NYC - Month to Month - Can I use my security deposit as a last month?

We aren't in any lease agreement just month to month. I also do NOT want him to show my apartment during my last month. For obvious reasons. I do not want to pay another 30 days just to get it back at the end of the term or to have a pain trying to get it back.

It is an illegal apartment. What do you suggest?

Illegal apt. with no lease, I don't see why not. I take it you're not planning on giving any notice?

I just gave him my 30 day notice today. I told him I don't have money for the last month and I asked if I could use my security deposit for it. He said I can pay him the rent in the next 1-2 days and that he'd pay me back deposit at the end of the month.

He'll probably try to fuck you over on the deposit. He will find little things around the apartment to charge you for. He will do everything he can to collect this months rent and of course keep the deposit. If he doesn't get the rent in a couple days he will probably serve you with an eviction which will really fuck you over. So I say pay your rent now and get away from the slum lord before you get an eviction on your record. And good luck getting any of that deposit back.

I hope you got that in writing or on tape. I don't think he can legally evict you, but he can change the locks and throw your shit out. Might want to call Housing or L&I for advise... :goodluck:

This is a month to month. This is a house and he lives above me. I live in the basement. He doesn't have any information on me other than my license.

Do you think he would keep my deposit even though I know where he, his wife, and two children live?
