Okay, so i sold an item on eBay...

i recently just sold a CDJ-1000MK3 digital turntable to somebody in Australia as NEW. it was a kid using his mom's credit card and what not, and i had several eBay messages with him about the item. i had told him that i USED it once to verify it's in perfect working condition, and that i would also have to ship it in a different packaging as to avoid certain costs when he receives the item (clerk at the post office told me shipping it in a diff. box and as USED would lower the cost for the receiver when getting it for some reason?). i made sure there were no scratches or anything before i listed it on eBay.

now the kid's mom has filed a claim dispute on paypal stating the item was not as described and that i said i was going to send it in the original packaging (which i discussed i wasn't) and that it had scratches all over it! she says it's clearly been used and that something rolls around when you shake it (WTF?! why would you shake it, of course something sounds like that)... no my paypal balance is -531$ and to resolve it i have to refund the bitch, make a different refund offer, or not refund it and go w/ another option (paypal didn't describe what the option was though). i don't have any money in my bank account so it would be a major overdraft if i refund it.

WHAT THE HELL SHOULD I DO?! should i just deny the refund? what would happen? i mean i sold it as NEW, but had opened the box, but never really USED it at all.

Sounds like the usual scam to me. They get a free turntable and you get nothing. That ship happens on ebay all day long. Your going to have to send the money back if you ever want to use palpal again. I have had 3 items charged back on me from stolen cards or people claiming item was never sent etc.

Your getting screwed in the deal and there is nothing paypal is going to do for you.

Lesson learned: screw Paypal.

People get away with stealing stuff from ebay sellers every day, because Paypal always sides with the customer (them). Not sellers.

If you ever sell anything again, take the money out immediately so Paypal can't do jack, and the person will have to sue you. Paypal can go fuck themselves.

What you should do is file a claim against her, and send paypal the emails, although it's almost 100% that they won't care. I'm sorry that you're getting screwed out of over $500 worth of merchandise.

Also make sure your bank account attached to paypal is empty, they will just withdraw it from your bank. :shakefist:

I think you screwed up by opening up the box. I don't know really what to say though. I have no ebay/paypal experience

call paypal..

I had a problem with someone denying I shipped them the item, and they held  the funds pending dispute.

Luckly I had the tracking number, paypal verified it was delivered. they released the hold on funds and closed the dispute.

if you look in your account at the dispute there are instructions of the different options you have.

ebay and paypal are the same company i think, so if you violated ebay policy about listing it as new and it wasn't, that was reason enough for the buyer to open the claim.

but, call them tell what happened, ask them if the email conversations help in your defense. at least they are admiting they received the item.  ebay also has a selection when listing your item, a selection that is mandatory where you have to select the return policy... what did you select?

Ya man you should not have listed it as NEW if it wasn't NEW.  In box.  Used once is not new.  Used once is "Used - like new".  You fucked up by opening the box.  Unless you can prove to them that you did in fact discuss all of these things PRIOR to the bidder buying the item, you're screwed.  I hope you keep your e-mails.

I've done international dozens of times without a problem, usually sells for 25% more, just make sure they have plenty of feedback.

Paypal gives seller protection to Canada, Mexico, and UK if they have a confirmed address.

gave paypal all the messages and they gave me my money back :-)

I am happy that you have had good experiences with doing so, but i have heard so many fuckin horror stories, that i simply adopted that one and only catch.

You hear more horror stories because that is what people post-- their problems with international trades.  then people talk about the stories they heard, then people talk about the stories people talked about that they heard, etc...  lol

I have sold to Brazil, and Austrailia before on ebay.  the shipping was expensive, but they paid for it. I didn't do as asked by the person from Brazil, he asked for me to claim it as a gift under $50... on a $500 sale..  that would be mail fraud, plus it wouldn't help in my defense if a dispute were filed...

sue them for mail fraud or just sue them.  tell them they can return it as long as its in the original condition and assuming it gets sent back within 30 days.  any "scratches" are shippings fault and they should have got insurence and they need to talk to the carrier or refused shipping.... they signed for the package which means they accepted it and wanted it.  tell paypal everything, and that you want your money asap, and then tell them if they ever take your money again without talking to you first that you'll never use their service again.

Dont bother with paypal.  Change your bank and credit card numbers so paypal doesnt charge you and abandon your account.  When they send it to collections immediately dispute it with a form letter you can find on the net and registered mail.  Check your credit report and accounts regularly and be ready to dispute anything right away.

I have done this before for $80.  I disputed the collections successfully and have no bad credit on my record.

well i think the only shitty thing is, i didn't directly say i had opened the box. what i did was tell the buyer that the post office insisted i sell it as used rather than new because it would reduce the cost for the buyer (which implied that they took it out of the original box and put it in their packaging boxes). he said that was fine and so i assumed he knew what i meant. i did state there was no refund, but unfortunately i had buyer's protection on there...

i think i'm basically fucked since i sold it as NEW and not as USED-like new since i had used it once to verify it's in good working condition. i told the buyer this as well. the problem is, we discussed all of this after the bidding had ended because he bought it within 4 hours of me posting it on eBay...
