friend got busted. his chick facebooked me:
her: Joey just called me and said he's going to jail. Apparently, he got pulled over with over an ounce or something. He didn't give me all the details but he said they want him to snitch and he's not. Which is fine, but do you know anything about possession with intent to distribute? That's what he's going to be charged with...Thanks.
me:hmmm, ya i know that over an oz is a felony. and if he had scales and/or baggies with it that's where the intent to distribute comes from. but if he had a couple ounces in a bag and nothing else but maybe some roches or something like that he could prob get an atty to argue that it was all personal and get the intent dropped but he'll still have a felony charge of possession no matter what. that reaaaaally sucks to hear tho man, whats his bond? or can he bond out at all? if i can do anything else to help out lemme know. and if u wanna try to ask some people who know a little more about it than me try looking at http://www.growery.org/forums/search.php u can make a post askin what he should do or maybe someone else in IN has been thru the same thing and they can tell u how to handle it best. other than that, definitely get an attorney. thats all i can really think of right now. if i think of anything else ill let ya know or if u have any more q's hit me up. her:Hey Josh, thanks so much. I do appreciate it. I'm not exactly sure what happened and he didn't go into detail. He said he got caught with it, then he said they were wanting to use him as a snitch and he won't do that. I understand the snitch part, if he does it once, I'm sure they'll want him to keep doing it and then he'll just end up in jail anyway. So, I don't know where he got it or who he's been with. I haven't seen or talked to him in months. He's just been in his own little world and surrounding himself with questionable people. I'm not sure what he's going to do, but I just wanted to find out for the sake of our daughter. I don't know Josh, I want to be there for him but it's like all I do is piss him off. I mean, he threatened to kill me in front of our daughter and my mom was here and he told her he was gonna bust me in my face. I know you probably don't want to hear all this and I'm sorry but I think your the only person who truly like knows both of us...It's weird, he's not the same person. I just want him to get his head on straight and fly right. I'm doing the best I can for my daughter and I never thought this was a path he would take. I'm not saying he's doomed forever but this could seriously fuck up his future. I don't understand he's a smart person, I just feel like he should know better and should want more for his daughter than a dad who can't stay out of jail. This is the second time in less than 6 months. He disappears, doesn't call his daughter or try to see her for months, out of all he things he is...I never thought deadbeat dad would be one of them. Sorry again, I just needed to vent. I'll check out that website and find out what I can. I don't know who I'll get ahold of him but I'll try calling the jail. Thanks again. It's much appreciated. I didn't even know where to start.
any better advice for her bf's legal situation?

Looks like the cutoff is 30 grams.
More than 30g can be a misdemeanor or felony with a peanalty of 6 months - 3 years and/or $10,000 in fines.
Possession, sale or distribution conviction also causes driver's license suspension for 6 months to 2 years.
So it's hardly a major charge. It's also likely it will be a misdemeanor and he won't do more than a month in jail.

One month in jail? 10'000$ fine? For a small bag of weed…?
The more I get to know the States and your laws, the more I am happy not to live there…
Sorry for the non-constructive post, I am just shocked by the grotesque disproportion between a so-called "crime" and its consequences.

Small amounts of weed is usually just considered a misdemeanor. A misdemeanor in most states is just defined as having a max of 1 year and some max fine.
If you look up my state laws that's what you'll see. The actual penalty that the judge in my area always hands out is a $680 fine with no jail.
So what you see listed on the NORML pages is usually the maximum penalty, not what people generally get.
But yeah, the laws are pretty fucked up.
