled you over for doing the speed limit", doesn't hold up in court OTOH.

I didn't read all of that but yeah.. Follow the law, don't stand out and don't drive a hoopty.
Just a few tips if you do ever get pulled over.
Be clean, don't have lots of clutter in your vehicle. Know where your insurance and registration are and have them available without having to go through garbage to get to them. ALWAYS keep your stash in a hiding place, don't ever keep it where someone can grab it with a search. I like, under the spare tire.
Don't smoke weed in your car, it's too much of an investment to lose for a dollar joint.

Under the spare is terrible in case you get a flat tire on the highway. In that case a cop may well stop and wonder why the hell you're not getting your spare tire out.

I know this guy named Bill K., he had the messiest car I have ever seen. Literally shit piled up to nearly the ceiling. He got pulled over all the time and the cops never searched him because his car was nasty and it would take hours to go through all that. Also he kept a massive dildo right on top in plain sight. The cops always took one look at his dildo, rolled their eyes and told him to have a nice night.
Quote:

But not too available. If you can pull out your insurance and registration in one second that will also make police suspicious. Make it take around ten seconds.

Good advice. Also its important to keep everything illegal in the trunk to avoid terry stops.

When I was a kid, my car used to be full of trash and junk about up to the seats in the back, but the front wasn't half as bad. Never been searched, but got pulled over and "approached" quite a few times
I'd hate to have actually been searched. I totaled that car, ended up pulling out live .38 special rounds, medication containers that apparently my "friends" were trying to lift off my folks, that kind of stuff...

Always stay under the speed limit. Traffic always goes way faster than the speed limit on many freeways, so you may stand out. But going the speed limit or going a couple MPH under the speed limit is NO cause to pull someone over. Just stay in the slow lane.

I'm not so sure about that. While almost all cop cars do indeed have cameras, it's the COPS that have the camera. That being the case, THEY have the video record of what went down, not you. AFAIK, their tapes are not public record. Basically, this is the exchange I see happening:
"But he pulled me over illegally!" "Yeah? Prove it." "You have a tape! Give me the tape and I'll show you!" "What tape? "
I'm planning on eventually wiring cameras into my car (up in the corners of windshields, etc.) to get a 360 degree field of vision in case I get stopped, and wire a mic near my driver's window so I can record the exchange. At least then I'd have my own record of it.
The only problem I can see then is that usually the digital recording equipment that police use have features that automatically "sign" and time/datestamp the recording. The signature is tamperproof, and forensics can tell if the recording was modified or edited. Consumer equipment wouldn't have that security feature.

If you're not breaking any laws, you shouldn't get pulled over, and if you do get pulled over it's probably from previous events i.e. your record.
Since I had my DUI, my driving has become completely different. I drive slower and tend to get paranoid if I am going over 5mph above the speed limit, so I never do.
I've been pulled over once, and that was for passing a cop who was going 10mph slower than the limit, this was at 10PM however, not the witching hours, but the time people usually go home. He must have been disappointed by the fact that I was the driest person on the road and led him deep into the suburbs on a wild goose chase just because I knew I had nothing illegal on me. He ended up having to let me go (obviously) and was pretty pissy the entire time about how he had pulled over someone sober.
I agree on don't smoke in the car if you've got a large quantity of stuff, but on roadtrips, if you've got a personal amount, just be smart about it. If you're going to smoke in the car, don't pull over and smoke in the car. I have more friends who've gotten busted for smoking herb in their car because they were stopped and a cop rolled up going "hey what are you doing?" I don't think I have met anyone who's been arrested for smoking while driving, usually your actions are too quick and if you're moving at speed with a window cracked, there is no smoke cloud. The passenger is also key before any lightup to check the road around and make sure no one is observing.

there was a ruling back in 1963 that the prosecution must make all evidence regarding the case (whether they choose to use it in court or not) available to the defense. the cops, if they withheld a video from your trial would be in trouble themselves. the entire prosecution would be done for. if you have a half decent lawyer this would be easy to take care of. your lawyer sends a nice letter requesting video. they say "what tape" your lawyer goes to judge. judge orders tape. you get the tape. and that is the worst case scenario. most laws are pretty fucked up and can be used to destroy you, but almost all people in the judicial system obey this ruling because it can be used to destroy careers like nothing.

