Disclaimer: All references to "mushrooms" or "mushroom growing" refer to legal edible mushrooms.
Not sure if this is the right place for this, so sorry if it's not; I just figured it involves some advice on how to not get caught cultivating so who knows.
Anyway, if you can't tell from the title, I got popped. It blows. I realize I'm not the most well known poster around here, but that's mainly because I wanted to lay low and not get caught. I love growing mushrooms. It was never something I really did just for money; of course it helps being a broke college kid, but it was the love of making something from basically nothing that drove me. I figured if any people would be able to understand that, it would be you guys. They didn't just take some grow op, they took something I loved and ripped it away. It's crazy because I should be thinking more about how I have to go on drug testing and possibly do some time, but all I can think about is how I'll never be able to grow again. If there was one thing I was good at aside from computers, it was growing mushrooms.
It would be ridiculous for me to post this without a story so here goes: Last Friday (the 13th luckily enough) started out just fine. My friend, and old roommate, called me up because his brother, who used to be like family to us, has been acting crazy lately. He wanted to go talk to him to see if we can get him some help. This kid used to be someone I thought I could trust to go to jail, and never rat me out, just because we were close. Anyway, he wasn't there, we waited for a bit he didn't come home, so we dipped. A few minutes later, he calls us freaking out about how a quarter of his bud is missing. We told him we didn't know what happened to it ( which we didn't, we assume it was one of his roommates ) but he said he was coming over to my house anyway. I was like, wtf kid, don't come over here, I'm leaving in a bit. As you can probably guess, he came over anyway. He started banging on my door, which I wasn't planning to answer at first, but then he started yelling about his weed being gone. I went downstairs to tell him to stfu and get out of here because my neighbor has a 10 year old kid, and she probably doesn't want him hearing all that crap. So, he left with this smirk on his face, and I knew something was up. I knew I should have just evacuated everything at that point. About an hour later, I get a call from a cop telling me to come home or there will be dire consequences. That was mistake number 2. Don't answer restricted calls. Ever. Apparently this fucker told the cops I stole $160 cash from him, and when he came over, I stuck a gun in his face. I've never owned a gun. So, the police tell me this, and at that point, they tell me is when I invoked my right to an attorney. So I'm sitting in the back of a cop car thinking, the kid that called me in got out of the psych ward like a month ago, and he was in and out a couple times, there's no way in hell they'll get a warrant to search the house. Well I guess if you say the "G" word to the cops around here, it's all downhill. I though it took days, even weeks, of investigation for police to get a search warrant. Wrong. It takes a 5 minute phone call to a judge. On the search warrant, it said they were looking for a silver 9mm pistol with a black trigger frame. Guess what they definitely did not find.
They took everything. A zip and a half of 2 different kinds of herb, which they're saying is intent to deliver because it was in 2 different bags. Well, any pothead here will tell you that a zip and a half is not that crazy for personal, and who the fuck mixes their weed together when they have two kinds? Pretty much all my pipes are gone too. Anyway, they also found the grow. Luckily enough, nothing was seriously in swing, but I don't think that matters. It was just a martha tent with an incubator, nothing crazy, but I'm sure around here, I'll be fucked.
So here's what they're charging me with:
Reckless Endangerment for the supposed gun thing, but I'm pretty sure that will be dropped because where's the proof?
Paraphernalia
Possession of THC with intent to deliver
and whatever the charge is for the grow, which I don't even know what they're going to call that.
I just got out of jail from the weekend on a signature bond (THANK GOD!) and now I get to deal with all these fun court things.
What I want everyone to take away from this is:
1. Trust in the Force - if something doesn't feel right, at all, get out. It's way better to be safe than sorry.
2. Do Not answer calls from restricted numbers; there's a reason they don't want you to know who they are.
3. Just don't grow if you know crazy people.
4. DO NOT keep hard copies of grow logs. If you really want to do one, get TrueCrypt, and encrypt a flash drive with a crazy good ass password.
5. Think. Just stop and think.
I know, I probably did some stupid shit, and I fucked up, but I'm going to take responsibility for it. I'm going to be so fucking in debt from lawyer and court fees, and I doubt I'll ever be able to pay for it. And to make things even better, I just found out I may be a dad soon. I don't see that as a bad thing, just something that is horribly timed. So, I'm not requesting everyone to help me out, but if you can find it in your heart to do so, at all, it would be greatly appreciated. Just PM me if you want. I love you guys and gals, and I'll always love growing mushrooms, even if I can't do it. I hope that this provides some insight, even if it isn't that helpful.

Dude, fuck off about the name thing lol, it was my gamertag when I was like 13. I know, I'm looking for money wherever I can. 5 years of work, down the fucking drain. I wish I had a decent camera so I could show you guys what a raided op looks like. At least they left me my 100lbs of birdseed. Looks like my yard is going to have a lot of avian friends in the near future.

No fruits and no dry product. I had a bunch of bags of premade substrate that they thought were mushies right away lol. Anyway, about not associating with sketchballs - did you fucking read my first post? The kid used to be like family and we were going to try and get him help, sorry for trying to be good to a friend. There was no way to see this shit coming.
I think they do, however, have a right to take the grow even though it wasn't on the warrant, but the fact they did not find the one thing on the warrant doesn't make them look great either.

I was thinking this as well. A friend once had his house raided for bullshit his dad was doing on the computer. They were there to seize the computer but also found a bong and a bunch of pot. They had to leave that stuff there because it wasn't what they had a warrant for.

Kinda the same here, but it went both ways. Was squatting at a friend's house and his father got raided for illegal porn. The warrant was for every type of media you could think of and more.
They took all the drugs and pipes. Friend took the hit because it was his idea to pick some up the night before. I still owe him a solid, I bring it up once in awhile, and he still tells me he'll let me know when.
But yes, the drug charges and paraphrenalia stuck. There was a grow op his brother was doing in the room I was staying in (unbeknownst to me). They took all the syringes, bags, jars, but left one completely colonized jar sitting upside down in the center of a table.
The grow never came up anywhere along the line. The jar they left could've been fruited. Apparently there were a lot of mycobags and jars inside a dresser and behind a panel in the closet. Nothing stuck to the brother at all.
The porn (obv) and the pot (wtf?), but not a clandestine mushroom grow.
Better have a good lawyer. This one cost this man his house.

I'm pretty sure someone's going to eventually say this, but I'm 99% certain if they have a warrant and find something illegal it is within their authoritative means to take it & charge for it.

Yea, if they have a warrant for something, they can look anywhere that that item may be. IE: if they're looking for a bike, they can't look in a drawer because it's obviously not going to be in there. Thanks for the support guys. I'm sure they'll still prosecute for the grow, but, like I said, it sure doesn't make them look too good when they didn't find the one thing they came for.

Like someone else said, they didn't find what was on the warrant, and anything else taken cannot be admitted into court. The warrant was for one thing, they found another, and NOT that one thing.
Your stuff is seized, but you cannot (if memory serves) be charged with it, I think.
Have your lawyer look into these things.
Go to the court and talk to a secretary and get copies of EVERYTHING they have to date.
Read the 4th amendment. "The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized."
So, bring this to the attention of a lawyer and see if you can't get all of this shit to go away right quickly.

I don't believe that's correct. I'm pretty sure that blatant evidence of a crime found while executing an otherwise legal warrant is permissible.
