You can't. Just the way they like it.

San pedro is a common decorative succulent for landscaping, so of course people don't get charged for it... But being illegal, they could choose to prosecute someone for it if they really wished.

That's how the drug laws are written. They want to be able to charge anyone they desire of criminal activity at any time, though in general they elect not to.

Also, to get a conviction, they would need to demonstrate the intent to possess mescaline. If you are wholly ignorant of the fact that the cactus contains mescaline, you're not legally liable. But as soon as you're cognizant of the fact that they contain mescaline, you're guilty of manufacturing.

Nifty, ain't it?
