'GURU OF GANJA' FOUND GUILTY OF MARIJUANA CULTIVATION

SAN FRANCISCO An author of how-to books on growing marijuana andavoiding the law was convicted Friday of marijuana cultivation and
conspiracy charges.

The jury concluded that Ed Rosenthal, the self-described "Guru of
Ganja," was growing more than 1,000 plants, conspiring to cultivate marijuana and maintaining a warehouse for a growing operation. He faces a maximum life term when sentenced June 4.

Several people in the courtroom, including Rosenthal's wife and
daughter, wept as the verdicts were read by a court clerk.

The verdicts were a victory in the federal government's battle against California's 1996 voter-approved medical marijuana law. Rosenthal's arrest last year was among a string of Drug Enforcement Administration raids on medical marijuana suppliers in California.

Under strict orders from U.S. District Judge Charles Breyer, Rosenthal was never able to tell the jury that he was growing marijuana as "an officer" for the city of Oakland's medical marijuana program.

Oakland's program and others throughout California were authorized under Proposition 215. Eight other states also allow the sick and dying to smoke or grow marijuana with a doctor's recommendation.

But federal authorities do not recognize those laws.

"There is no such thing as medical marijuana," said Richard Meyer, aDEA spokesman. "We're Americans first, Californians second."

Jury foreman Charles Sackett III said outside court that jurors werefollowing federal law in finding Rosenthal guilty, but he personally hoped the verdict would be overturned.

"We had no legal wiggle room," Sackett said.

The government essentially portrayed Rosenthal as a major drug
supplier. Because federal laws trump state laws, Breyer ruled that
Rosenthal could not defend himself under the color of California's
Proposition 215. Marijuana, under federal rules, has no recognizedmedical benefit.

Rosenthal said he's anything but a drug dealer, noting that the plantsagents seized didn't have buds, the part of the plant normally smokedfor a high. He planned to give out cuttings to seriously ill people.

A founder of the National Organization for the Reform of Marijuana
Laws, Rosenthal used to write the "Ask Ed" column for High Times
magazine, and has researched and written nearly 20 books on marijuana.

Damn.

I had hoped he would get off through the "jury nullification" tactic, but it looks like the jury didn't have the balls to go that route. That was pretty much the only chance he had once the judge disallowed his defense based on his working for the city of Oakland.

This verdict will certainly be appealed all the way to The Supremes. If ever there was a test case for the constitutionality of the drug-prohibition laws, this is it. I figure we should all cough up some coin to fund his appeal process. Presumably the NORML website will have such a fund set up shortly.

A sad day indeed.

According to the AP version of the story he faces maximum term of 85 years in prison. Of course, he's not a young man and an 85 year sentence would effectively be a life sentence.

Poor Eddy. I'm suprised something like this didn't happen sooner to him. I've often wondered how he pulled his blatent activism off so well.

What will happen to him? Think he'll die in jail?

How can a judge 'disallow' your defence? What the fuck does that even mean? They won't listen to you? What's the point of even having a trial? Some justice...

They feds/DEA stacked that jury too...

Damn that fucking SUCKS... ..

Ed should have known better though. Even in the text of Prop 215, no one has any legal ground to grow 1000 plants.

Counties were given the right to decide how much was permitted per person and ONLY the sick person OR his caregiver had the right to posess or grow the pot in all of california...

In SanFrancisco Ed would have to be the Licensed and legel caregiver for almost 100 people to support that many plants.

I hope that on appeal Ed gets out of this eventualy.

When nobody else will do the work, then it falls on the shoulders of those who will.

There aren't nearly enough people supplying those in need. A good portion of the "Compassion Clubs" are just rackets set up by organized crime.

Everyone who is growing should be donating clones anonomously to the legitimate clubs.

If the pothead masses contributed more, people like him wouldn't have to do shit like that.

I think Ed may actually want to be in this position...he knew "they" knew. This puts the spotlight on the issue, people can't ignore what the federal government is doing anymore. Hopefully people's attitudes toward the demonization of plant cultivation will change as a result of this. I think we all owe ths guy a lot.
