Yea, regardless of what happens, I'm not growing for quite a long time, and definitely only legal edibles, and I'm not going to have more than a bag of herb at any given time. Fuck trying to save money buying in bulk if it's going to get me intent to deliver, I can deal with a possession charge.

Well gents, I have court in 2 hours to receive my 'criminal complaint' which I believe is just the police report, and to see what, if anything, they're going to charge me with. The first thing I do when I get back home from there is going to be posting here, so you guys will know what's up in 3-4 hours. Wish me luck.

Ok, well I just got back. They didn't drop shit. They added another pariph count (one for my pipes and bongs and one for the growing equipment) and manufacturing/delivering psilocybin/psilocin <=100g. I don't know what they weighed to get that amount considering there weren't any fruits. I'm still going to try and get the warrant dropped though. My attorney said he doesn't know enough about the case yet to be able to say whether there's a good chance of that or not. I did get the police report of this kids other case, and it seems like every other paragraph has something about him lying in it, so that will probably help at least a little. I doubt I'm going to get off free though. I'll probably end up on probation for a couple years, which will suck, but it's better than going to prison. If for whatever reason they did stick me with the max for everything (obviously highly unlikely) I'd be looking at 29+ years. This is technically my first offense though.
I'm trying to stay positive. I've been writing down all the good things that have come from it. I made a new friend, and I've quit doing drugs so I'm much more productive now, which has also lead to me getting my legit business off the ground. It still sucks that I have to take a breathalizer every day and a piss test twice a week, but there are a lot of people that have it worse. I've also gone from smoking about a half a pack of cigs a day to a little over a pack since I can't smoke herb.
The one thing that brought me the most pleasure though, is knowing for certain the cops pocketed about a half zip of the bud I had.
Anyway, I'll keep you guys updated as shit progresses.

Instinct tells me a certain breed of lawyer could rip this case to shreds but I don't know and good luck. I just had to comment to celebrate some good coming out of it, nice one!

I hope to god you're right. I've been asking him what he thinks will come of this, but he doesn't have enough information yet. I did get the police report from this kid's other incident (the kid who narked me out), and the whole second page is about how he can't come up with answers and his story doesn't add up. Basically, it says he's a fucking liar without saying "he's a fucking liar." It also states in the report that he's been diagnosed with bipolar disorder. I don't know if the police take medical things like that into account when they are asking for a warrant, or if they even are allowed to, but I couldn't imagine they would take someone's word with, say, dementia, as absolute fact. (I'm not saying bipolar disorder is the same as dementia by any stretch of the imagination, but I feel that it should have some bearing on his credibility as a witness.) I know how I view the situation and what actually happened, but I don't know how the court will see it, which is all that really matters. I know I obviously have a bias toward myself, but I still feel that the warrant was fucking ridiculous.

They were looking for a gun and found some mushrooms that were for personal use. It's such a petty offence in the face of what they were looking for, taking the word of someone highly unreliable. It isn't like looking for stolen jewellery and finding a dead body at all. His friend had set him up with a fraudulent call to the police. I doubt this is straightforward.

UPDATE: Went to court again today, for the same BS as last time, only now I have my real lawyer. I go in again next week for what is essentially a probable cause hearing, and they're going to put this kid on the stand. I'm pretty confident anyone can attend this, so I'm thinking everyone he owes money to around town might be interested to hear about where he is going to be. If the kid shows up, which I'm pretty sure he will because he has court for his other incident later that day, I'm pretty confident he'll be fucked up, and if all these people are there, there's a good chance he'll lose it on the stand.
Any thoughts? Good idea? Bad idea?

Pretty funny and not a bad idea. Obviously anybody with an outstanding warrant should probably not visit the court house, just in case. But the rest of them, sure. Have them all sit there and stare at him.

I like the idea! If the warrant was truly unsigned, then there really shouldn't be anything to this case. A warrant has to be signed to be valid, no exceptions, though now it probably has a signature on it, and they'll just claim you missed it. Sending good vibes you way man.

I was thinking this as well. A friend once had his house raided for bullshit his dad was doing on the computer. They were there to seize the computer but also found a bong and a bunch of pot. They had to leave that stuff there because it wasn't what they had a warrant for.
I'm pretty sure someone's going to eventually say this, but I'm 99% certain if they have a warrant and find something illegal it is within their authoritative means to take it & charge for it.

Thanks guys, much appreciated. I go back on Wednesday for the pretrial hearing, so I'll let you know how it goes. I just have to make it clear to all the people going, that they are there for my moral support, not to scare him.

Is that how your lawyer said it works? I'm under the impression that a 'probable cause hearing' is behind closed doors b/w the judge and prosecuting attorney...
I mean, is it really a court room situation, or is it just a board-room style meeting?
Sure, invite the people that don't like him. But perhaps then he'll lie extra good to screw you over. Then point fingers and say "That guy sells weed, he sells ecstacy, etc..."
Good and bad idea...But do what you want and get informed of what the actual situation is like when you'll be going to talk to these folks.

I'm not sure, it sounded to me like it was an open court thing. Maybe not. I'll have to check with him and see what's up.

I'm starting to feel more and more that if they convict me of this shit, I'm going to prison. Anyone know of any cases with similar details and their outcomes?

I would suggest calling up a med mal lawyer and ask them for someone who is reputable in police misconduct. They tend to flock together from what I hear.
