My son in jail

My son asked me to go on this website to see if anyone could answer some questions for him. He was arrested on May 17th in a small Illinois town after the cops searched his apartment and found 1700 grams of shrooms. He has been charged with manufacturing with intent to distribute which is a Class X felony here. That means 6-30 years in prison. Does anyone know what their states punishment is for that quantity? Does anyone also know what percentage of psilocybin is actually in a gram of schrooms. Any help would be great, I have to get him out!!!

Pretty sure most laws are written to include the non-active dry weight as well as the weight of the actives but it's roughly 1% of dry weight.
Unless you can get the search declared illegal you're son is not getting out of this. Get a lawyer. You should be able to get free consultations - ask them about who is the best local attorney in drug law and search and seizure.

This is a very difficult situation and the case may not be winnable. If he sold to an undercover it is very hard to challenge the evidence.
Money does buy justice, and spending $10k on a lawyer will help to some extent. Don't get too carried away on an expensive lawyer though, the help a lawyer can do is probably limited to getting the charges reduced to a lower level felony. Hopefully they will be dropped to a tolerable level - best case scenario there will be a suspended sentence with some probation, though a year or so jail time is likely. At least it won't be closer to 30 years though.

I would imagine 1700 grams is almost impossible to argue down the intent to distribute by claiming personal use - that is a horrible situation.
How was he busted?

No use getting worked up so soon. Just get him out on bail if you can.
I always tell people to get a public defender first if they qualify. The PD can do most of the work, which saves you lots of cash. I think it's also not a bad idea to see what deal the PD is offered, then bring out the big guns. That way you have a fresh face bargaining and they know you're serious about fighting it and they better offer a better deal.
If your son has a clean record the charges will be much less serious. Prosecutors have a lot of options for dealing. The main thing is to get the felony off the table if possible.
In any case ask for a withheld judgement. That means a term of probation, fines, etc., but at the end the charge will be dismissed entirely. If that doesn't fly ask for a suspended sentence. That means if you don't fuck up on probation you don't actually have to do the prison time, they just hold it over your head until you complete probation.
Your best bet is hoping the search warrant doesn't hold water. Probably a long shot though.
As far as the weight... you get charged with the entire weight just the same as if it was pure psilocybin powder. If you throw a gram of coke into an olympic swimming pool, you've just become the biggest coke dealer in history as far as the law is concerned.

you could get caught with 10 pounds a weed and be alright if your record is clean

A lawyer is the best bet. As stated earlier, research into the validity of the search is paramount. However, don't place to much hope in that. Police don't usually raid a home without a warrant. Damage control is key here, and a silent son with a charismatic lawyer is the way to go here. Please, please, please, refrain from a public defender at all costs. If you can't afford a real lawyer, well you get what you can and a public defender is better then nothing. However, most public defenders are applying to work in the D.A.'s office, and will do what is best for the D.A., and not your son. Best of luck to you to you in this more than fucked up situation.
