So when a cop asks to search your car, and you envoke your rights and deny him.....

How do you get around the k-9 search?
he will inevitably detain you or your car, make you wait for the k-9 and then regardless of if the dog smells anything, make him alert, then search the car anyway.
how the F do you get around this?
basically are you screwed at this point?

Ive refused search a couple times, and every time they just let me go without a k-9 search. I didnt have any drugs on me any of the times, so a k-9 search wouldn't matter.
If you do have drugs, then spend the night in jail and get a lawyer in the morning, right?

if they actually bring the canine unit, yes you are probably fucked.
this happens in little bumfuck towns a lot.
ive also heard a few stories of the cops saying the k9 is on the way when they are actually just bluffing to try and get consent and the "victim" just has to wait it out.

Carry drugs that have no odor.
Do not store your odorous drugs near odorless drugs.

They don't always bring a k9 if you decline the search.
Sometimes the k9 is not available. If you have to wait too long for the k9, you get off.
Sometimes they can't find the drugs even when they are using a k9. Sometimes the dog is tired and/or not in the mood to find drugs. They can't sniff the engine compartment very well, and its hard to get a dog to tell you where the drugs are with all those hoses and components in there. A fake vaccuum line full of weed would be extremely difficult to locate if it looks like it belongs there.
Some people spray pot tincture all over the car so everything smells like weed to a k9. Others dissolve a gram of coke in water and spray that under the seats, around the trunk, etc.
Having a cat in the car is rumored to make k9 searches ineffective.

Sounds like a really stupid idea to me. Once that dog alerts on the car they can tear that fucker to pieces and leave you on the road with no tools. Once they have that probable cause they can detain you as long as they like.
I had a cop tell me before that he's taken people's seats out and left them on the side of the road, in the rain, with no tools after they consented to a search.
Having a dog or cat in the car seems like a good idea to me though. Barry Cooper advises hiding drugs in or under food items. That way it looks like the dog is just interested in the food.
Anyhow, remember that the dog just walks around the car, they don't get to go in the car unless they alert. But like it was mentioned the cops will just make the dog alert if they really want to search.
Your best bet is probably the time it takes for the dog to get there. Ask for your ticket so you can be on your way. It only takes perhaps 10-15 minutes to write a ticket, if they detain you longer it becomes an illegal search. That clock doesn't start until they start writing the ticket, so ask for it right away. Say "I don't have time to converse with you officer, please issue any citations necessary and release me." Same with the search "I don't have time for a search, please issue any citations necessary and release me."
They'll probably try telling you it will go faster or they'll just give you a warning if you let them search. Just tell them that "even a quick search will take longer than writing the ticket and I'd rather pay the fine and be on my way."

how long do they have to detain you and/or stop you on the side of the road?
when are you legally permitted to leave the scene?
if they ask you for a search and you deny, and you ask them if they are detaining you, can you just leave? or do you still have to stay?

> how long do they have to detain you and/or stop you on the side of the road?
Depends on where you live and what judge you get. If the judge thinks it was reasonable that it took that long to issue you the citation then it will stick, if not then it should get thrown out.
It also depends on what excuses they can use... radio trouble, time to run your plates, name, insurance, etc..
> when are you legally permitted to leave the scene?
When they tell you you're free to go.
> if they ask you for a search and you deny, and you ask them if they are detaining you, can you just leave?
They will tell you that they are detaining you. If they say they are not detaining you then you can go.

I wish I lived in one of those places where people have the rights that you all speak of. They've been running a fucking gestapo here for generations. They just tell you your car smells like weed rather it does or not and their bringing in the dog. Usually a K9 unit isn't too far away. The judges usually have the cops back and the law really doesn't matter if they want you.

I've heard this as well, and have wondered if this is due to the cat being a distraction to the K9, or maybe if this is the case if having cat dander, (or maybe even a litter box), in the car might be legally useful against a K9 search.
If the cops are employing K9 units for law enforcement, (smelling/detecting drugs, bombs, ect.), I wonder if animal cruelty charges of some sort would stick from some traffickeer telling the judge, "Yeah, I keep that cat in the car all the time to mess with the drug dogs".
And most importantly, if "cheesing" doesn't become too much of an issue first, does this lead to the prohibition of cats?

I think putting your dog in harms way the way they do should qualify as animal cruelty. Why don't those assholes at PETA do some crazy shit over that? Until they do we'll have to rely on poisoned bacon.

ok- seriously - bringing a dog - specially a " watch dog" breed - CAN AND WILL help get you away from this issue!!! - Note - a officer CAN DO ANYTHING THEY WANT AND GET AWAY- OR FRAME YOU_OR SET YOU UP- they are trained on techniques to get their way if they want to -
Firstoff - say its a normal traffic violation - the cop wil give you your signed ticket back and first act nice as shit and tell you how to drop the fines n points n court with a cheap lawyer - then round here they go " oh one more thing before i go - this may seem silly but i gotta ask if you have any guns drugs bombs or other contraband on ya or in your vehicle?" - - -you say "no" - - - then they say " well then is it ok for me to search and check myself?" - - This is where you gotta say - NO THANKYOU OFFICER - I AM ACTUALLY QUITE OFFENDED BY WHAT YOU JUST ASKED - AND IM OBVIOUSLY IN A RUSH TO GET HOME....I WOULD RATHER B ON MY WAY AND INVOKE ALL MY CONSTITUTIONAL RIGHTS UNDER THE UNITED STATES OF AMERICA (( You need to also be holding a "invocation of rights card" - - - - - - Doing this while having a wild ass dog sitting shotgun is sure to make that officer walk away pissed If they still for some reason keep buggin you - tell em your afraid of your dog getting loose on the side of the road or accidentally biting someone and your very uncomfortable with the whole "unnecessary situation" - -- if they proceed you were fucked from the start - - -- Hope your talking with the cop who hates paperwork ya kno And- i never thought or heard of the cat thing - i now would say have a cat and a rottweiler or pittbull - or other intimidating breed Good thread - love discussions like this

What about spraying bear piss or something all over your car? What animal piss scares off dogs the most ?

Deer and fox urine works fantastic. When or if you are pulled out of the vehicle, pour the vial of urine somewhere you know the dog will run by, also outside of the police camera view. The dog will be very, VERY focused on that smell he ran across and will not be able to concentrate on hitting for the drugs he's trained to find. He may even direct his handler back to the same spot where the urine was spilled, and subsequently its possible the officer may ask you to move your vehicle to a new location where the K9 can work more effectively (if they're smart, and they're not.)
Think of it this way - as humans, we naturally eat, just as dogs naturally smell, and if we eat something delicious but are also trained and used to eating - say, mcdonalds - we're going to focus on the delicious stuff.

Probably the last thing you want is the drug dog going crazy anywhere near your car. The handler will just say he's alerted on your car and proceed to search.
Something that scares him is probably your best bet, like wolf urine.
Myth busters did a show on guard dogs. I don't think the wolf urine worked. Nothing much seemed to work except food and bitch in heat urine. The food only worked half-assed since the dogs are usually well fed. The bitch urine worked like a charm though. The dog would not break away from the bitch urine the entire time the safe he was supposed to be guarding was being robbed by a guy in the attack training suit.
But I don't see how this would work. If the dog keeps going at your tire or trunk or whatever they're just going to say he's alerting on your car.

I've never heard of them doing this. Once you get the ticket they have no reason to detain you. They almost always ask the question right off or right after they tell you why they stopped you.
If I already had my ticket and they asked I'd just say "No thanks!" and drive off. They wouldn't have probable cause to stop me a 2nd time and if they did I'd get off.
