help me beat traffic court!

here's the deal- i was riding my motorcycle and came up to a stop sign, i slowed down and stopped for a second, rolled forward for another second while still balanced on my bike, looked both ways, then went through the stop sign; then what do you know, a cop stops me. he stated that he didn't see me take my foot off the pegs, so therefore i didn't stop. well, i have to say that i stayed behind the stop sign for at least 2 seconds, and never executed a dangerous maneuver, so i think i'm in the right.

my plan of action is to have a trial by written declaration, and barring that, a trial de novo in which case i'll probably just state what i stated here. another angle i could use is that the cop only saw me from one side, and that i could've planted my other foot down while stopped.

have any suggestions as to what i should say in my written declaration?

I don't have any tips to answer your actual question, but I do have a tip about traffic court.

My advice is simply to actually go to court. I've taken three different tickets to court and the officers didn't show for any of them, so I was dismissed of charges.

Who knows how often it happens, but often enough to make it worth the effort.

My only other advice is to bring pictures of the intersection to court (preferably from the officer's point of view), as well as a video of the method you used to stop on that day. The more honest effort you put forth, the more likely they are to believe your story has some merit. It ought to at least get you a reduction.

Pay the ticket and get it over with. Sounds like you weren't 'truly' stopped anyway.

and who the fuck cares if you actually stop, the main point is to execute manuevers safely. say you're stopped at a red light and have been waiting for 10 minutes and there's no one around, you gonna wait some more? fuck that, if i can safely cross i'm doing it.

furthermore, being in the state of california, our state budget is in the fucking shitter, and you can tell they're hurting by the amount of cops who're trolling the streets to write as many tickets as possible.

lastly, i did stop, i just stopped (completely) for a second and used the leftover momentum to roll for another half a foot up to the line before passing.

well, the cop said he would see me in court. but that's essentially what i'm doing anyway. if the case doesn't get thrown out by written declaration then i'm going to court. this gives me 2 chances to beat the ticket, as well as burden them some more.

I'm pretty sure they use a pile of burning written declarations to light the spliffs they stole off teenagers they arrested.

In other words, they have no reason to pretend to care about what a person says, especially in a letter. IMO the only time you can get off of a ticket is when the cop doesn't show, because what they say is law whether it's true or not.

Definitely take it to court tho. Whatever the copper said, there is still a good chance he is not going to show. In the amount of time he'd spend dealing with your ticket he could ruin ten other peoples lives; I don't think any pig would give that up.

lol dude, you're not getting it.

a trial by written declaration is a trial- that means i present my case, and the prosecutor presents his; the judge decides the outcome, that's one (1) trial. if the judge decides on a guilty charge, i can petition for a second (2) trial, in which i'll have to show up in court and personally plea my case. in this case i get 2 separate trials, as opposed to one if i just show up in court and plea my case. and in addition a written declaration requires that a cop writes his argument lol, instead of having to show up in court and just say "blah blah blah".

Stopped = at rest = zero momentum. By definition, if you have momentum you are moving, not stopped.

sorry, you're not a judge. i already explained how i stopped.

furthermore, just because you stop doesn't mean you don't have leftover momentum, it really depends on a number of factors.

Because there's leftover momentum and you haven't stopped.
The center of mass of the system is moving relative to the local frame, if you really want to get fancy.

But the judge isn't going to say it like that, I'm curious to know how he'll phrase it. (Or how she'll phrase it.)
