UK: Arthritis sufferer spared jail over cannabis crop

another case of the media referring to gardens as factories:confused:

Evening Post, Nottingham

Thursday 01 Oct 2009

AN ARTHRITIS sufferer who smoked cannabis to ease his symptoms has been spared prison for growing his own crop.

Jason Turner, 23, of Wheatacre Road, Clifton, converted his loft into a small cannabis factory of 20 plants.

Nottingham Crown Court heard the electricity was not bypassed at the house, which is often a common feature of homegrown crops, and there was no evidence of any previous crop grown there.

Turner had suffered since he was a baby with severe arthritis and began buying cannabis when he was older to help.

When he got into debt, he had a go at growing his own.

He pleaded guilty to producing cannabis in February after a police search exposed his illegal activity at the property.

The flowering cannabis tops – the most valuable part of the weed – weighed 1.11 kilogrammes and would have been worth between £3,700 and £17,500 if ever sold.

Turner, who had previous convictions for three driving-related offences, told police he smoked the drug nearly every night to "chill himself out".

Richard Posner, mitigating, said: "There was no initial intention to supply. As your honour has pointed out, this was far from the usual cannabis factory set-up. There was no sophistication. He is capable of carrying out light community work."

Judge Michael Pert QC imposed a community order, to include 150 hours of unpaid work and supervision.

"Make no mistake, cannabis farming is serious," he said.

"It does in normal circumstances cross the custody threshold. Yours is an unusual case."