Keep your license plate clean! I've been pulled over because my plate was "difficult to read" As someone else said a good attitude can make a huge difference. In the case of my license plate I apologized for how dirty my car was and offered to use a fee napkins I had in my car to clean it off. He took my offer and made sure I took my trash and I was on my way.
A good attitude and a willingness to jump through their hoops has gotten me out of many many tickets. Know your rights! Stand your ground and don't let them talk their way into searching your car or get you to admit fault. But if they want to waste some of your time it's better than a ticket or jail.
As far as traveling with less than legal substances, I try to only carry what I can eat in one mouthful and a gulp of water. Why take an ounce when you don't need it?

A good attitude and a willingness to jump through their hoops has gotten me out of many many tickets. Know your rights! Stand your ground and don't let them talk their way into searching your car or get you to admit fault. But if they want to waste some of your time it's better than a ticket or jail.

Yup, I am always an overly respectful kiss ass to cops when I am pulled over. I also look pretty clean cut, not to mention I am white. I have been pulled over with a dirty pipe and weed on the floor by my friends feet and I got off without even getting a ticket.

My comment probably comes as pretty obvious to most people but I just wanted to add something.
When people say that a case will get "thrown out"
its not really a simple process and it will cost you a shizload of money in some cases.
fuck the police
when a scumbag cop pulls you over even for a crap reason
and then they illegally search you
but they find something
the process to get off is a pita
first you have to bond out of jail.
if they grant you bond
then it depends on what type of bond they hit you with
sometimes its a cash bond meaning that the whole amount needs to be put up in cash or 10% cash 90% collateral, you get the 90% back if you show up to trial
other times they will settle for 10% of what the bond is
either way you lose the 10%
if your bond is 40k that is 4 grand down the toilet
now you have to get a lawyer on retainer
this can cost quite a bit of money depending on what the charges are and where you are in the country and what your background is
say they charge you 5k
thats 5 grand you need to come up with before they get started working on anything
now the lawyer will try and file for a motion to suppress the evidence
if they deny the motion to suppress then the lawyer can file an appeal
if the appeal is denied then you have to prove to 12 jurors that your 4th amendment rights were violated while the state tried to put you away for being a druggie
the fucking cops suck
the drug laws are bullshit
the justice system is a crock
even if you do nothing wrong they can still search you
you have to have enough money to throw around to be able to "get off"
when you hear about people getting off they dont normally post how much it cost the dude to prove his case.
long story short
be as careful as you can
but dont think that shit just gets thrown out
probably a shitload of people in jail that copped to a plea even though their rights were violated and they should not have been searched.
cops know it. they dont get repremanded for cases being thrown out. they just throw enough shit against the wall and more than enough sticks.
the DA and the judge don't throw out shit for no reason even if rights were violated.
$$$$ has to be paid
fuck the police

I don't think this is correct. Where you lose money is a bail bondsman. You can either pay the whole amount to the court directly and recover it after you appear for your court date, or you can go through a bail bondsman. The bondsman typically will require 10-20% of the bond amount, all of which they will keep as a fee. Sometimes the bondsman will accept collateral.
Then they would pay the entire amount of the bail for you and recover it after you appeared in court. No show? They come the assets or the person that signed you out.
That's my understanding of how the bail bonds business and bail works in the USA, at least.

In my state it is illegal to be on a cell phone while driving or texting & driving, I refuse to use a blu tooth, so if you see cops just put the phone down. Also never ever smoke weed in the car, the smell stays in the car too long. If you are riding dirty make sure you have a stash spot in the car or best spot is under the hood they will hardly ever look their, but never ever agree to let them search the car. You never know what you or one of your passengers had dropped and the car that an untrained eye wouldn't find.

