Proposition 19 ~vs~ The Feds
    #13302915 - 10/07/10 08:58 AM (13 years, 3 months ago)

If proposition 19 passes , How are the federal gov. and the DEA going to react?

Will it be open season on Californians who grow & sell?

Will it not  create problems with persons taking it across state lines to supply other states?

Will the Federal Gov. enact sanctions and cut fedral aid?

I see a whole slew of problems that will take forever to iron out.

Badly.

It is now.

Depends on what you mean by "problems".

And risk losing all those bought and paid for votes?

The government cannot give to anybody anything that the government does not first take from somebody else. When half of the people get the idea that they do not have to work because the other half is going to take care of them and when the other half gets the idea that it does no good to work because somebody else is going to get what they work for that my dear friend is the beginning of the end of any nation. I think if weed was legalized maybe we'd be a little bit more tolerant to the bullshit from FED & BIS

Hopefully not by arresting people in a place where the local govt says its legal.  Except that's already happening more or less, so it should be interesting.

> If proposition 19 passes , How are the federal gov. and the DEA going to react?

Prop-19 doesn't change federal law.  Federal law trumps state law, thus prop-19 will change nothing at the federal level.  My guess is that the DEA will put every resource they have into busting people in California to set an example.

> Will it be open season on Californians who grow & sell?

At the federal level, yes.

> Will it not  create problems with persons taking it across state lines to supply other states?

Again, a federal issue... nothing will change here because of prop-19.  If you read the federal law against drugs, the primary reason they use as justification for the law is "interstate commerce" which the federal government has jurisdiction over.

> Will the Federal Gov. enact sanctions and cut fedral aid?

Probably.

> I see a whole slew of problems that will take forever to iron out.

Such as?

Such as? I was looking for a little more input , not curt answers.

In no time there will be an overstock of product , no market to get a reasonable price. Producers will have to look elsewhere to move their product. The neighboring states will have a sudden influx of MJ traffickers , facing stiff sentences.

Where will they house all of these new prisoners? Can they possibly?
Will it force neighboring states to reexamine their own laws to deal with the crisis?

Will the citizens , tired of persecution, lash out at the gov.?
Could a simple thing like MJ cause states to break from the union?

How can the feds tell a state how to handle its own people if they aren't breaking federal laws . MJ , if not crossing a state line & under so much is left up to the state to prosecute.

Will the Feds turn the DEA loose on such a large amount of citizens?

Will reformed MJ laws snowball?

You really think so?

I imagine they'll do some operations and get the media attention they love so much, and spend a ton of taxpayer money on public service announcements that pot violates the controlled substances act, but that's about all I see them doing.

After they get their airtime, I imagine they'll largely proceed as they do now.

It will be interesting to see if the cops try and refer cases to the feds if it passes- they love to spout "we just follow the laws" when they get criticized for their backwards behavior, but then will turn around and actively subvert the law where it agrees with their whims.

See: the counties who sued the state to enjoin issueance of medical marijuana permits, for examples of this.

edit:  I'm sure they'll go after brick and morter buisnesses associated with pot as they do now- they seem to love asset forfeiture even more than policing people's personal lives.  Unfortunately, this has a large liklihood of negating much of the benefits of legalization by driving the state-legal buisness back underground.

It will go to the supreme court because it will be one of the first issues to test states rights/federalism

A good read on Prop 19's potential conflicts with the federal Controlled Substances Act:
