well its hard to say if they will or not. There is nothing illegal about spores so theres no reason to, but im sure the government knows what's done with the spores most of the time anyway.. and i think they will be made illegal throughout the US sooner or later. It wouldnt matter too much, because most people on this forum can pick them and make spore prints.

even though common sense is not a factor in such decisions, the idea of trying to regulate spores seems even too absurd for bush. it would take a microscopic examination to determine what fungus any spores come from. the task would be daunting. imagine a truck load of syringes or spore prints, only one of which is p cubensis. the monetary and time cost of finding that needle in a haystack would be far too much. plus there are ways to get around it. how about mixing in some p cubensis spores in a syringe with sterilized spores from other fungi? you'd have a relatively few viable p cubensis spores in a huge haystack of non-viable other spores. good luck!

They're already illegal in some states. However, anyone familiar with the sorts of things that tend to get passed into US federal law knows that congress usually doesn't need any particular reason to outlaw something, especially if it's in any way related to recreational drugs.

Total unenforcability is likely to pose no deterrant, either.

Spores have been illegal in germany for awhile now, and they are pretty strict on it, geez if it wasn't for FSRE I would have never been able to get a new strain! Is really hard in germany, and they don't care if it is pc's or not they will nab you for any kind of print unless you have a license. However I havn't heard about them getting anyone for a syringe, because as it was stated before, hard to trace.

There are very small amounts of alkaloids in poppy seeds but they're still legal.

Poppies are also legal to grow. Only illegal to harvest and use in an illegal manner. Mushroom fruits are illegal altogether in a lot of places.

but there is not an "epidemic" of people growing poppies and producing opiates on a massive scale within the US so why waste the efforts on that? when you think like a pig the laws start to make a little more "sense".

do you not think about this? i feel as if you just ask to challenge me. let's see. you grow a shitload of poppies and produce a shitload of opium (for example) and you start slinging it. eventually it all comes down and you get busted. then we all know. same goes for shrooms. we've heard the horror stories. every time a shroomer goes down for cultivation (at least the ones I hear about) it is a LARGE operation. now, with that in mind, how often do you hear of large poppy production operation going down in the USA??? thought so. basic fact: it ain't happening.

good point but a little off the subject (that being ALREADY illegal substances having their means of production; seeds/spores/etc; made illegal) I have wondered why anyone cares if salvia exists (from a legal standpoint). any ideas of your own? (i'm also wondering when this thread is going to be locked since we are not discussing cultivation too much are we?)

The biggest slice of pie of opium manufacture (i know it comes from a plant) is in Afghanistan. If anyone is to compete they would have to grow hundreds of plants which will nearly always mean failure. No drug baron will grow hundreds of plants in an underground or hidden grow room. It wouldn't be economically insufficient since the power needed to push one plant into maturity is more than how much money you will make off how selling the opium it produces which is very litte.

hrrm. hehe, who cares. if you read the posts (just mine and yours paying attention to the RE:'s) i thought we were debating why pot seeds are illegal concerning THC content and poppies weren't despite alkaloid content. i made the point that pot is a high-profile drug that they ARE out to get so therefore it would stand to reason that the seeds are illegal. you DID ask why the poppies are not illegal despite alkaloid content. i was explaining why. you seemed to imply that possibly there were large operations of poppy production going on and nobody knew about it. then i stated that that couldn't be or somebody would a got busted by now. then you turned around agreed that the poppies aren't illegal cuz the government doesn't really care about those (yet). so then we were in agreement. ethnojimmy tossed in a sidetrack about salvia having a fairly low profile (despite being advertised in freaking men's health and other MAJOR publications) yet being attacked legally and i wanted to hear his thoughts on that. sooo, EJ... :smile: it's all just some convo, really, unless I'M SCREAMING i ain't sweating any of anything, people seem to read me wrong alot round here. The problem with this argument is there is alot of misinformation in how substances are controled.

First of all there are only if I remember right five plants and one species of mushroom that are illegal. Every other plant is NOT illegal. so I guess lets start at the begining.

First of all poppies ARE illegal, (One species of them that is, the rest also produce opium and are perfectly legal) however the wording of the laws is very hazy and this has led to the basic rule that they are legal if they aren't used for anything illegal. SO it works like this, cop see's poppies in your backyard and finds a book on opium, your busted. Cop finds poppies in your yard and no drugs or drug related items, not illegal. Since its hard to inforce such a hazy law its generaly safe to say that they're legal BUT don't get caught extracting opium.

As for most other plants (such as salvia) The goverment IS NOT making salvia divinorum illegal, they making salvinorum A a controled substance. So savlia wont be illegal, just a small part of it without proper permision from the drug eforcment agencie.

