San Pedro legality question

This has been puzzling me. Mescaline is a Schedule I substance. San Pedro and other cacti contain Mescaline. San Pedro in itself, according to Erowid, is legal to possess, as long as it's not dried or prepared for ingestion. Despite this, certain online companies sell dried pieces of powdered San Pedro. This is illegal, correct? Is it just a matter of hopefully getting away with it? Would one be better advised just to purchase a live San Pedro?

Honestly I'm not sure, I've ordered dried cactus flesh that is marked as incense and never had problems. Recently I've ordered 500grams and still didn't have any problems. If you can get it this way it really is the best, I'm getting 1.5% Mescaline Acetate yield. So nice! lolz.

No, it is not illegal to buy it as incense. Who's to say you're not using it as an incense?

Human consumption however is illegal.

Buying it powdered is a way preparing it for consumption,

nobody uses it as an incense. The DEA may be ignorant but they're not stupid.

Yeah, but I am just saying that is how vendors get away with selling it as such....

But I would stick with live San Pedro either way.

I don't buy it powdered, a lot of vendors will screw you with powdered flesh, just get the pieces of flesh, that way you can tell the quality much easier.

LOL it is legal as long as you do not use the powder for illegal purposes.Its the same as dried poppy pods.