Not sure if this has been stated already but it's the not-so-obvious:
If at all possible, do NOT in fact drive. Either have the other party drive to you or simply walk the distance.
Driving and sometimes even bicycling subject you to a slew of new laws and regulations that permit the police to stop, detain and search you (I SMELL WEED).
If you are however walking down the street, you are SIGNIFICANTLY more safe from search and seizure, although an officer MAY still terry pat you and "stop" you persuant to questioning you about your identity. If you aren't confident with your knowledge of the law you may give him identification that isn't necessary (Where I come from it's only required if you're driving or a passenger) but in most places an officer may stop you and ask you questions about your identity which you may not lie about. Personally I have a justified religious reason for referring to myself by a pseudonym and as such if questioned would be able to reply without using either my legal first or last name.
The bottom line here is this: walking is safer than driving in regards to search and seizure. Make sure ANY containers you have with you are LOCKED. Police have no legal reason to search a locked container. Any weapons inside can't hurt them and they can't see anything illegal going on.

Good idea about walking, though I have been stopped and questioned while walking more than once. Its always late at night, one time they said there was an auto burglary in the neighborhood so they were stopping everyone. They complained that I was wearing all dark colors. I told them that I only own clothes that are dark colors, but they didn't seem to care.

I moved and spent over a year in another city, driving drunk daily and overall being stupidly reckless, never got pulled. Since returning five months ago, pulled eight times now in a car and three times on foot, only one of those three later than 10PM...bad stuff.
Also, open container laws are a bitch. Gave a close friend a ride today and had expired tags, (foul, but was already ticketed for it and in the system), ate a 25 dollar fine with 157 dollar court costs for a Sparks can full of lemonade. Do NOT ever leave ANY empties in the car unless they are secured in the trunk. Wasn't even aware it was illegal if not full of alcohol, and they usually don't worry about it if they got you on something better, but if they have nothing else you will get that ticket.

we used nutbags back in the day and they saved our asses a few times
get a crown royal bag or a sunglasses bag and loop it on the button of your pants and put the bag on the inside of your boxers
some people even stitched a button on the inside of their boxers so there is no visual exposure of the string
even if you get searched it would take a cop feeling your dick to feel anything and most cops may feel the area for weapons but none of them get that grabby
i had a friend stopped with a shitload of pills in hit nutbag on him and they were searched and this saved him

nutbag sounds like it could totally work. I'm with numonkei though, I'd go for swallowing whatever it was I was carrying. That isn't an option with many substances though .

Actually, without weight it often is. I've swallowed over two grams of GOOD dope...downtown and then back out, probably about three hours total...nothing came back out solid, just plastic chunk, but I was quite alright and felt very little from it. Not exactly the safest thing to advise though, don't remember oral bioavailability for oral with that stuff, the puke tasted fantastic though...missing multiple felony charges tastes even better.

So I just got a DUI....I posted a story about it on here that is extremely long and retarded. Nevertheless, I got a DUI and hadn't drank any alcohol. Yet, I apparently had drank a whole bottle of cough syrup. Yall dont have to read my story, although it would all make some more sense if you did have time to....but my point is... If I was driving under the influence and crashed my car into someone, was given an "non-reportable" crash incident based on what they called "DUI careless driving"...does that mean they aren't giving me a DUI for controlled substances, or just that I will have to go to court or have some court thing decide all that, and decide if I go back to prison. Please help I know this is an incomplete picture of my situation but read this if you really want to help me any more. thank you all so much thank you thank you thank you

Mine would be to just post the same question in only one thread. Especially in the same forum. And certainly not in a thread on how not to get caught. You're past that point.
But what the hell do I know? I just hang out here.

