If you were driving while drinking, say with a bottle of JD, and you got pulled over, wouldn't it be possible to just jump out of the car real quick and chug your bottle. Then when they say you were driving drunk you could just say you weren't drunk when you were driving you just drank a ton outside of the vehicle....Just a thought..

Hmmmm, for some reason I just can't see the cop letting you on your merry way...He'd probably say you were brandishing the bottle like a wepon and tazer your ass, then proceed to beat you vigorously...

In UK the offence is "drunk in charge". So although you are outside of the vehicle you are still in charge of it. It doesn't matter if you're driving or not.

Technically a person can be done for just unlocking a car door when drunk, as she/he would be deemed to be in charge of the vehicle. The police, however, will usually wait until the person starts the engine before doing them as it saves them a bit of effort in court.

And i personally think that people who drink and drive should be hung by their intestines. If you've ever been hit by a car you'd know why.

Once again im angered at the fact that Im forced to share the world with such fuckheads. I would take in to account the stupidity-to-age factor, but, it doesn't apply in this case because you have to be at least 21 to be legally in possession of a bottle of liquor for that scenario to possibly work in the first place. Buy a computer and a driving game...cuz thats where your headed after your license gets revoked...

It was a question to start a discussion. I wasn't plotting to go out drinking and driving and I am highly against it. You don't need to jump to conclussions and try to start a big argument. A simple yes or no and why would have been fine. You do have to share the world with fuckheads but I am not one of them.

i personally think drunk drivign is bad. i mean some people can pull it off but nto if a real dumb ass is about to hti u and u cant react properly in time. dont do it or do it but do it not very smashed at least ive seen to many friends accuantances die. anyway jsu tmy 2 cents.

I would imagine they could just get you for drunk in public at that point. I mean you can't really say you weren't drunk at that point, they would have just watched you down a bottle. I'm sure they could get creative and hit you with a few other things too.
