Man pleads guilty to giving mushrooms to friend

The Associated Press

A young man has pleaded guilty to supplying hallucinogenic mushrooms that led to the death of a Paducah teenager as he tried to enter the wrong house.

The Paducah Sun reported 20-year-old Taylor Thompson pleaded guilty Wednesday to trafficking in a controlled substance, marijuana possession and having drug paraphernalia.

Taylor told police he brought mushrooms to a party in July, ate some himself and gave some to other people.

One of those was 18-year-old Caleb Barnett, who later broke into a neighbor's home, thinking it was his own. The homeowner fatally shot him. Barnett died in surgery at Baptist West Hospital on July 30.

Circuit Judge Craig Clymer will sentence Thompson Feb. 3. The prosecutor has recommended 2 1/2 years.

Hopefully he didnt get anything, as he was just defending his home against an invasion.  The kid shouldnt have broke into a home that wasnt his.  When one is defending their family they dont have time to aske "hey kid, did you take some dope you cant handle?"

I would have shot him too.  My sons life is worth more than someone who broke into my house.

Yeah Death is a pretty harsh sentence considering he could have shot him in the leg.I mean there has got to be more to the story than that.Did the kid have a weapon of some kind and making threats to this so called neighbor. And if this is the neighbor you would think he would recognize your fucking neighbor man.I mean WTF man! There has got to be more than that to this story!

No, they dont.  Its called a Castle Doctrine.  It gives a homeowner the right to shoot an intruder.  If you walk outside your door, or soot through a door, you just committed murder, unless you are attacked outside with no way to escape.

Its awful hard to know someones age and who they are when they break in in the dark.

Its sad, really, but the homeowner did nothing wrong.  Had he shot him in the leg he could have gotten himself sued in civil court.  Not only that, you dont know someones intention, you wouldnt want to shoot a murderer in the leg and give him time to use his own weapon.

Thank you for clearing that up for him. I will say I'ld shoot any fucker that broke into my house. If you are in the situation you are supposed to give a verbal warning that you are armed and will defend your home unless the intruder leaves then it's on. I do feel bad for the kid, but when you take any kind of drug that is your responsability. The kid that had them at the party isn't at fault even though the law may disagree.

Let this be a lesson, you are responsible for any friend you give mushrooms to.Hopefully they don't freak out.
I had a friend freak out and he said he was going to call the cops because he couldn't breath.
I learned at that point that i would never supply my friends with them again.

I wont debate guns here, because it isnt the appropriate place.  I will say one thing though, our freedom was acquired with guns, its been upheld with guns, and will remain secure because of guns.  Anyone that doesnt believe in personal rights to firearms should go ahead and move to canada, do the rest of us a favor.

Wow what terrible situation.  I don't believe anyone is at fault, except for the guy who died. He should of made better decisions, like not consuming an illegal substance and breaking into someones home.

I would of shot the guy too.  And no not in the leg.  In my opinion if I am going to fire a weapon at a living organism, it will always be a kill shot.  Luckly I've never had to fire a wepon at a living orginism.

This is just a bummer story all around. The guy didn't force the mushrooms on anyone and I believe the user is ultimately responsible. It is usually with bad results when I see people abuse alcohol and psychedelics.

Usually DUIs never return to their place or origin but in all honesty I rarely see stores getting held responsible for their alcohol sales. Shit the liquor store down the street will keep selling the local woods bum alcohol until he doesn't return ie passed out in my backyard.

Alan put it best

There are exceptions to this.
Some guy in Texas got away with shooting and killing someone who was breaking into a NEIGHBOR's house while he was away!
The burglar never even stepped foot on the shooters property. I think the law varies by state.

I always thought this would be a good way to kill someone.
Invite them over to your house, shoot them when they walk in the door and just tell the cops they were breaking in! :awesome:

I talked to a sheriff once that said if someone invades your home and you decide to use a gun on them - kill them. True, you could be sued by the family members, but seeing as they were not at the scene of the crime then they would almost certainly lose their case.

Here is what was posted in the original article.
http://www.shroomery.org/forums/showflat.php/Number/10769682#10769682

http://www.wpsdlocal6.com/news/local/story/Sheriff-Jon-Hayden-Holds-News-Conference-On-Early/4_QoLm1kR066Lb17M0O99g.cspx

Friday morning at 1:46AM a burglary in progress was called in to 911.  The call was made from 12505 Logan Lane which is located in the McCracken County part of Kevil, KY.

The homeowner, his wife and two small children ages 2 and 3 were asleep in the home. Their burglar alarm sounded, waking the residents of the home. The male adult homeowner went and retrieved a 9mm handgun from inside the home. He then went to the alarm control panel to see what the location of the alarm activation was. It indicated a door to the detached garage. He then went out side through a back door and noticed that a side entrance door into the garage had been kicked opened. He the yelled that he had a gun, and for the person out there to get off of his property.

He at this same approximate time overheard his wife screaming inside the house. He ran back into the  home where he learned from his wife that the burglar was inside their attached garage attempting to gain entry into the home through a wooden door that had a window. He then yelled numerous times at the intruder that he had a gun, not to come into his house. The intruder continued kicking and striking the door to make entry. Once kicking the door open, the intruder stepped up into the residence (an entrance foyer). The homeowner stepped back several steps ordering the intruder to get out of his house or he would shoot him, at which time the intruder continued making forward advances towards the homeowner. The homeowner then fired one shot at the intruder with a 9mm semi-automatic handgun, striking him in the arm. The bullet went through the intruders arm and into his chest area. The intruder after falling into the floor, got back up and starting fighting the homeowner, at one point biting him on the arm. The intruder, according to the victims, appeared to be extremely under the influence of something. The intruder, while continuing to fight and struggle with the homeowner, called him "DAD" numerous times. The homeowner was able to manage to force him out of the front door of the home at one point, but he managed to gain entry back into the home through the front door again. The struggle continued throughout the home and back out into the attached garage. The intruder managed to get into a vehicle that was parked in the attached garage that still had the owners' keys in the ignition. The homeowner realized that he had another firearm in that vehicle and lunged into the car in attempt to gain control of the weapon. Another severe struggle ensued inside the car and the homeowner was able to pull the suspect back out of the car. The two continued to fight which led out into the driveway at which time the first McCracken Co. Deputy Sheriff (Dep. Dwayne Pickett) arrived (Time 1:54AM). Dep. Pickett, after also having to struggle with the suspect, was able to get him handcuffed. As additional sheriff's deputies, West McCracken Fire personnel, and Mercy Regional  Ambulance personnel arrived, the suspect continued to fight with them as they attempted to stabilize him. A Deputy with the Ballard County Sheriff's Department also responded. The suspect appeared to be manifestly under the influence of some type of drug. He also was wearing no shoes.

The intruder was transported to Western Baptist Hospital where he later died at about 6:00AM in surgery from injuries we suspect are related to the gunshot.

Soon after our arrival at the residence, we were able to identify the intruder as being 18 year old Andrew Caleb Barnett of 4655 Magruder Village in Kevil. This address is within close proximity to the Logan Lane location.

I, along with other deputies, went to Mr. Barnett's home at around 3:00AM in an attempt to locate and notify his family. We did locate his parents at the home and made arrangements to get them as quickly as possible to Western Baptist Hospital.

Over the next couple of hours, we were able to obtain information pertaining to where 18-year-old Caleb Barnett had been prior to breaking into the home on Logan Lane, a location that he along with several other adult teenagers had been reportedly having a party that involved alcohol, Marijuana, and a Schedule 1 non-narcotic called Psilocybin Mushrooms (street name: MAGIC MUSHROOMS). That location was identified as being 240 Neil Lane which is a mobile home park just west of Logan Lane.

Sheriff's detectives went to the home and at about 7:00AM and found four teenagers at the home along with whiskey, Marijuana, and a various items of drug paraphernalia. They also located the packaging that had in fact contained the "MAGIC MUSHROOMS."

Statements obtained from the teenagers present were all consistent in that they had all in fact been smoking Marijuana and doing "MUSHROOMS" during the early morning hours. They stated that the effects of these MUSHROOMS were overwhelming causing drastic "out of character" actions, and hallucinations. They described the effects experienced by Caleb Barnett to be much worse than the rest that participated.

Detectives there obtained further statements that at around 1:30AM, Caleb left walking (in the general direction of Logan Lane and his home) making the statement that he was going home. Several attempted to stop him trying to get him not to leave due to his condition, but were unsuccessful. Among several items seized from the mobile home, were Caleb Barnett's shoes, and cell phone.

Four adult teenagers were arrested at this mobile home and were transported to the McCracken County Sheriff's Department. They all were later lodged at the McCracken County Regional Jail. Numerous consultations have taken place with McCracken County Commonwealth Attonerys Tim Kaltenbach's Office throughtout the morning.

The reason that drug dealers are responsible for crimes committed by their customers but liquer stores are not is that drugs are illegal.  When you do something illegal and it results in a death, it becomes "constructive manslaughter".

Quote:

Constructive Manslaughter  (from http://en.wikipedia.org/wiki/Manslaughter )

Constructive manslaughter is also referred to as ‘unlawful act’ manslaughter. It is based on the doctrine of constructive malice, whereby the malicious intent inherent in the commission of a crime is considered to apply to the consequences of that crime. It occurs when someone kills, without intent, in the course of committing an unlawful act. The malice involved in the crime is transferred to the killing, resulting in a charge of manslaughter.

For example, if a person throws a brick off a bridge into vehicular traffic below they could be found to intend or be reckless as to assault or criminal damage (see DPP v Newbury[11]). There is no intent to kill, and a resulting death would not be considered murder, but would be considered involuntary manslaughter. The accused's responsibility for causing death is constructed from the fault in committing what might have been a minor criminal act.

Regarding the update that Motaman posted, it sounds like a really unfortunate situation all around.  If someone is really messed up on psychedelics, don't let them roam the streets.  Restrain them by force if necessary.  Also the people at the party should not have answered the door for the police or made any statements.  Due to their ignorance of the law they talked themselves into all sorts of trouble, probably drug distribution and manslaughter charges.

I think the whiskey is just as much at fault as the psilocybin... if not more.

Stories like this gets the DEA's little dicks hard. They and the supporters of the ban love it. Oh yeah the poor kid right. Bullshit, they don't give a fuck. His fuckin' friend should get time! That dumbass shoulda watched his friend better. Probably his first time anyway. He needed a babysitter. This story sucks not just for that rookie, but for everyone who works to get the law overturned. This can happen to any kid that gets stoned and is not used to the effects. Be a good friend, don't let them wander on their own while trippin balls.

Hopefully Kristin is a girl, otherwise I can foresee a guy named Kristin having a horrible time in prison(not that she will get any real prison time, Probation more likely).

1 girl, 5 guys = sausage fest.

Yeah I agree.... Would have never happened in Canada where it is against the law to defend yourself even if your life is in danger.  God forbid if you even pepper spray an intruder your up shit creek.