Oh... another thought.
Making an anonymous thread telling your tale of woe, and then while posting here in this thread using your actual nick, while telling people about your anonymous thread, kind of negates the benefit of posting anonymously.
Don'tcha think?

fastfred said: #23 If you crash or get stuck somewhere...
This business of going to a bar and getting drunk thing is completely legitimate. In my area, a local cop had apparently bragged to some people about how to get away with a DUI (it could have been murder, I don`t recall if it was a DUI with a fatality or not), and that he had done it before. This method was going to a bar and having a few, but leaving your license with someone at the scene of the accident. Unfortunately he had also done this a few times, and I believe the one that made the paper was because he had told this to people at the bar that night, then driven drunk and obviously gotten into an accident. The flip side of this is that I believe he did kill somebody, and went to the bar to drink so as to not be nailed for DUI, but due to his earlier loose tongue he was nailed for it.
It does work though, but the best policy is NOT to drink if you`re going to drive.

Not sure the change for a pay phone is relevant anymore, I lost my cell last year and had to make a call. I looked all over the city I was at and could not find a pay phone. Not in front of any c-stores, grocery stores nor big box stores it sucked. Finally asked someone to use their cell.

Never break more than one law at a time, if at all possible. This is something my father told me a long time ago and has always stuck with me.
One more thing to add...
If you ARE engaging in any illegal activities (especially buying/selling illegal substances), always have a "mutual contingency plan" layed out, in the event that you are questioned separately, which you undoubtedly will be if the authorities are any bit suspicious, and they WILL be.
I know someone who met their dealer once on a dirt road way back in the woods to acquire a large quantity of trees. They had just made the deal and were back in their vehicles. The cop came to my friend's window first and asked why he was there. He told the officer that his friend had moved recently and met him there so he could follow him to his new place. The cop then walked to his dealer's vehicle and asked him the same question. He responded with the exact same story, which led to the cop apologizing for the hassle and telling them both to have a nice day.
This was NOT planned out, and they were both EXTREMELY lucky to have said the same things, but this is a solid example of how much smoother things go when your stories match up!!!
Excellent write-up sir. These are all laws of common sense that I have been preaching to people for many years now.

Great thread I have 2 duis myself, both retardedly dumb situations that if I had the cash for a decent lawyer they had no proof.
Opposed to my friend ( who got me my first one not putting his seatbelt on) smashing into a pole at 40 miles an hour with me and some other friends in the car. I immediately got out of the car ran and called my mom to pick me up. Sure enough we pass him getting sobriety tested, but since he had 4 grand for a lawyer. He got off with reckless driving.
He's the worst driver I know, and I drove across town in his car. He insisted on driving back so I was like fine whatever. Was a pretty bad accident his truck was totalled which he just dropped 10k on, and insurance got him 14 grand. I fuckin hate him for that shit, and if his door would have opened. I would have dragged his ass out of the car and beat him in the street.

Actually with the "FREEDOM OF INFORMATION ACT" you can request (demand/summon) a copy of the footage from the exact time the officer was interacting with you, cost 15$ inquire at police station

That sometimes works, but they aren't required to video you, so often there is no footage. And when there is footage, if they don't like what they see, they have a tendency to lose it.

I'm sorry I should have been more clear with that statement, What I mean is you can request the footage from the SQUAD CAR's dash cam, these are in use almost 100% of the time during any traffic stop. When I was traveling (tramping more specifically/hitch hiking and what have ya) I had a lot of police interaction, but a lot of time they park with the dash cam facing the other way, unlike if you were pulled over then you're almost sure to be right infront of the camera. Amidst my collection of interactions with police there were a number of time (3 or 4) when they informed me and my drooges that we were under audio and video surveillance via a small camera next on their shirt! No b/s im sure some of you have also had this experience right? Most prominently I had this happen on the Oregon coast.

If you have to transport drugs in your car- do it during the day, during a normal work driving time. No chance of getting stopped then. Your just one of the daily commuters going to / coming home from work.
My problem during this time of day is that traffic cops are actually out harder during this time, and more traffic accidents tend to happen. Even if you're a good driver, there are just more idiots to hit you.

