The California Governor, Schwarzenegger, who opposes Proposition 19, this morning signed a landmark bill in the state of California which decriminalizes the possession of marijuana. For those wondering, this does not make marijuana possession legal, but it no longer will be a misdemeanor offense. Instead of the mandatory fine of $100 as well as the mandatory appearance in front of a judge, the outcome of being caught with marijuana will now simply be a $100 fine. The new law will be in effect on January 1st and include anyone caught with up to an ounce of marijuana. Basically the possession of the drug is seen no different by California now than speeding is.

Schwarzenegger signed the bill because it will save the state a ton of money since there will no longer need to be a judge and attorneys appointed to each and every one of the misdemeanor offenses involving marijuana possession. Last year alone there were 60,000 Californians caught with the drug, and in the last decade approximately 500,000 offenders.

Schwarzenegger however remains against November’s Proposition 19 (known as Prop 19) vote to legalize the drug.

Nice.  Sounds like MA.

It definitely would make me feel a lot safer if it was the same in my state.  I can't even imagine.

It's insane that in some places you can do jail time and in other places you have a simple fine.

At least now it won't be such a huge letdown if prop 19 fails

People will probably say that this bill will make people even lazier about getting out the vote for 19.. but I don't think it's going to pass anyways

Here in MA the $100 fine decrim law has been in effect for awhile now. Even before that though I can remember even back in like 2001-2002 just smoking blunts in Boston walking around. The cops barely even try and enforce the law at all now because you can refuse to give them I.D and if you don't pay the fine there is no consequences. All in all, a pretty solid city/state to be a stoner in.

Looks like a step in the semi right direction.,..now its just a fine atleast..
now we gotta vote on prop 19 to de-criminalize it...
i feel like this year is the year pot's gunna start being legal in places and then eventually across america...
pitty it took baby steps to get here... but atleast its hapaning...maybe it'll pull us outta the depression like how alcohol did when we had it prohibited and then legalized

Sounds like Oregon, or at least in my parts with no jail space. Last time I had pot a cop just dumped it and shook his head, "no medical card, meh". Nothing happened and it was only a a bowl load. Besides, they have tweakers and pedos to deal with.

Still looking forward to legalized bud, where ever it may be in the country. It is a start and the more states that decriminalize it the better. It is a step in the right direction.

The new law, which takes effect on Jan 1, 2011, will have an effect even if Californians vote to legalize marijuana by passing Prop 19. Proposition 19 leaves misdemeanor possession penalties in place for public use and smoking in the presence of children; under SB 1449, these offenses would be simple infractions.

This is still not a victory. I STIL CANT SMOKE. I have a real fucking job that tests frequently. not until it is legalized, its not a victory. This is just going to make ppl not vote because they are "satisfied"

SB 1449 deals strictly with possession. Cultivation would still be considered a felony until Prop. 19 passes.

I have to admit, I think the passing of this bill is not necessarily the best thing with prop 19 on the table. "Sympathizers" (people who don't smoke, but understand the need to legalize and regulate) might not be as inclined to vote; they might think, "well that's good enough.". However, I think most people understand the difference between "decriminalization" and "partial legalization", and will still vote yes.

EDIT: I think prop 19 still has a chance. Polling has it at more pro than against (47:42), and I think the polls are less likely to sample people who are young and just registering to vote (and are likely to vote yes). In fact, for many freshman entering college, this will be their first election! If it doesn't pass, it is going to be damn close.

I dont know, I think the people that don't smoke that are thinking of voting to pass prop 19 are doing it on the fact that legalizing would bring in billions plus help to cut off money from the cartels.  This bill will do none of that.

i know for sure too bc my friend got caught with a roach...he was driving a car that wasnt his to pick someone up and got pulled over...they found the roach...the owner of the car even went to court to say my friend didnt know it was there and that it was hers....didnt matter he still got a year probation and spent a few weeks in jail.  he is also on this thing called "first step" which requires an ankle bracelet and he is only allowed out from like 10am to 9pm every day.

that is GODAWFUL. There are so many things wrong with this. Talk about ruining someones life over something insignificant, and why? Honestly I dont know why, sheer ignorance and backwards thinking.

I think its to the point of where its been such a failure for so long (criminalization of drugs), that to stop after putting so much effort into it, would embarrass those who grew up believing in it.
