legal detainment is always questionable as a cop can hold you up to 72 hours without charges if he can articulate a reasonable suspicion

did you sign a waiver forfeiting your right to have an attorney or to
remain silent, did you fail to exercise those rights, the fact that he
failed to mirandize you properly doesnt mean anything if you waived your
rights and they have it on tape or paper

Pris:  Is the perceived smell of marijuana an articulate reason to detain someone?  Couldn't it be argued that it is just as reasonable to assume he smelled it coming from someone's backyard?

for detaining, as I stated they can hold you up to 3 days without charges

as for search or suspicion of DUI/DWI, depends on jurisdiction, there are a
few that have ruled the sent of smell is not probable even though it has a
distinct smell a number of judges are seeing the trend in cops claiming
smell and finding no evidence, a study done showed that most people cannot
tell the smell of marijuana over certain other smells like exhaust fumes
such as on a busy highway

when a cop makes the claim of smelling marijuana I tell him he's wrong,
if he pushes the claim I will call him a liar and I make sure that I
express a phrase "I understand your desire to try and make the claim of
probable cause to perform an illegal search on this vehicle but you do
not smell marijuana in my vehicle and I do not consent to a search"

cops are wired for sound that goes straight to the camera on their dash,
it's all recorded from the time he starts his car or at least until the
blue lights flip on, use their tools against them
