Opinions on being pulled over while on Ambien/DPH?

I know legal advice is best from lawyers, but what do you guys think the punishment will be for this situation? Basically, I was under the influence of Ambien and diphenhydramine, and was kinda driving slowly, swerving around the streets and got pulled over. Completely failed the roadside sobriety test. But I wasn't drinking at least. Obviously I fucked up, but still. I wasn't riding dirty, thank God. But they did make me take a UA, and that will likely bring up weed, and possibly Ultram and Ambien, both of which I don't have a prescription for. But I was cooperative. Could they also nail me for that though?? I live in Iowa, by the way. Just looking for opinions. :P

I know I do. I can admit I fucked up. Normally, I hate drunk drivers and impaired driving, and I'll never understand why I decided to get in my car that night and drive, but yeah... Basically, all I remember is taking an Ambien. Next thing I know I am being pulled over. It's all a haze between those events.

I guess my biggest concern is the piss test. I just know it'll be dirty. But at the time I didn't have anything on me, and I told the officer the only thing I was on was diphenhydramine. Could they use other things on the drug test against me? Or even get additional charges?? :[

It's possible they may try to file additional charges. In any event, you're probably going to catch a DUI. Sorry about that and good luck.

If you dont know, just keep refusing all bodily samples till they take you to the "blood chair", where 10 cops and a bunch of leather straps will be applied and a sample will be taken by force.

THEN! you know you have to give a sample and you can go ahead and peacefully piss in a cup.

nope... in most states you give 'implied consent' when you drive to submit
to tests to determine if you're intoxicated, a refusal loses your license
for 6mos-1year

yes, you can still get the charge if you're over 21, have a blood alcohol
level below the legal limit but show yourself to be impaired

Well, in case anyone's wondering, I called the police station that arrested me today in order to see if they could let me turn myself in when the time comes to arrest me instead of surprising me at work or home if they do end up charging me, and they said they would, and the officer also told me since the only thing I was initially arrested for was for driving while intoxicated and didn't have any drugs on me or anything, they'd only charge me for the DUI regardless of what they find. On one hand that's shitty, because even if it's just DPH or Ambien they find, I'll get the DUI. But I guess that also means even if they find weed, it'll still just be the DUI charge. He actually even said, "Even if for example we find cocaine, it'll still be the DUI charge." That was a pretty strong example, so that kinda relieves me a little. Guess I'm gonna have to prepare to start getting used to driving on a suspended license for 180 days if I can't get a work permit...

Oh well, shit happens. I never drive impaired, and I hate drunk drivers and all that, but... That's how life goes.

Good luck. Depending on what state you're in its either illegal or they'll just take you to jail and get a blood test.

If he was swerving and driving on the shoulder that would be enough.
