Despite rejecting Prop. 19, Californians lean toward legalizing marijuana, poll finds November 4, 2010 | 3:12 pm
California voters rejected Prop. 19, but a post-election poll found that they still lean toward legalizing marijuana for recreational use and, if young voters had turned out as heavily on Tuesday as they do for presidential elections, the result would have been a close call.
The survey, conducted by the polling firm Greenberg Quinlan Rosner, suggests that California voters had qualms with this initiative, but remain open to the idea. A majority, 52%, said marijuana laws, like alcohol prohibition, do more harm than good.
“There’s a fair amount of latent support for legalization in California,” said Anna Greenberg, the firm’s senior vice president. “It is our view, looking at this research, that if indeed legalization goes on ballot in 2012 in California, that it is poised to win.”
Voters think marijuana should be legalized, 49% to 41%, with 10% uncertain, the poll found, but were evenly split over whether they thought it was inevitable in California.
“The question about legalizing marijuana is no longer when, it’s no longer whether, it’s how,” said Ethan Nadelmann, the executive director of the Drug Policy Alliance. “There’s a really strong body of people who will be ready to pull the lever in the future.”
Nadelmann and the Drug Policy Alliance played a key role in the campaign, bringing a late rush of money to help fund a final advertising blitz.
The poll was paid for by Peter B. Lewis, a retired insurance company executive. Lewis donated $159,005 to the Drug Policy Alliance’s campaign for Proposition 19 and was one of the backers of California’s 1996 medical marijuana initiative.
The poll also found that a quarter of those who voted on Proposition 19 had considered voting the other way, suggesting that a different initiative or a different campaign could change the result.
“We have fluidity,” Greenberg said. “The issue does not have the kind of hard and fast kind of polarization that we’ve seen with other so-called moral or social issues.”
Among voters who opposed Prop. 19, 31% said they believe marijuana should be legalized or penalties reduced, but they objected to the some specifics of the initiative.
The poll did not probe what it was about the measure that did not appeal to these voters. “Among the no votes, we’re seeing a significant proportion who we believe will ultimately support marijuana legalization in the future,” Nadelmann said.
Prop. 19 would have allowed adults 21 and older to grow up to 25 square feet of marijuana or possess up to an ounce. But it also included a provision to protect marijuana users from discrimination that opponents, including the Chamber of Commerce, ridiculed. They claimed it would allow nurses and bus drivers to come to work stoned, which the campaign disputed.
The poll found some evidence that this issue may have cut into the initiative’s support. Voters said by 50% to 44% that employers should have the right to fire workers who test positive for marijuana even if they arrive sober and ready to work.
The initiative was the brainchild of Richard Lee, a medical marijuana businessman in Oakland who paid professionals to draft the measure and made the key decisions on its approach.
Lee chose to give cities and counties the power to approve marijuana sales, not the state Legislature, a system that would allow a patchwork approach much like medical marijuana. The poll suggested that voters prefer that local control approach, finding that 44% trust city and county governments more to control marijuana, while 38% trust state government more.
Greenberg Quinlan Rosner surveyed 796 voters who participated in the election by phone between Oct. 31 and Nov. 2. The poll has a margin of error of plus or minus 3.5 percentage points.

I think every state should legalize medical marijuana and decriminalize pot under one ounce. This way the government can still charge people tax on medical marijuana. The average Joe will stop getting arrested for a dime bag. Plus pot will still be illegal so the government can still go after drug dealers/cartels.

ignoring me wont change the fact that it is a state matter and if you are not a citizen of the state the law is being passed in stop whinning about what the outcome is. move out here and register to vote get a law you like passed I got one I didnt like get defeated it is the american !1

I can't move out there and register to vote. I literally don't have the money or ability to do so.
So what if I don't live in California? Voting "yes" would have helped end the oppression across the country, and you refused to do it because you're a selfish fuck. I hope you enjoy the money you're making from prohibition while your fellow (innocent) citizens are sitting in a jail cell.

1) No one would be buying? Really? Nobody? You know it is legal to grow tobacco, but how many people do that? People just want to pay for someone else to do the work for them. Did you build the automobile you drive? You ever use an automobile for transportation because you didn't want to put forth the effort to walk? What about automated car washers? Not only that, plants get pests/diseases and many other problems that cause them to die or people could steal your plants. Having it available in a store to buy, is the best solution. What if you live in an apartment and have no yard to grow outdoors and don't have any room to spare indoors to grow or don't want to invest the money to grow, after all, if you can buy it cheap enough from a store... While it is illegal, the profit margin is high enough to make it worth while to some people to risk the jail/prison time, but if it was legal, it would likely be grown as a hobby and most people would probably grow very poorly. (added info after reading a reply to my post so I could elaborate).
You should be at least 18 years old to be on this website, therefore, you should be well aware of the price of tomato's and other foods going much higher because of crop loss. Even professional corporations suffer crop loss. What makes you so sure that 100% of everyone who smokes pot will not only be immune to crop loss, but also will prefer to grow it rather than having it professionally grown/cured and all they have to do is pay for it and not have to deal with any issues related to growing/curing? Your claim is for 100%, that is bold and arrogant.
2) THC products: What about buying everything related to cannabis and smoking/eating/growing it? Lighters, rolling papers, jars, air sprays, food, eye drops, incense and so on? What about fertilizers, pots, water, support cages, scissors, bags and so on?
3) Surplus: For how long? 4-6 months and you have an 80 year supply for yourself and enough to share with your friends/family members? What if something happens and your cured cannabis gets ruined? Are you just going to quit smoking for 4-6 months until you can grow/cure some more? What about the first 4-6 months if Prop 19 was passed, are you just going to pull it out of the air?
You obviously did not give this much thought. I admit that my argument against you is not perfect, but I was in a hurry to write this and now I have to go do something. My point is, it seems to me, the people against Prop 19 that smoke weed, are either drug dealers, cops, was tricked by the propaganda, or just plain stupid.
The larger the percent of the world that says "cannabis isn't as bad as everyone else says it is" the more people will say "well, OK, maybe your right, we will lower the harshness of our laws against cannabis a little" and as they find that it is making the world a better place, more and more places follow and before you know it, "Refer Madness" starts to fade away. Every time cannabis is voted against, it is preventing this from happening and is encouraging the world to believe "marijuana is a dangerous and scary drug that is the worst thing in the world".
Yes, I am aware that some of the parts of Prop 19 were not perfect, such as "being around children" and so on, however, there are soooo many situations and circumstances, you can't expect a prop to be bulletproof flawless and you can't expect it to not have limitations at first. People are not afraid of someone buying 900 gallons of 150 proof vodka at once, but people freak out over having more than a handful of cannabis at once, mainly because it is illegal and they believe you are going to sell it if you have enough. In order to not have limitations, the only chance is to have the federal law changed in USA so that weed is no longer a scheduled drug. If weed is fully illegal in all the states and very harsh penalty's against it, then that will NEVER happen. It HAS to be a gradual thing so that people don't think that legalizing weed is the same thing as inviting the anti-christ to come to torture us all with burning flames of damnation and stabbing us with a pitchfork and result in the end of life as we know it. They have to see that propaganda is the reason it is illegal and that people can use it responsibly.
* Don't forget about the hemp industry, if growing cannabis was legal, then growing hemp would be legal too. Growing hemp in California would be profitable and taxable too.

Guest1: I agree with you on that even if it were legal to grow 99 plants (which is allowed for personal use under CCHHI), not everybody will be doing it. If you work full time, growing indoors is impractical. Buying all the equipment, setting it up, installing and running it may not be worth your while. Growing outdoors is obviously not an option for anyone without a garden.