This happened to me. I got a copy of the police report and there were a bunch of fabricated things (things that they/I said or did) so I had my lawyer demand the video which would've cleared me on most of what was in the report, but then the cops said there was no video of the encounter

Solid, well-written advice. One thing I may add that I did not see which would have saved my friends from getting DUI's, is this:
If a cop asks if you've been drinking tonight, tell him NO! There is no reward for being honest in a DUI situation, and telling him you "Only had two beers" or even "I had a sip of wine" is giving him PROBABLE CAUSE. In fact, if you are over the limit, and you admit to drinking AT ALL at a traffic stop, you might as well be consenting to a DUI charge. You can avoid the whole charade of roadside sobriety tests and $7,000 of DUI fees, insurance, etc. by simply saying no. Tell him not one fucking drop.

Wow! Nice to see this thread is still going. Lots of good advice here, but most of it falls under what to do if you're stopped, which is a whole subject in it's self.
I've been driving awhile since I wrote this and have been stopped twice. Once because I cut through a tractor lot (at night), and once for I think no headlights (just leaving the grocery store).
It's easy to make mistakes no matter how careful you are. Both times I got off without a ticket, but once I was probably over the limit a tiny bit and the other the cops had a computer error that thought my license was suspended.
Not sure there's any real lessons to learn there, but both were avoidable if I had just followed my own rules more carefully.

I was pulled over once for "going down a bus lane" at midnight. :P The next street over was a bus lane but not the one I was in. I apologize and explained to him how the signs were confusing, I thought "bus lane ahead" meant the next street over (duh). Even though, I was right--I apologized and said that the signs confused me and I'm not familiar with that area (even though I grew up there lol).
He asked me if I was drinking and I told him no. He asked where I was coming from. I thought about lying but where else would I be coming from at midnight, right? I told him I came from a bar. BUTTT I was coming from dropping my boyfriend to work (he's a bartender and starts at midnight).
I had a few drinks too :p no ticket! yay.

Follow the advice in thread, and add to it. Then you hopefully won't have to deal with the law at all.
The most recent person to smack themself was someone that said they loved the thread, but ended up with a burned out light. Just a pullover, but could/should have been prevented.
Why would someone think their 10+ year old beater car might loose a light? [If you have to ask you may deserve to be pulled over.]

Hate to revive an old thread but its relevant, I've never had a drivers license, drove through/to 41 of the lower 48 states, only ever been pulled over in 4, every time I was driving at night, driving drunk/erratic (oregon had no clutch, had to gear start and float gears - couldn't start 1st gear from stop light with headlights on, pulled for no head lights at night) Now I live in a crime riddled area never drive at night, only A to B, B to A, lights, tires tabs and respectable appearance - also non red cars help, the best cars ever to have is 80's volvos with earthy colors of brown and tan - they scream college professor or librarian.

Well we might as well keep an awesome thread going.
If you live in a province/state that has it is illegal to use a cellphone while driving, leave your goddamn phone in your pocket. I really can't stress this enough.
Cops in my province crackdown on this so hard. This is a really easy way to fill their quota so they won't think twice before pulling you over. I will always be a legal stop.
Holding a phone to your head is obvious, texting is somehow even more obvious. If you must take calls when driving get a bluetooth speaker phone setup in your car. Better yet pull over.
It is the most easily avoidable thing.

I take calls on a case by case basis cause pulling to the side of the street where I live can make tyou look like a drug dealer or your getting ready to open fire on some peds, just last night i talked on the phone all the way home - no bluetooth. Its just that crazy here (this city) talkin on the phone while driving is better than pulling over.

fastfred said: I've been meaning to post my tips for awhile now.

So much swearing , please don't swear. Swearing is not good to do.
So much rebellion. Rebellion against the state is a sin, in the Bible. We are not to rebel Authority, for even authority be given by God, at least righteous ones. But even the unrighteous authority we are not to rebel against.
