The Kentucky General Assembly has adopted legislation outlawing a synthetic form of marijuana called K2 while also broadening penalties for drunken driving offenses.
House Bill 265, which passed in the House 79-15 on Thursday, addresses concerns about the availability of a powerful substance to children and others, said Rep. John Tilley, D-Hopkinsville.
Tilley and Rep. Myron Dossett, R-Pembroke, co-sponsored a similar measure aimed at stopping the sale of K2 in businesses such as convenience markets and adult novelty stores. Police in Oak Grove and Hopkinsville raised concerns about K2 after a Fort Campbell soldier was charged with breaking into an Oak Grove business and accused of stealing 25 packages of K2.
The bill that eventually won approval makes it a misdemeanor crime to possess, traffic or produce synthetic marijuana, according to the Legislative Research Commission. It also outlaws piperazine pills, which are made from substances commonly used to treat roundworm and pinworms. The pills are described as having an effect on users that is similar to the use of the drug ecstasy.
HB 265 also allows police to charge a driver with DUI for the use of illegal drugs or certain prescription drugs not prescribed to the driver.
“The bill would also make it easier to prosecute DUI offenders who hurt or kill someone in a car wreck while driving intoxicated by lowering the blood alcohol level required to prosecute someone under the state’s aggravated DUI law from 0.18 to 0.15,” the LRC noted in a legislative update.
Section of the bill related to synthetic marijuana and piperazines would take effect immediately after the bill becomes law with the governor’s signature. Other provisions in the bill related to DUI would take effect later this summer.
“One of the flaws in the previous DUI law is that, unlike with alcohol, it was extremely difficult to prove a driver was impaired even if it could be proven they were taking drugs illegally,” Tilley said. “This legislation should dramatically reduce the number of people willing to get behind the wheel when that is the last thing they should be doing. Just as importantly, it will also better equip law enforcement to take on the steep increase we have seen in drug abuse in recent years. It has unfortunately become a true epidemic.”
Tilley and Dossett voted in favor of the bill. Rep. Brent Yonts, D-Greenville, opposed it.

I work about 2 miles from the store that got robbed. These people are racking in sales of around 6 to 10000 per day on this substance and its mainly going to the military guys.
Im just happy there is no mention of jwh at all in any of the articles. And hopefully the bill will only regulate k2 and other herbal mixes leaving the active compound alone.

Man oh man.... The noose tightens. .15 orrrr .08 is like after using Listerine mouthwash. I just am sooo lost at the movement to legalize k2 whilst plants like jimson remain unfettered. God forbid your kiddos burning dried lavender and clematis, i would much rather have em running around on dissociative not knowing what the fuck is going on and being hit by busses. bLEEp

I haven't read the text of the law but I am almost certain that it works by banning jwh-018 and several other popular synthetic cannabinoids. They would do a solvent wash, GC/MS that, and see if they have any peaks that indicate that there are controlled substances present. Just like every other drug bust in the US for the past 30 years.

Correct. But there are a few common ones that almost all of them use.
And hundreds of less common ones that are not tested for.

In Louisville, KY every hood gas station and convenience store I've been in recently has synthetic cannabinoid-laced "potpourri for sale by the gram bag." It seems to be widespread. However, people getting stoned just doesn't seem to cause much violence outside of the money being made by traffickers.
