In Florida (because of case law Fiske vs State of Florida) fresh picked mushrooms (even actives) are legal. Also, you must claim that you were picking edible shrooms for food and never admit to any knowledge of their psychoactivity. If you have dried active shrooms they are illegal.
Again this is case law. Also, anyone can be charged with anything. Of course our legal system's motto is innocent until proven guilty but real life can teach you otherwise.
I think one reason why fresh mushrooms don't catch a charge in Florida is because law enforcement doesn't know how to dry them out (store them properly). This is a guess though. I can picture someone's fresh cubes confiscated and stuck in a sealed plastic bag. Then when they call for the evidence - all they have is a pile of goo left

Fresh mushrooms are illegal in Florida if you admit knowing what they are. The Fiske decision only applies if you don't know what you have picked.

Its because the drug laws specify that you need to have intent to possess the controlled substance. So if you don't know what you have, you are not guilty. Since most people can not ID mushrooms, the court assumes that you are innocent unless there is evidence that you know what you have. That evidence can take the form of dried mushrooms or a statement from the suspect stating that he was picking psilocybin mushrooms.

I think that is the correct answer.
Seems silly to move somewhere just so you can eat psilocybin mushrooms legally. They are legal everywhere if you don't get caught and keep it quiet. The vast majority of psilocybin mushroom users never get caught.

British Tortola may be something to explore..
I recalled reading something about mushrooms readily available on the beach, I can quote http://wikitravel.org/en/Tortola as saying "Mushrooms are legal in the British Virgin Islands. The native species grows in the hills and is available after rains, which occur throughout the year. Mushrooms are available at full moon parties, the right bars, and from casual purveyors. Although they are legal, many non-trippers frown on their use and it would be gauche to roam the town asking strangers for mushrooms. Rather, have a few drinks with a native or expatriate who seems to be of the right attitude and bearing before bringing up the topic. "
Whether or not that is entirely accurate, I dont know. I suppose it is possible that the British Isles dodged the mushroom ban a few years ago in the U.K. (I heard they used to be legal there.. ).
Aside from that, you may explore Portugal and/or Uruguay. In both cases an understanding of Spanish and/or Portugese will be required.
Do your research and make sure you are moving for the right reasons if you do decide to go through with it.
