friend of mine got popped - question about recording false statements

friend of mine recently got a felony POCS for having hash in texas... im not even sure if thats a legit charge but thats not what i wanted to post about.

he and some friends got pulled over new years eve, all pretty wasted including the driver. driver got a DWI, everyone got a PI. but the shitty part is my friend and his accomplices did the right thing and chose to plead the 5th to all the cops questions involving the hash, yet in the police report the cops recorded that my friends companions all squealed and stuck the hash on him. The police report also states that he admitted the hash was in his possesion. He told me his interrogation took place in the back of a police cruiser. Assuming the cop didnt pull a crooked move and turn off the in car microphone, would it be possible to dismiss the case based on the false confessions?

another question:
also if anyone knows about the legal penalties of possesion of hash in texas that would be helpful.

this all took place in williamson county, just north of austin. I advise anyone to keep the fuck away from this place if you arent a middle aged clean suburbanite.

thats harsh man.  you know how shit goes in pig country though, even if the tapes were available to help discredit the officers report, they would probably just disappear or something. the "justice system" in alot of places seems to sustain itself by any means necessary

I didn't realize that police cars have microphones in them that record all the time.

im not sure they do. I know the video cameras have microphones that record whats going on in the immediate vicinity of the car.

The camera usually comes on when they make a stop.  They either turn it on manually or some of them come on with the lights/siren.  And they usually do have a microphones that pick up outside and inside noise.

To the OP if you can prove the cops are liars then all the prosecution has against you is the testimony of a proven liar.  They won't take that to court and I wouldn't take a deal in that situation either.

What you need to do is go to the local cop shop and file a FOIA for the video/audio.  Just request all video and audio related to case # XXX or the stop of XXX vehicle on 12/31/09.  You won't get this in discovery since they won't be trying to use this if it goes against them.

I would do this ASAP before it gets "lost".

yeah thats what i suspected. I told him to get a good lawyer. The sad fact is in this county the police can get away  with almost anything they want. The only exception to their abuse of power is their apparent stupidity.

He fucked up. common sense tells you not to be ridin like that around here with everyone barred out NYE.
we'll see what happens.

Might as well file your own FOIA.  The lawyer will probably bill you at least an hour ($100+) for filling it out when you could do it yourself for free.

Besides the real video will let you know if you even need a lawyer or if it's a waste of money.
