Shouldn't an internet provider be able to utilize their infrastructure as they see fit, provided it complies with contracts made with the customers?

then you get comcast throttling bittorrent protocol, etc..

i am not aware of a petition but i'm not worried at this stage in the game.  it sounds like the bill is flawed on its face, plus the reps are in a weak position.

And why should such a practice be illegal? A provider of a good or service sets the rules for its provision.

The only leg to stand on regarding this argument is the fact that local governments allow utility monopolies in their jurisdiction.  If more competition among cable and internet providers was allowed, methinks you would see a lot less of bandwidth caps and throttles.

consider the historical circumstances that allowed for the internet in its current form, and recent events that suggest it is under threat.

the comcast issue was resolved by fcc vote.  if mccain's bill takes away fcc powers, comcast customers may again face bittorrent throttling.

more generally, unrestricted "quality of service"-type behavior by isps will restrict (slow down, throttle) online freedom of speech (ie shroomery) & press, open source efforts, and other global goods that the internet currently enables in a first class manner.

Good thing we live in a capitalist society where the consumer can leave internet providers that throttle traffic for ones that don't.

I live in an area where there is only one provider of high speed internet...I'm sure there are lots of other people in this situation as well.

comcast is enormous and for many of its customers it is the only choice.

if there's one thing this bill tells me, it's that despite obama's flaws, mccain would've indeed been far worse.