Spores aren't illegal because only the mushroom is illegal and contains a controlled substance. The spores do not and therefore do not fall into the catigory of a controlled substance. They probly wont be made illegal for many years simply because the gov really only steps in when people are making alot of (un-taxed) cash. When shrooms start making drug deals rich guys then they'll crack down on it more. As it stands they can bust you for the finished product already and so show they are making a real good fight in the war on drugs. The gov doesn't have a problem with you becoming a dealer aslong as they get to bust you later hehehe

Now how things with salvia will pan out remains to be seen. There are many plants that contain a controlled substance that are not illegal to poses, such as poppies and all cacti save peyote (specifically illegal without religiouse excemption) These are considered ornamental and there for the goverment can't really bust grandma for growing something in her garden. Salvinorin a could be made a controlled substance and yet you could still order it from a ornamental mail order company such as richters (note: Richters does sell salvia and is one of the worlds biggest mail order plant companies) Since it is in many flower and herb catiloges already this is a posability. Wether it will go the way of the poppie or not remains to be seen and its just much better if salvinorin A never becomes controlled at all. Just because its illegal doesn't mean its illegal, you just have to learn the gray areas and don't cross the lines.

SO while this is a VERY simplified lesson on drug law ( I mean REALLY simplified, do some digging if you want to learn more, it may save you some day.

There are very small trace amounts of thc in seeds. This is why the legality of them is kinda odd. It is illegal to be in possesion of anything containing thc as thc is illegal but thats not a sure thing either. Fucking Goverment Swine piss me off. They made the laws that way so they could fuck over anyone they want but they don't have to press charges about it if they don't want

exactly. i don't know where people get the idea that it is legal to grow papaver somniferum in the us. it isn't. opium poppies are a schedule 2 controlled substance along with the likes of coca leaves and cocaine. i guess people get the idea that "old ladies" grow them so they are legal. i wonder who these "old ladies" are and where they live.

I didn't say it wasn't recognized throughout different publications as being a plant with psychoactive properties. My point had been that you don't read about people going out in public, getting high on Salvia, and then causing a big scene. It's pretty low key and for good reasons. In the same respect, you generally don't hear about huge opiate operations either.
As far as my thoughts on Salvia being thrown in front of the government to decide if it should be a regulated substance, I think that's ridiculous. It's a beautiful plant that has been used not only for spiritual purposes and the like, but also as a plant that is not too uncommon in a lot of flower and herb gardens. There's an AgWay about 2 hours from my house that has Sal D seeds for $1.69 a packet. A very good friend of mine found them and bought about ten packs about 2 months ago. Can you imagine how many people in this general area are probably growing those seeds out right now? And I haven't seen them at my local Agway, but if that other one has them, I'm sure it's not too uncommon. If it became an scheduled drug, all those people would be guilty of manufacturing of a dangerous drug, and they'd probably have absolutely no clue why.
I didn't prepare a debate for the day, I don't really care to. My personal thoughts are that plants, all plants, have an indescribable beauty and power...and to say that we cannot grow what 'God' (whatever you want to call him/her/it/luck) has put on earth for its beauty and essence or just because it's there, is fucking asinine.

That's not Salvia divinorum. You can't grow Salvia d. from seeds.

There are a bunch of other salvia species, both edible, and decorative. That must be what you're thinking of.

you can grow salvia d from seeds. but seeds are rare what you buy in a local store is NOT salvia divinorum.

if so, you could be selling them for a LOT more than you're paying. i'd still wager all my money and my house that they are not salvia divinorum seeds. there are lots of other salvias that you can easily buy seeds for but salvia divinorum seeds are so rare as to be practically unavailable.

here's a test: try to find just one place on the internet that has salvia divinorum seeds available. if they are as easy to find as you say, that should be no problem at all.

As I understand it, you need a PhD in Mycology to even apply for that particular permit (I have a friend who is aspiring to that very goal). I doubt the spore vendors here have that sort of qualification.

My guess is that most vendors have a 'friend' who grows and they get their spores that way. Either that or they're ordered from a country where it is legal.

if you found packets of seeds labeled "salvia divinorum" for sale at anything like that price, they are 100% guaranteed mislabeled, intentionally or unintentionally. maybe they mislabeled a different salvia as divinorum. but, imho there is 0 chance they are salvia divinorum.

if sagewisdom.org can't get them, neither can agway.

Yes like how morning glory seeds and hbw are legal and easily obtained. The law is broken when a person tries to extract LSA or posesses large amounts of the seeds and documentation on how to obtained said schedualed substance.

Salvia D DOES in fact produce seeds. HOWEVER they are about as rare as seeing a herd of musk ox in time square. And even asuming that what you say is true and you can buy them at a store near you, they have a dismal germination rate and you'd be lucky to get even a few plants from the entire stores supply.

There are MANY other plants that fall into the family salvia, most are kitchen spices and are probly what you have found. If what you say is true though, don't waste your money. Order a few live plants from richters at I beleive 12 bucks a plant, your better off and even though it may seem otherwise, its much cheaper then buying the 20 packs or so you'd need to get even one plant.
