The merchandise came to you by mistake. It wasn't mailed to you as a gift or a free sample. Nor was it mailed to you with the intention of getting you to pay for it.

Don't be an ass. Send it back. Not this summer. It should go now. All one of your friends needs to do is write "return to sender" on the box and leave it at the post office.

Do the right thing. It's sad you ever thought of doing otherwise.

Let me clarify the situation. I made it simpler above, but in reality it is a bit more complicated. I'm studying in college and this year I'm studying abroad and am currently not in the United States. The package arrived to my dorm address in the U.S. and hence to everyone suggesting I get in touch with the girl and even meet up with her so she can smoke me out among other things, that's not really possible since I'm abroad.

If you are abroad, and the package is in the US..... how did you (as stated in your first post) open it?

Nonsense. Why people believe that wives tale is a mystery to me.

If a company deliberately sends you something you didn't order, that's one thing. Notice the word "deliberately"?

However:
"The mistaken delivery of property to an individual who realizes the
mistake and simultaneously forms the intent to steal the property at
the moment of receipt constitutes larceny at common law. W. LaFave &
A. Scott, 2 Substantive Criminal Law ยง 8.2(g) at 342-43 (1986).
Furthermore, where the individual does not realize the mistake at the
time of receipt but realizes it later and then forms the requisite
intent, there is a larceny as well."
http://www.armfor.uscourts.gov/opinions/1996Term/96-1167.htm

There are many similar state laws as well:

TITLE LXII
CRIMINAL CODE
CHAPTER 637
THEFT
Section 637:3
637:3 Theft by Unauthorized Taking or Transfer. โ€“
    I. A person commits theft if he obtains or exercises unauthorized control over the property of another with a purpose to deprive him thereof.
II. As used in this section and RSA 637:4 and 5, ""obtain or exercise unauthorized control'' includes but is not necessarily limited to conduct heretofore defined or known as common law larceny by trespassory taking, larceny by conversion, larceny by bailee, and embezzlement.

Source. 1971, 518:1, eff. Nov. 1, 1973.

It's sad people believe they have the right to keep something in this situation. It's even sadder they don't do the right thing and send it back.

It was a mistake for fucks sake.

You are under no obligation to pay for shipping, but you need to let the company know.

I stand corrected then.

This is titusxii. I never opened the package. I had my college friend pick it up from our dorm's mail room since he is on campus and I'm abroad. My friend has the package now.

I'm not a puppet on purpose. I just haven't posted on this site in months and forgot my username, which didn't show up even when I did an email search. It's not a direct contradiction. I clarified that the situation I posed in my first post was simplified and that since I am out of the country, I have not opened the package myself but had a friend do it.

'No, my "titusxii account was banned a little while ago for being a puppet (does this mean two usernames using the same email?). When banned, they told me what my old username was, so now I'm using it instead. Aser, what is your opinion on my situation? What would you do in my shoes?

Well, I probably wouldn't have told everybody about it in the first place. It also depends on how good of a vaporizer it is.

If it was a really nice one and I had received good service from the company in the past I would probably return it or at least contact the company and ask them what to do about it.

If it was a cheaper one or the company had been jerks to me in the past, I might consider keeping it.

I guess it would come down to my viewing of the company that sent it. If I hated them, I would keep it. If I enjoyed their service and prices I would report it to them and see where it went from there.

Who knows? They might let you keep it or send you something in return or give you a discount on something.

Ethically? No!

Legally? No! Your name isn't Sarah Wilson and you cannot open mail not addressed to you.

Do the right thing and track her down. I'm sure you can get some weed out of it.

Aser is correct. The package was addressed to me. It was only upon opening the package that I realized it was intended to be delivered to a different person. Plus I'm out of the country. Even if I was in the U.S. and could track her down, I'm not sure if I would want to. Sure I would have her meet me so that I could give her the package, but that's about it. Sounds a little sketchy to do anything more than that with a stranger (unless she is a total babe...)

Once I ordered an expensive essential oil diffuser for about $130.  They accidentally shipped me two.

I thought I have no need for two, perhaps if I send it back they'll give me a free accessory or something.  The only free thing I got was the postage to send it back.  Not even a 10% discount on their shit.

Keep it.

Contact the company and explain the situation. See what solution they come up with.

I'm surprised so many people are telling you to send it back.  It's not your job to be their shipping department or handle their mistakes.

Contact the company and tell them what happened.  Tell them you're a busy man and if they want to make an appointment to pick it up in person you'll be happy to do so as long as they compensate you for your time.

It's pretty doubtfull that they'll show up in person to pick up the package.  If they want you to mail it back tell them you're too busy to be their packing boy.

Well I'm abroad so I haven't done anything yet, been too busy with school to contact the company. I'm surprised as well that so many people told me to send it back. It's especially a pain for me to return it since I'm abroad and therefore have to get my friends to do it, which I don't want to do since it takes up their time... In any case, the package is with my friends now. It's unopened and so still obviously returnable in case something comes up.
