Two men charged with picking hallucinogenic mushrooms in cow pasture
June 24, 2010 - marconews.com

Two Bonita Springs teenagers found picking hallucinogenic mushrooms got the wrong kind of trip on Tuesday, after they were arrested and booked in Collier County Jail on trespassing and drug charges, according to a police report.

Timothy Carl Dowdal, 18, of 27791 Marco Drive, and Myles Sebastian Peacock, 18 of 27249 Pullen Ave., Unit B23, were arrested by Collier deputies and taken to the Naples Jail Center. According to an arrest report, both men were spotted by a Collier deputy at the end of Keane Avenue while they were walking through a cow pasture, eyes turned downward, as if searching for something.

In the report, the deputy stated that a third man was also there, but that he turned and ran upon seeing the deputy, and could not be found later. According to the report, the two other men also ran from the deputy, leaving behind a grocery bag filled with suspected psilocybin mushrooms, a hallucinogenic mushroom. The report states they later came driving by in a truck, were stopped and questioned and were identified by the deputy as the teens who ran.

The report also states that a two-liter soda bottle in the truck was filled with a brown liquid containing pieces of suspected mushrooms, identified in the report as "mushroom tea."

A third person, a woman, was in the truck with the two men, but she was released without any charges against her.

Dowdal and Peacock were both charged with possession of a hallucinogen and trespassing, after the rancher who owns the cow pasture said he wanted to press charges.

I have never seen a paper put out the addresses of the people being arrested. That is fucking low.

this rancher was obviously involved in a large scale psilocybin growing operation.

with an estimated street value of over 10,000$, there was enough psilocybin on this seemingly law abiding rancher's land to poison a medium sized city.

Not enough information to know whether or not the rancher's an asshole, as I'm certain the charges he was pressing were for trespass, and he's probably sick of kids wandering around in his pasture.

Returning on the same day to a place where you've been run off by the cops for committing a felony is none too bright...

I've heard of people asking permission to go onto farmers properties and I have heard that sometimes they said yes...

My friends used to do that way back in the day, they'd go to Spanish speaking farmers (they spoke Spanish) and ask nicely with a $20...

A guy and a girl got in trouble just like this a week or two ago down there. I wonder if it`s the same field? If so, you would think people would realize the area is being watched.

And yeah....driving back by is damn stupid! Kind of like how some arsonists set fires then come back to watch.....some people just don`t have any sense!

:congrats:

that is how i do it. Odds are if you hunt in broad daylight someone will see you eventually. so if that happens, just chop, run. How are they gonna catch you if you leave the pasture for the shelter of the forest. they would be idiots to follow you. Im glad that guy got away. I have been in a similar situation and just hid in a bush (at night) while the cops drove past the field.

.....But it's legal to pick wild mushrooms in Florida.

Quote:

Florida stands out because of a decision in 1978 in Fiske v Florida by the Florida Supreme Court which ruled that wild-picked psilocybin mushrooms could not be legally considered "containers" of psilocybin and thus would have to be specifically listed in Florida law by the legislature if they meant to make them illegal. Since the Florida legislature has not chosen to change the laws since then, the possession of wild Psilocybin mushrooms is presumptively not punishable under state law. This does not mean police won't arrest people for possession of even wild mushrooms, but this has been used as a successful defense against such charges.
