US: Man sentenced to 5 years for marijuana crop
    #11220312 - 10/10/09 01:17 PM (8 years, 10 months ago)

Barbara Boyer

Philadelphia Enquirer

Saturday 10 Oct 2009

Jarvier Sandoval was, by all appearances, a dedicated horticulturist who kept watch over his tender shoots at all hours.

Just two problems. One, his garden was in Wharton State Forest in Waterford Township. Two, he was growing cannabis.

Sandoval, 27, appeared yesterday in Superior Court in Camden, where he was sentenced to five years in prison for possession of 325 marijuana plants with intent to distribute.

Authorities became aware of the ganja growing in the Pinelands National Reserve in December, according to police reports and Assistant Camden County Prosecutor Tamika McKoy.

As their investigation progressed, authorities learned that Sandoval and Manuel Diaz, 26, had set up camp near a patch of land 120 feet by 150 feet, nearly the size of a football field, where they cultivated their marijuana crop. The men, who had no other known address, kept a tent and sleeping bags there and maintained a constant watch over the plants, police said.

One day in May, authorities said, the duo was running out of food and one was spotted making a grocery run.

At 6 a.m. June 15, arrest teams moved in on Sandoval and Diaz. Also apprehended was Juan Cardenas, 43, who arrived in a truck filled with fertilizer, tubing, and rain suits, authorities said.

Police harvested the 325 plants as evidence.

Sandoval pleaded guilty in exchange for the five-year sentence. Judge Samuel D. Natal noted that aside from the marijuana garden, Sandoval appeared to have led a life free of crime.

Charges are pending against Diaz and Cardenas.

As a hiker, I have to wonder whether I'll accidentally stumble into one of these camps and suffer grievous, physical harm.

They dammed off a watersource on an FOF's property, leaving a tenant, livestock, landscaping, and wildlife with nothing to drink. If they want to restore their land, they have to live in fear of reciprocity.

This guy should probably hire CapHat on as his lawyer.  There's clearly no victim here - no corpus-delecti.  We all know that

Hopefully the guys can earn some time off their sentence by tending the jailhouse garden.

But seriously... why send them to jail? How is that protecting the public? It just makes their lives miserable and puts them in close association with more serious offenders in jail, which is a breeding ground for criminality. Their more likely to pose a danger to society AFTER their punishment than before!

A STATE forest, private land? And he negotiated any rights he had when he made a plea. "Once a plea is made to a court, the court now has jurisdiction to hear the case". He should have demanded a tribunal  and he should have made it clear on record that he is not one of their citizens and this court does not have the right to hear this case. An apeals court will over turn that shit quick and reprimand the judge who went ahead and pushed him through the system. But instead he accepts an officer of that court to speak for him and makes a plea, its sad but hes fucked. In the subject bar it read US man like hes a part of a corporation that can tell its employees what to do? That should give it away they say he a US citizen and he say he is too when he makes pleas.

One can only appeal to a higher court about what you have objected to. Preservation of record is every thing, remember court is not about judges and lawyer its about paperwork.

^^^^^  Your kidding right ??  If this dude was in New Jersey which i think he was than the guidelines for over 50 plants is 10 to 20 years.  So for dude not to cop a plea is just plain insanity !  I've been through the court house a few times and seen people both cop please and say fuck them and fight it, 90% of the dudes who fought it lost and got basically what ever the prosecutor wanted, so to fight a 5 year bid with 20 something hanging over your head you would def need some huge brass balls!

Get out your guns fellas. The law refuses to open its ears to the public and listen so we gotta put a new hole in their head so they can hopefully get the message. When are we going to get sick of it and fight?
